PROJECT DESCRIPTION/BACKGROUND: The applicant is proposing to reuse and slightly modify an existing 2 -sided 26 -foot tall pole sign previously utilized by the Keg Restaurant for the new AFK Elixirs & Eatery restaurant and bar. The project site is located within the Urban Design -- District D and the Commercial Arterial (CA) zone. The City's sign regulations (RMC 4-4-100G.5) prohibit the use of pole signs within the Urban Design Areas and require the removal of signage within 90 days of the closure of a business (RMC 4-4-100D.6). Therefore, the existing non -conforming pole sign should have been removed upon the closure of the Keg Restaurant. The sign is located on the northwest corner of the property within an existing landscaped area. The applicant is proposing to add approximately 13 square feet at the top of the sign and 3.5 square feet at the bottom of the sign of decorative gear shape and logo backing panels. The base cabinet would be repainted to match new artwork colors. New manufactured efficient LED backlit channel letters "the AFK" and "elixirs & eatery" would be installed over the top of the newly refurbished base cabinet. C. FINDINGS: Having reviewed the written record in the matter, the City now makes and enters the following: 3. Request. The applicant has requested an administrative variance from RMC 4-4-100G5 to reuse an existing, non -conforming pole sign for the AFK Elixirs & Eatery restaurant and bar. 2. Administrative Variance: The applicant's administrative variance submittal materials comply with the requirements necessary to process a variance request. The applicant's site plan and proposed sign photo simulations are provided as Exhibits 3 through 6. Existing Land Use: The subject parcel is surrounded on all sides by existing commercial uses, including but not limited to Clarion Hotel to the north, Harley Davidson to the west, Mitsubishi to the south, and SR 167 to the east. The subject site is currently utilized by the new AFK Elixirs and Eatery restaurant and bar (previously the Keg Restaurant). 4. Zoning: The subject property is within the Commercial Arterial (CA) zone and Urban Design --- District D. 5. Topography: The site relatively flat. 6. Lots and Building Size: The lot area is 73,020 square feet in size and the AFK Elixirs and Eastery restaurant and bar is 8,460 square feet in area. E. CONSISTENCY WITH VARIANCE CRITERIA: Section 4-9-2506.5 lists 4 criteria that the Planning Director is asked to consider, along with all other relevant information, in making a decision on an Administrative Variance application. These include the following: The Planning Director shall have authority to grant an administrative variance upon making a determination, in writing, that the conditions specified below have been found to exist: a. That the applicant suffers practical difficulties and unnecessary hardship and the variance is necessary because of special circumstances applicable to subject property, including size, shape, topography, location or surroundings of the subject property, and the strict application of the Zoning Code is found to deprive subject property owner of rights and privileges enjoyed by other property owners in the vicinity and under identical zone classification: The applicant contends that practical difficulties exist and that the strict interpretation of the sign regulations would deprive them of privileges enjoyed by other property owners in the vicinity. The removal of the existing sign would involve capping the pole and digging up the foundation adding substantial cost to the operation of the restaurant. In addition, East Valley Road is a utility right-of- way corridor with underground sewer lines, gas lines, and electrical lines. In order to ensure these utility lines are not disturbed during the installation of a permitted ground -related monument sign, the applicant would be required to verify and test the existing soil conditions, possibly utilize hydro -vac excavation methods, haul away soil, deal with possible groundwater, reinforce or sleeve existing utility lines, and install a new foundation. Given the position of the utility lines, it is questionable whether there is room for an adequate foundation to support a monument sign. In order to place such a sign in a useful location, visible to customers driving from both north and south, the applicant may be required to tear up asphalt, run electrical wires under the pavement, remove existing landscaping, and existing required parking, and repave portions of the parking lot. Staff has reviewed the proposed variance request and concurs that the requirement to remove the existing pole sign and replace it with a ground -related monument sign may cause the applicant unnecessary hardship. Easement 8106180669 for the underground electric system runs along the project site's East Valley Road street frontage. The location of the underground power lines may preclude the installation of a ground -related monument sign, which results in a practical difficulty to meet the strict application of the zoning code. b. That the granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which subject property is situated: The applicant contends that the reuse of the existing pole sign would allow for the use of the existing underground electrical power lines, which would not be injurious to the street appearance. The applicant also contends that the proposed reuse of the existing sign would improve the street appearance as the proposed sign is more attractive and has a better design than the previous Keg sign. Staff has reviewed the applicant's justifications and concurs with their analysis, the reuse of the existing pole sign would improve the street appearance of the subject property as the proposed sign is of a better design than the existing sign. In addition, the reuse of the existing sign would limit the amount of ground disturbance that would occur if the applicant were required to remove the pole sign and install a monument sign. The granting of the variance would not be detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which the subject property is situated. c. That approval shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and zone in which the subject property is situated: The applicant contends that the approval of the variance would allow the tenant the same privilege already granted to other businesses in the vicinity. Nearby restaurants operating in the same zone including Burger King and Royce Coffee Lounge have been permitted to utilize pole signs to identify their businesses (Exhibit 6). Royce Coffee Lounge was recently granted approval to reuse an existing pole sign just two lots to the north of the project site. This sign was previously approved via a variance in 2002 (LUA02-128, V-A). Staff has reviewed the applicant's justifications and concurs that the approval of the variance would grant the applicant the same privilege to utilize an existing pole sign and has been granted to other properties in the vicinity and same zoning designation. In addition, the granting of this variance would not constitute a grant of special privilege, as available space on site for a monument sign is encumbered by utility easements that significantly limit the applicant's ability to install a monument sign (Exhibit 3). d. That the approval as determined by the Planning Director is a minimum variance that will accomplish the desired purpose: The applicant contends that the approval of the variance is the minimum necessary as they are not requesting a taller pole, only the reuse of an existing pole with the installation of a similar size sign as was previously installed on the project site. Given the limited visibility, it is clear that a pole sign is the bare minimum that will make this business visible to drivers on East Valley Road. The approval of the reuse of the existing pole would allow the applicant to install a sign of similar size as what was previously approved on the project site for the Keg Restaurant and grants the applicant the same privilege granted to other properties in the project vicinity. However the approval of this variance should not be intended to grant future tenants the ability to reuse the pole sign. Staff recommends as a condition of approval that the variance approval to reuse the pole sign be valid for a period of 10 years or until a change in tenant whichever comes last. The 10 -year time frame allows the new business the opportunity to operate and gain capital to provide sufficient funds to complete the larger amount of work that would be necessary to construct a monument sign. With this condition of approval, the current tenant will be able to utilize the pole sign for the time that they occupy the site, and if the tenant changes, a new tenant could use the pole sign until April 21, 2024. With this condition of approval the request is the minimum variance that would accomplish the desired purpose. F. CONCLUSIONS: 1. The subject site is located on the east side of East Valley Road, at 3750E Valley Road, within the Commercial Arterial (CA) zone and Urban Design District D. 2. The sign regulations prohibit pole signs within Urban Design Areas. The applicant is requesting approval to reuse an existing pole sign. 3. The requested variance meets the four criteria to be considered in making a decision on a variance request as specified in RMC 4-9-2506.5. The analysis of the proposal according to variance criteria is found in the body of the Staff Report. G. DECISION: The Administrative Variance for the AFK Elixirs and Eatery, File No. LUA14-000368, is approved subject to the following condition: 1. It is the goal of this variance to allow AFK Elixirs & Eatery, an upscale dining and entertainment establishment, to reuse and slightly modify an existing 2 -sided 26'tall "Keg Restaurant" landmark pole sign located at 3750 E Valley Rd in Renton (exhibit A) to help people identify and locate a new business. Making use of an existing double sided blank sign cabinet, pole and electrical wiring that is all structurally sound would represent a significant manufacturing cost savings. We propose to change the overall existing sign area by adding minimal extensions of about 13.0 more square feet at top and 3.5 square feet at bottom of decorative gear shape and logo backing panels made of routed and painted aluminum to be field attached. The base cabinet would be repainted to match new artwork colors for an overall appearance revision. New manufactured efficient LED back lit channel letters "the AFK" and "elixirs & eatery" would be installed over the top of newly refinished base cabinet. The total addition would increase the sign area by 16.5 square feet and would not represent a significant change in structural loading. This would be the same on both sides of sign. This type of sign is typical in this area for proper business branding and is reflected in no fewer than 10 pole signs in the close proximity (exhibit B). Current code requires removal of pole signs, with exceptions for certain business types, showing unfair bias. The existing sign planning code mandates that this sign be removed even though other similar signs have recently been allowed. The current code would require this sign to be replaced with a ground monument sign. No other monument signs are visible in the vicinity. With limited height and limited night lighting, the current code requirements would prove to be a costly and ineffective solution. Removing this pole sign incurs the cost of removing existing steel structure and sign cabinet and possibly portions of existing foundation (requiring expensive equipment, including cranes, large trucks and backhoes), hauling/disposal, and relocation of existing power to reach the new mandated limits of sign location. This sign relocation requires costly excavation and power relocation and requires major modification and removal of existing mature vegetation for 50 feet in either direction and replanting of new to provide low ground cover to allow for sign visibility. The existing mature landscape ranges from 5' to 10' and code allows for a new sign with maximum height of only 5' which would also be set back thereby limiting passing visibility by visual triangle limits at entrance (exhibit Q. The new sign would not be allowed to have more than 10 square feet of illuminated logo area and would diminish nighttime visibility compared to existing larger pole sign. This will add many thousands of dollars in work, not including the cost of the new sign. In the nature of making use of an existing structure as a way to recycle and reduce costs, we propose to renovate the old sign with a fresh contemporary look. We are asking the board to consider allowing this sign to be updated, thereby helping the existing neighborhood by encouraging this upscale establishment that will provide a needed service to many, strengthen the local economy as a contributing tax payer, and offer a positive and attractive look to a growing area. The pole sign is the best solution due to extreme cost and loss of visibility if removed. Granting of the variance will not be materially detrimental to public welfare or injurious to the property or the vicinity. The proposed AFK sign would re -use an existing pole sign formerly used by The Keg (exhibit A), with the same underground power lines, so it would not be injurious to the street appearance. In fact it would improve the streetscape because the new AFK sign is a much more attractive and well-designed than the previous Keg sign. 2. Strict application of the Zoning Code would deprive subject property owner of rights and privileges enjoyed by other property owners in the vicinity. East Valley Road is a vicinity with car dealerships, warehouses, business parks, hotels, and restaurants, with no residential housing nearby. Almost all businesses within eyesight of this property have pole signs,including: Harley Davidson, Honda/Yamaha, Clarion Hotel, Royce Coffee Lounge, Burger King, a casino, and IKEA. Neighboring property, a Mitsubishi Motors car dealership, has a tall sign even larger than a pole sign. (See exhibit B, attached photos of the views of East Valley Road and surrounding pole signs.) Regardless of where zoning lines are drawn and which businesses are excluded from city requirements, it seems unfair to single out AFK restaurant as the only business not allowed to have a pole sign on a street with many of them. 3. Variance is necessary because of special circumstances. AFK Elixirs & Eatery is a new type of business, ideally suited to Renton: a restaurant and bar specifically appealing to "geeks and gamers" - computer -savvy people who enjoy playing video and board games. AFK Tavern in Everett, operated by the same business owners, draws enthusiastic customers from many miles away, has 22,000 "likes" on Facebook, and has customers willing to wait 3-4 hours for a table. With employers like Boeing and Wizards of the Coast in Renton, as well as many high-tech and software firms in nearby King County, this restaurant will not only provide jobs but also attract skilled, well-off clientele from throughout the region. Many of them will be arriving via Highway 167 and will not be familiar with East Valley Road. Given the nature of the business, many will be searching for the restaurant after dark, especially in winter months. Without a clearly visible sign, these customers will have trouble finding AFK. A "monument' ground sign would be visible only once a customer has arrived at the property entrance. Attached photo shows that even the temporary banner sign - 8 -feet tall -- is not visible from the street at the property boundary, compared to the pole sign, which is clearly visible (exhibit C). A monument sign, limited to 5 -feet tall, would be even less visible and would cause potential customers to brake sharply or make a U-turn, disrupting traffic flows, because they could not see the restaurant in advance. 4. Applicant suffers practical difficulties and unnecessary hardship. The applicant began the process of sign approval in October 2013 and has already lost five months in the approval process; because of that loss of time, AFK has to open its doors with only a temporary banner, allowable for only 20 days. Even if this variance is approved, AFK will not be able to have a permanent visible sign until mid-May at the earliest - two months after opening and seven months after starting the approval process. Considerable engineering costs have already been incurred. To comply with strict application of the Zoning Code, applicant would professional sign company, it is clear that erecting a "monument sign" would present the following unnecessary costs and hardship: a) Removal of existing pole sign, formerly used by The Keg, would cost at least $4200. Pole would have to capped and foundation dug up. b) East Valley Road is a utility right-of-way corridor with underground sewer pipes, gas pipes, and electrical lines. In order have to create a "monument" sign. After consulting with the city and with a to not disturb these utility lines or subject them to structural weight, installing a new monument sign would require the verification and testing of soil conditions, possible hydro -vac excavation, hauling away of soil, dealing with possible groundwater, reinforcing or sleeving of utility lines, and putting in a new foundation footing. That could triple the cost of the foundation work. c) Given the position of the utility lines, there is a question of whether there is room to provide adequate foundation for a monument sign. In order to place such a sign in a useful location, visible to customers driving from both north and south, it might be necessary to tear up asphalt, run electrical wires under the pavement, remove mature established landscaping that blocks visibility, and repave parts of the parking lot, if the sign took up one or more parking spaces, it might require additional spaces elsewhere on the property. These added costs are prohibitive to a young company just getting established in Renton. 5. Approval does not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity. On the contrary, approval would give property owner and tenant the same privileges already granted to other businesses in the vicinity. Nearby restaurants operating in the same zone and under the same laws including Burger King and Royce Coffee Lounge, both of which have been allowed to use pole signs. Royce Coffee Lounge, a new business, was recently permitted to install its own sign on a pre-existing pole, just two lots north of this property. This variance would grant that same right to AFK. 6. The approval is the minimum variance that will accomplish the desired purpose. AFK is not requesting a higher pole (which would make the business more visible from Highway 1.67) or a significantly larger sign, only re -use of an existing pole with a similar -sized sign. Given the limited visibility even of the 8 - foot temporary banner, it is clear that a pale sign is the bare minimum that will make this business visible to drivers on East Valley Road. AFK's use of the existing pole for a more attractive sign would ensure the arrival of desirable customers to a new business in this area and improve the quality of the East Valley Road business environment.
