A temporary use permit is necessary because the structure does not satisfy applicable development standards (including parking and landscaping) or design district regulations (including building design, pedestrian amenities, materials, etc.) of the CA zone and Urban Design District'D' (Exhibit 2). The car wash and auto detailing business leases the vacant portion of a site which encompasses an automobile repair business (Exhibit 3). A temporary use permit, LUA 10-081, TP, was approved for this car wash/auto detailing use on December 22, 2010 and expired on December 23, 2011. The structure in use at that time has since been removed from the site. Temporary tents (not to exceed 400 square feet) to be removed at the end of each business day were required. While the applicant did not comply with that condition, the existing semi-permanent structure was installed. Analysis: The existing semi-permanent structure provides shelter from the elements for the automobile detailing use that is currently occurring on the site. However, staff supports the applicant's operation of the business as it currently exists for a period of one year. This would allow the automobile car wash/detail business to operate in a sheltered area. Commercial car wash water and/or automobile detailing wastewater may not be discharged to the City's stormwater system. A catch basin insert and oil/water separator connected to the side sewer on the property currently exists. This system must be maintained in good working order. The water source for the business has been identified as from the domestic water meter. Such water source must be maintained. The water source for the car wash/automobile detailing business may not be from the irrigation meter. Staff recommends that prior to the conclusion of the one year period, the subject business cease operation and be removed from the site. Alternatively, the site must be brought into conformance with the Code requirements in effect at that time. Such requirements include, but are not limited to conformance with CA zone development standards, Urban Design District'D' design standards, and surface water development standards.
