The following comments are based on the application submittal made to the City of Renton by the applicant. EXISTING CONDITIONS WATER: The site is located in the City of Renton water service area. SEWER: The site is located in the city of Renton sewer service area. STORM: There is storm drainage in Logan Avenue South. STREETS: Logan Avenue South is a Minor Arterial and Tillicum Street is an aUey. CODE REQUIREMENTS Water 1. The project proposes the extension of about 145 feet of 8-inch water main within the alley (also known as Tillicum) from the existing 12-inch water main in Logan Ave to the west property line of proposed lot 2. 2. The project also includes the installation of a fire hydrant near the northeast corner of proposed Lot 1, connected to the above new 8-inch water main extension. 3. Separate domestic water meters, minimum 1-inch, is to be installed to each unit of the multi-family development. The service line and meter shall be sized to provide domestic and fire sprinkler service. 4. Civil plans for the waler main extension will be required and must be prepared by a registered professional engineer in the State of Washington. 5. Subject to water system development charges, meter installation fees, and related permit fees. 6. A backflow prevention assembly (DDCVA) will be required for the fire sprinkler system. Foster Short Plat -LUA13-001408 Page 2 of 3 November 4, 2013 Sanitary Sewer 1. Sewer service is provided by the City of Renton. There is an 8-inch sewer main in the alley (Tillicum Street). Separate side sewers will be required for the multi -family development. 2. System development fee (SOC) for sewer is based on the size of the new domestic water to serve the new home on each new lot. Sewer SOC fee (2013 rates) for a 'X-inch or 1-inch meter install is $1,812.00. These fees are collected at the time a construction permit is issued and the rate prevalent at time of construction permit will be applicable. Stormwater 1. The Surface Water SDC for multi-family development will be applicable. Current rate of the fee is $0.448 per square feet of new impervious surface area, but not less than $1,120.00. The rate that is applicable at the time of construction permit will be applicable and the fee is payable prior to issuance of the construction permit. 2. A soils evaluation report prepared by Touma Engineers has been submitted for the project. Information must be provided during the construction permit review stage regarding whether the soil is suitable for infiltration. 3. A drainage report has been submitted by Touma Engineers with the land use application. The drainage review type in the drainage report must be based on the 2009 Surface Water Design Manual Amendment. The project is subject to full drainage review. Drainage plans and a final drainage report based on the City adopted 2009 Surface Water Design Manual Amendment and the 2009 King County Surface Water Drainage is required to be submitted with the construction permit. The drainage report submitted with the construction permit must include the correct project description, all core requirements and the special requirements, especially the requirements for flow control, water quality, and stormwater BMPs. Based on the City's flow control map, this site falls within the Peak Rate Flow Control Standard, Existing Site Conditions. The drainage report should clearly show the information of the required frontage improvements and include it in the calculations. All stormwater requirements as per the 2009 Surface Water Design Manual Amendment and the 2009 King County Surface Water Drainage Page 1 of 3 Technical Services December 18, 2013 Manual is required to be provided by the project. 4. A Construction Storr General Permit from Department of Ecology will be req grading and clearing of the site exceeds one acre. Transportation 1. logan Ave South is a Minor Arterial. The strset design is for two 11-100t wide travel lanes, 6-root wide bike lanes on both sides, 8-foot wide parking lanes on both sides, 0.5' wide curb, and gutter. The sidewalks in the downtown district are required to be 12 feet in width with regular street grates. An additional one foot of right-of-way is required between the back of sidewalk and the property line. The project requires the dedication of 8.5 feet of right-of-way (subject to final survey). Foster Short Plat -lUA13-0014D8 Page30f3 November 4, 2013 2. The alley, Tillicum Street, currently has a paved width of 10 feet and a right-at-way width of 10 feet. As per RMC 4.6.060.F.2, the minimum paved width on a residential alley Is 12 feet and the minimum right-of-way width is 16 feet. Therefore, a dedication of six feet is required to be provided with a 2-foot widened alley pavement. 3. All electrical, phone, and cable services and lines serving the proposed development must be underground. The construction of these franchise utilities must be inspected and approved by a City of Renton inspector prior to recording the plat. 4. Traffic Impact Fees -The transportation impact fee s applicable on new multi-family development is based on the applicable fee at the time of building permit application and payment is due at the time of issuance of the building permit. General Comments 1. All construction or service utility permits for drainage and street improvements will require separate plan submittals. DEPARTMENT ANAL YSIS: 1. Project Description/Background The proposed project is an infill subdivision of an 0.10 acre lot in Downtown Renton (Exhibit 2). The proposed project would, if approved, result in two lots accessed from Logan Ave Sand S Tillicum St, a public street and public alley, respectively. The existing house that is to remain fronts on Logan Ave S, but has a single-car garage accessed from S Tillicum St (Exhibit 3). The two-story, single-family residence, built in 1916, would be retained and remodeled. A new multi-family unit (size currently unknown) would be constructed on the newly formed lot to the west. The area is designated Urban Center -Downtown (UC-D) in the City of Renton Comprehensive Land Use Plan. The objectives and policies of the UC-D designation are implemented by the Center Downtown (CD) zoning (Exhibit 2). The potential density for the development would be 100 dwelling units per net acre (du/a). The subdivision ofthis relatively small lot (0.10 acre) into two lots, while complying with zoning regulations, would not further the objectives and goals the the Urban Center -Downtown designation. The property, following subdivision, could be developed with a multi-family structure on the new lot, while retaining the 1916 structure, but it would be disingenuous to characterize the development as fulfilling the intent of the Comprehensive Plan. Subdivision for the purpose of transfer of ownership is, however, a valid land use action. The site is within Urban Center Design District 'N and is, therefore, would be subject to special design requirements for building siting and design (not a part of this application). The site is level with very limited vegetation, consisting primarily of grass. A Soil Evaluation Report by Touma Engineers was submitted with the application. This report indicates this area of Downtown Renton is underlain by gravelly, sandy loam fill material to depths of several feet. The soil on site has the capability to carry structural loads, although a geotechnical report would be required to be submitted with building permit plans. This activity and further research resulted in a determination that no potential hazards from landslides, erosion, or coal mines are anticipated. The site is level, with no slopes. The underlying fill introduces hazard from seismic activity, which would be mitigated to a certain degree by building design. The site is underlain by an aquifer, but is not located within one of the City's Aquifer Protection Areas. Groundwater is estimated to be at below 30 inches. The site is in the unregulated flood zone. 2. Environmental Review Except when located on lands covered by water or sensitive areas, short plats are exempt from SEPA Environmental Review pursuant to WAC 197-11-800(6)(a). 3. Compliance with ERC Conditions N/A 4. Staff Review Comments Representatives from various city departments have reviewed the application materials to identify and address issues raised by the proposed development. These comments are contained in the official file, and the essence of the comments has been incorporated into the appropriate sections ofthis report and the "Advisory Notes to the Applicant" at the end of this report. 5. Comment from the Public Comments received from the public are included as Exhibit 8. These comments included concerns about additional traffic and parking in and around the alley. The alley is narrower than allowed by current regulations. Site planning and infrastructure is intended to promote a pedestrian -scale environment and amenities. The proposed project is consistent with the following Comprehensive Plan land Use and Community Design Element policies as noted, if all conditions of approval are met, unless noted otherwise: Policy LU-202. Development and redevelopment of Urban Center -Downtown should Note strive for urban density and intensity of uses. No density is proposed. The future density, 3 following building construction is not known, but density up to 100 dwelling units per net acre (du/a) is allowed, or up to 150 du/a, subject to administrative conditional use approval (see below). Density is not dependent upon the subdivision however. Policy LU·204. Projects in the Urban Center -Downtown should achieve an urban density Note and intensity of development that is greater than typical suburban neighborhoods. 3 Characteristics of urban intensity include no or little setbacks, taller structures, mixed-uses, structured parking, urban plazas and amenities within buildings. Note Policy lU-20S. Development should not exceed mid-rise heights within the Urban Center 3 -Downtown. Building height at this site would be limited by the proximity of the Renton Municipal Airport. See "Building Height" section, below. Note Objective LU-RR: Encourage additional residential development in the Urban Center- 3 Downtown supporting the Countywide Planning Policies definition of Urban Center. Future development of the property to urban densities would meet this objective. Policy LU-207. Maximize the use of existing urban services and civic amenities and Note revitalize the City's downtown by promoting medium to high-density residential 1 development in the downtown area. Allowed densities should conform to the criteria for Urban Centers in the Countywide Planning Policies. Existing urban services would be extended to the new lot. Future density is unknown. Note Policy LU-209. Net residential development densities in the Urban Center -Downtown 3 designation should achieve a range of 14-100 dwelling units per acre and vary by zoning district. Note Policy LU-210. Density bonuses up to 150 du/a may be granted within designated areas 3 for provision of, or contribution to, a public amenity (e.g. passive recreation, public art) or provision of additional structured public parking. COMPLIANCE WITH THE UNDERLYING ZONING DESIGNATION: Objectives and policies of the Comprehensive Land Use Plan designation of UC-D are implemented by Center Downtown zoning (CD). RMC 4-2-120B provides development standards for development within the CD zone. The proposal is consistent with the following development standards, if all conditions of approval are met, unless noted otherwise: Density: There is no minimum density requirement for property less than 0.5 acre. The maximum density permitted in the CD zone is 100 dwelling units per net acre (du/a), or up to 150 du/a, subject to administrative conditional use approval. Net density is calculated after the deduction of critical areas, areas intended for public rights-of-way, ,f and private access easements. The gross site area of the undivided lots is 4,280 sf, Street dedications would be required for both Logan Ave S (8.5 feet = 340 sf) and S Tillicum St (6 feet = 591 sf). Therefore, the net area, before subdivision, would be 3,349 sf. It is unknown at this time how many units would be developed, but the maximum, without height limitations or allowance for additional density through conditional use approval would be 3 on Lot 1 and 4 on Lot 2. There is no setback for the portion of the building greater than 25 feet in height. There is no rear yard setback, unless the property abuts a residential zone. In this instance, the side yard of Lot 2 would abut an ,f approximately 3-foot wide strip of land zoned CD, which in turn abuts the R-8 zone to the west. Based on the potential for redevelopment of the property to the west as single-family residential (current zoning), staff recommends a 5-foot wide sight- obscuring landscaped strip and a solid 6-foot high visual barrier be installed/constructed along the west property boundary. A condition of approval shall be that a S-foot wide sight-obscuring landscaped strip and a solid 6-foot high visual barrier be installed/constructed along the west property boundary of Lot 2. Building Height: The maximum building height in the CD zone is 95 feet, although this site is within the Airport Influence Area. The limitations to building height must be met in Note accordance with the Airport Compatible Land Use Restrictions (RMC 4-3-020). 3 Building architectural elevations, which would be used to determine if buildings comply with height regulations, have not been submitted, They would be submitted for building permit review (compliance not yet demonstrated). Note 3 Screening: Screening is required for surface-mounted utility and mechanical equipment and rooftop equipment as per RMC 4-4-095. Landscaping: Landscaping is required for all subdivisions, including short plats. A detailed landscape plan must be approved prior to issuance of street or utility construction permits. Roof lines, roof pitches, and roof shapes designed to reduce apparent bulk and transition with existing development. Additionally, the Administrator may require increased setbacks at the side or rear of a building in order to reduce the bulk and scale of larger buildings and/or so that sunlight reaches adjacent and/or abutting yards. They would be submitted for building permit review (compliance not demonstrated)_ Service Element Location and Design: All ofthe following are required: 1. Service elements shall be located and designed to minimize the impacts on the pedestrian environment and adjacent and/or abutting uses. Service elements shall be concentrated and located where they are accessible to service vehicles and convenient for tenant use. 2. In addition to standard enclosure requirements, garbage, recycling collection, and utility areas shall be enclosed on all sides, include a roof and be screened around their perimeter by a wall or fence and have self-closing doors. 3. Service enclosures shall be made of masonry, ornamental metal or wood, or some combination ofthe three (3). 4. If the service area is adjacent to a street, pathway, or pedestrian-oriented space, a landscaped planting strip, minimum three feet (3') wide, shall be located on three (3) sides of such facility. Parking structures shall provide space for ground floor commercial uses along street frontages at a minimum of seventy five percent (75%) of the building frontage width. 2. The entire public facing facade shall be pedestrian-oriented. The Administrator may approve parking structures that do not feature a pedestrian orientation in limited circumstances. If allowed, the structure shall be set back at least six feet (6') from the sidewalk and feature substantial landscaping. This landscaping shall include a combination of evergreen and deciduous trees, shrubs, and ground cover. This setback shall be increased to ten feet (10') when abutting a primary arterial and/or minor arterial. 3. Buildings containing predominantly residential uses shall have pitched roofs with a minimum slope of one to four (1:4) and shall have dormers or interesting roof forms that break up the massiveness of an uninterrupted sloping roof. COMPLIANCE WITH SUBDIVISION REGULATIONS: RMC 4-7 Provides review criteria for proposed subdivisions. The proposed project is consistent with the following subdivision regulations if all conditions of approval are complied with: Access: Each lot must have access to a public street, private road, or by a private access .(' easement per the requirements of the street standards. Both the existing house to remain and the new structure would be accessed from Tillicum Street. Streets: Logan Ave South is a Minor Arterial. The street design is for two ll-foot wide travel lanes, 6-foot wide bike lanes on both sides, 8-foot wide parking lanes on both sides, OS wide curb, and gutter. The sidewalks in the downtown district are required to be 12 feet in width with regular street grates. An additional one foot of right-of-way is required between the back of sidewalk and the property line. The project requires the Note dedication of 8.5 feet of right-of-way (subject to final survey). 3 The alley, Tillicum Street, currently has a paved width of 10 feet and a right-of-way width of 10 feet. As per RMC 4.6.060.F.2, the minimum paved width on a residential alley is 12 feet and the minimum right-of-way width is 16 feet. A dedication of six feet is required to be provided with a 2-foot widened alley pavement. The maximum width of single loaded garage driveway shall not exceed nine feet (9') and double-loaded garage driveway shall not exceed sixteen feet (16'). N/A Blocks: Blocks shall be deep enough to allow two tiers of lots. No new blocks would be formed. 4. AVAILABILITY AND IMPACT ON PUBLIC SERVICES: .(' Police: The Renton Police Department has commented that the proposed project would have minor impacts on police services. Fire: Sufficient resources exist to furnish services to the proposed development, subject to the condition that the applicant provides Code required improvements and fees. Schools: The Renton School District has verified that existing schools would have .(' capacity to accommodate the anticipated increased enrollment from the proposed project. Students would attend Bryn Mawr Elementary School, Dimmitt Middle School, and Renton High School. Parks: Although there would be no significant impacts to the City of Renton Park System anticipated from the proposed project, an impact fee is required of all new residential development. " Park impact fees shall be paid prior to issuance of building permits, This fee is assessed per new multi-family lot at the rate in place at the time the building permit is issued. As of January 1, 2014, the fee is $706.95 per unit for a 3 to 4 unit structure. Park Impact Fees will increase annually. Credit would be given for one existing residence. Stormwater: There is a stormwater control system logan Ave S. A drainage report was submitted by Touma Engineers. The drainage review type in the drainage report must be based on the 2009 Surface Water Design Manual Amendment. The project is subject to full drainage review. Drainage plans and a final drainage report based on the City adopted 2009 Surface Water Design Manual Amendment and the 2009 King County Surface Water Drainage is required to be submitted with the construction permit. The drainage report submitted with the construction permit must include the correct project description, all core requirements and the special requirements, especially the requirements for flow control, water quality, and stormwater BMPs. Based on the City's " flow control map, this site falls within the Peak Rate Flow Control Standard, Existing Site Conditions. The drainage report should clearly show the information ofthe required frontage improvements and include it in the calculations. All stormwater requirements as per the 2009 Surface Water Design Manual Amendment and the 2009 King County Surface Water Drainage Manual are required to be provided by the project. A soils evaluation report prepared by Touma Engineers was also submitted. Information must be provided during the construction permit review stage demonstrating that the soil is suitable for infiltration. The Surface Water System Development Charge (SOC), as of the date of this report, is $0.448 per square foot of new impervious surface area, but not less than $1,120. Fees are payable prior to issuance of the construction permit. Water Service: The project proposes the extension of about 145 feet of 8-inch water main within the alley (also known as Tillicum Street) from the existing 12-inch water main in logan Ave to the west property line of proposed lot 2. The project also includes the installation of a fire hydrant near the northeast corner of " proposed lot 1, connected to the above new 8-inch water main extension. Separate domestic water meters, minimum I-inch, is to be installed to each unit of the multi-family development. The service line and meter shall be sized to provide domestic and fire sprinkler service. Separate water meters shall be provided to each lot. Fee credit will be given for the existing house. Sanitary Sewer Service: Sewer service is provided by the City of Renton. There is an 8- inch sewer main in the alley (Tillicum Street). Separate side sewers would be required for the multi -family development. (Exhibit 5) The System Development Charge (SDC) for sewer is based on the size of the new ./ domestic water to serve the new home on each new lot. Sewer 5DC fee (2013 rates) for a X-inch or 1-inch meter install is $1,812.00. These fees are collected at the time a construction permit is issued and the rate prevalent at time of construction permit will be applicable. Credit will be given for the existing home if previously connected to sewer. Fees are payable prior to issuance of the construction permit. Transportation: Impacts to the city transportation system are expected, due to increased vehicle trips to and from the proposed project. Traffic Impact Fees, as of ./ January 1, 2014, are $953.25 per new apartment unit. The Transportation Impact fee would be calculated and assessed at the rote in effect when the building permits are issued. Transportation Impact Fees will increase annually, Credit would be given for the existing house. I. FINDINGS; Having reviewed the written record in the matter, the City now enters the following: 1. Request: The project proponent has requested approval of a short plat subdivision of a 4,280 sf (0.10 acre) property in Downtown Renton into 2 lots suitable for multi-family residential structures. The project would have a density of 22 du/a. 2. Application: The property, located at 51 logan Ave S, is owned by Eddie DeCarlo Foster and luida Foster. 3. Comprehensive Plan: The property has a Comprehensive Plan land use designation of Urban Center-Downtown (UC-D). The proposed project furthers the objectives and policies of the UC- D section of the land Use Element of the Comprehensive Plan. The objectives and policies of the Community Design Element appear to be supported by the project to the extent it has been proposed. 4. Zoning: Objectives and policies of the UC-D designation are implemented by standards and regulations of the Center Downtown (CD) zone. The project, as proposed, meets or exceeds the CD zone standards and regulations. 5. Subdivision Regulations: The short plat, as proposed, would meet the requirements of RMC 4- 7 Subdivision Regulations. The subject site is deSignated Urban Center-Downtown (UC-D) in the Comprehensive land Use Plan and complies with the goals, objectives, and policies established with this deSignation. 2. The type size used for the land record number should be smaller than that used for the land use action number. The dedication of right of way for short subdivisions requires a separate Deed of Dedication; provide a space to the recording number of same on the short plat. The Deed of Dedication document includes both a legal description exhibit and a map exhibit of the dedicated parcel. The legal description exhibit should be prepared, stamped, dated and signed by the applicant's surveyor. The surveyor should also prepare the map exhibit. The dedication process requires an updated Plat Certificate dated within 45 days of approval of said dedication. Talk to the Project Manager if there are questions or further information is needed. Show two ties to the City of Renton Survey Control Network. The geometry will be checked by the city when the ties have been provided. Provide short plat and lot closure calculations. Note what was found when visiting the existing monuments. Indicate what has been, or is to be, set at the corners of the proposed lots. The city will provide addresses for the proposed lots as soon as possible. Note said addresses on the final short plat drawing. Do note encroachments, if any. Do include a "LEGEND" block for the short plat drawing, detailing any symbols used thereon. Note i!!! easements, covenants and agreements of record on the drawing. Note any relevant researched resources on the short plat submittal. Note the plat name and lot and tract numbers ofthe adjoining properties or note as "Unplatted." . The City of Renton Administrator, PublicWorks Department, is the only city official who signs the final short plat. Provide an appropriate approval block and signature line. Pertinent King County approval blocks also need to be noted on the drawing. All vested owner(s) ofthe subject final short plat need to sign the final short plat drawing. Include notary blocks as needed. Include a declaration block on the drawing, titled "OWNERS' DECLARATION" not "CERTIFICATION" or other. Note that if there are easements, restrictive covenants or agreements to others (City of Renton, etc.) as part of this subdivision, they can be recorded concurrently with the final short plat. The final short plat drawing and the associated document(s) are to be given to the Project Manager as a package. The recording number(s) for the associated document(s) are to be referenced on the final short plat drawing. Provide spaces for the recording numbers thereof. The new easements for ingress, egress, utilities, etc. shown for the benefit of future owners ofthe proposed lots each need a note defining the rights associated with the easement at issue. The preceding statement obligates the seller of the lots created to "expressly grant and convey" the lots "together with and/or subject to" any new private easements delineated on the short plat in the conveying document. The private ingress, egress ·and utility easements require a "New Private Easement for Ingress, Egress and Utilities Maintenance Agreement" statement. Note the attachment on the drawing. We are happy that the owners want to beautify their site with a duplex'but are concerned with additional traffic and parking in and around the alley. As you know, this is a very small alley, large trucks use the alley to deliver product and pick up garbage. Our neighbor uses the alley to get in and out of his garage as we do to drive around our building to Logan St. There is not even an extra foot of space to use to park on. We will not allow parking in back of our building so unsure where additional parking space may come from. In addition I am not' sure the long range use of this property as a duplex is the wisest choice fordeveioprrnmt. The additional right-of-way required to meet the minimum standard for an alley (16 feet) must be dedicated from the Foster property, The project review engineer has determined there is sufficient area between the exi.sting pavement edge and the residential structure for this purpose. Sufficient parking for both the residence to remain and any additional new units must be provided on the project site. Under-structure parking would probably be the only viable approach for the new residential units. With the removal of the existing garage, an additional . paved, surface parking area for a minimum of two vehicles must be provided on~site. Parking on near-by private property wouldoniy be allowed by means of a "shared parking agreement," signed by all parties and in effect .in perpetuity. I have completed a preliminary review for the above-referenced proposal. The following comments are based on the pre-application submittal made to the City of Renton by the applicant. Water 1. The proposed development is within the City of Renton's water service area. 2, There is an existing 12-inch water main in Logan Ave S that can deliver 2,400 gpm at 20 psi residual pressure, The static water pressure is about 70 psi (196 hydraulic-zone). There is also an existing 8-inch water main in Airport Way S that can deliver 2,400 gpm at 20 psi residual pressure. 3. There is an existing hydrant within 300 feet of the site. If not currently existing, a Storz quick-connect fitting must be installed if hydrant is counted for service. 4, There is an existing 3/4 inch water meter serving the existing house on proposed lot 1. 5. According to Renton Fire Prevention department review comments, the preliminary fire flow demand for the proposed triplex is 1,500 gpm including the use of a fire sprinkler system. In order to provide water service for domestic connection and for fire protection to the proposed development, the following improvements will be required per City Code and Development standards (RMC 4-6-010B): 6. Extension of about 145 feet of 8-inch water main within the alley (also known as Tillicum) from the existing 12-inch water main in Logan Ave to the west property line of proposed lot 2. 7, Civil plans for the water main extension will be required and must be prepared by a registered professional engineer in the State of Washington. 8. Installation of a fire hydrant near the northeast corner of proposed lot 1, connected to the above new 8 -inch water main extension. 9. Installation of a separate domestic water meter, minimum I-inch, to each unit of the triplex, The service line and meter shall be sized to provide domestic and fire sprinkler service. 10. The System development (SDC) fee for water is based on the size of the new domestic water meter that will serve the new home on each new lot. The SDC Fee for each additional It.-inch water meter or a i-inch water meter is $2,523,00. SDC Credit is given to the existing meter serving the existing home. 11. If the existing house in lot 1 is changed to a multifamily unit, then installation of a separate water meter and service line to each individual unit will be required. Sanitary Sewer 1. Sewer service is provided by the City of Renton. There is an 8-inch sewer main in the alley (Tillicum Street). 2. System development fee for sewer is based on the size of the new domestic water to serve the new home on each new lot. Sewer fee for a Yo-inch or 1-inch meter install is $1,812.00. Storm 1. A drainage report complying with the 2009 King County Surface Water Manual will be required. Based on the City's flow control map, this site falls within the Flow Control Duration Standard, Existing Site Conditions. Small project drainage review is required for any single-family residential project that will result in 2,000 square feet or more of new impervious surface, replaced impervious surface, or new plus replaced impervious surface, or 7,000 square feet of land disturbing activity. If the project exceeds one of these thresholds, a drainage plan and drainage report will be required with the site plan application. 2. A geotechnical report for the site is required. Information on the water table and soil permeability with recommendations of appropriate flow control BMP options with typical designs for the site from the geotechnical engineer shall be submitted with the application. 3. Surface water system development fee is $1,120.00 for the new lot. Transportation 1. The project proposes the remodel of an existing house, and the creation of a second lot with the construction of a new triplex bUilding in it. Payment of transportation impact fee is applicable on the construction of the triplex at the time of issuance of the building permit. The transportation impact fee rate for a triplex is based on the apartment land use rate. The current ,ate oftransportation impact fee forthe triplex is $498.75 per dwelling unit, giving a current total of $1496.25 for the triplex. The impact fee for this type of land use will increase on 1/1/2014 to $953.25 per dwelling unit. The impact fee may change before the building permits are issued. The transportation impact fee that is current at the time of building permit issuance will be applicable. 2. Street lighting is not required for a two lot short plat. 3. The maximum width of single loaded garage driveway shall not exceed nine feet (9') and double-loaded garage driveway shall not exceed sixteen feet (16'). 4. Logan Avenue 5 is a Minor Arterial. The required ROW width is 91 feet (as per the RMC 4.6.060.F.2). The minimum paved width required is 54 feet. The available ROW is 60 feet and the available paved width is 44 feet. Therefore, the RMC would require a dedication of 15.5 feet of ROW along Logan Avenue S. The street standards also call for the construction of an 8' landscape strip and an 8 feet sidewalk. There is an existing house located in the site within 8 feet of the existing ROW line on Logan Ave S. Therefore the applicant can subm it a request to review the waiver (reduction) of the dedication and the construction of frontage improvements. 5. The alley, Tiliicum Street, currently has a paved width of 10 feet and a ROW width of 10 feet. As per the RMC 4.6.060.F.2, the minimum paved width on a residential alley is 12 feet and the minimum ROW width is 16 feet. Therefore a dedication of 6 feet is required to be provided with a 2 feet widened alley pavement. The applicant can submit a request to review the waiver of the dedication and the construction of frontage improvements. General Comments 1. All construction or service utility permits for drainage and street improvements will require separate plan submittals. All utility plans shall conform to the Renton Drafting Standards. The development Regulations are available for purchase for $50.00 plus tax, from the Finance Division on the first floor of City Hall or online at www.rentonwa.gov. Project Proposal: The proposed project site is located on the west side of Logan Avenue S, abutting a named east -west running alley,S Tillicum St. The site area is approximately 4,280 sf. The project proposal is to subdivide the property into two lots with the intent of constructing a triplex on the newly created lot to the west and remodeling the existing house on the east lot (abutting Logan Ave 5) into 3 to 4 dwelling units. Current Use: The property has an existing single-family residence constructed in 1916. A detached garage and free-standing shed are located west of the house, in the rear yard, and would be removed. Zoning: The area including this property has a Comprehensive Plan designation of Urban Center -Downtown (UC-D) and is zoned Center Downtown (CD). Overlay Districts: The property is located within Urban Design District 'A' and is, therefore, subject to the Urban Design Regulations (see below). Development Standards: The project is subject to RMC 4-2-120B, "Development Standards for Commercial Zoning Designations." Density -The minimum density required is 25 dwelling units per net acre (du/a). The maximum density allowed is 100 du/a. The subdivided lots may be developed with 6 or 7 dwelling units (total both lots). The maximum density would not be exceeded with the proposed amount of development (see Density Worksheet, attached ). Setbacks -Setbacks are the distance between the building and the property line or any private access easement. Setback requirements in the CD zone are as follows: Maximum front yard -15 feet for buildings 25 feet or less in height, zero for that portion of a building over 25 feet in height; minimum rear yard when Page 1 of 3 the property abuts (shares a common property line) a residential zone -15 foot landscaped strip or as-foot wide sight-obscuring landscapel ip and a solid 6-foot high barrier alol Ie common boundary. In the case of the proposed project, the rear yard ofthe exiting house becomes the side yard ofthe new lot and triplex. Therefore, the fact that there is a Residential 8 zone abutting on the west is not a factor. Side yard setbacks are not required in the CD zone. Building Height -The maximum building height allowed in the CD zone, when the property abuts another property zoned Residential, is 50 feet (20 feet more than the maximum height allowed in the abutting R-8 zone, which is 30 feet). In order to exceed this height, a Conditional Use Permit must be approved by the Hearing Examiner. The Preapplication materials did not specify proposed building heights. Dimensioned building elevations are required with the land use/building permit application submittals. Building heights may be restricted by limitations imposed by the Renton Airport Compatible land Use Program. Refuse and Recycling Areas -Refuse and recycling areas need to meet the requirements of RMC 4-4-090, "Refuse and Recyclables Standards" (attached). landscaping -The development standards require that all pervious areas within the property boundaries be landscaped. Therefore, all areas of the site not covered by structures, required parking, access, circulation or patios, must be landscaped with native, drought-resistant vegetative cover. Refer to landscape regulations (RMC 4-4-070, attached) for additional general and specific landscape requirements If existing trees cannot be retained, they may be replaced with minimum 2 inch caliper trees at a rate of six to one. Pedestrian Access -It is not clear how future residential units will be accessed by pedestrians. As a site element, residential access from the fronting street (logan Ave S) should be indicated on submitted plans. Access -Vehicle access shall be from the abutting alley. Sufficient backup area for safe maneuvering should be provided. Parking is not permitted in the front yard (abutting logan Ave S). Driveway widths are limited by the driveway standards, in RMC 4-40801. Parking -Regulations pertaining to parking can be found at RMC 4-4-080. The minimum and maximum required/allowed is one off-street parking space per residential unit (RMC 4-4-080F.I0.e). This requirement is applicable to any new units established in the existing structure. Building Design Standards -Compliance with Urban Design Regulations, District 'A', is required. See the attached checklist and Renton Municipal Code 4-3-100, attached. The following are a few of the standards outlined in the regulations. No significant destruction of aquatic habitat or organisms noted. 6. Qualitative data such land use, impervious surface, topography and soil types noted in Task 4. 7. Tributary basin delineated in Task I verified. 8. No neighbors were contacted. 9. The weather conditions during inspection was sunny and warm. Task 4. Drainage System Description and Problem Description The entire site falls within the Miller Creek Basin. The topography survey is prepared exclusively for the site, by Touma Engineers and Land Surveyors, PLLC. The topography survey was prepared on 2-foot contour. There is no indication of erosion or stream capacity noted downstream of the site. TASK 5: Mitigation of Existing or Potential Problems. Our field inspection and review of available resources and existing problems were not found. Mitigation is not required. The development of the property is not going to impact existing downstream patterns. A temporary erosion and sedimentation control plan will be designed to control runoff to downstream system IV. GUARANTEE CONDmONS AND STIPULATIONS 1. Definition of Tenns. The following terms when used in the Guarantee mean: (a) the "Assured": the party or parties named as the Assured in this Guarantee, or on a supplemental writing executed by the Company. (b) "land": the land described or referred to in Schedule (A)(C) or in Part 2, and improvements affixed thereto which by law constitute real property. The tenn "land" does not indude any property beyond the lines of the area described or referred to in Schedule (A)(C) or in Part 2, nor any right:, tiUe, interest, estate or easement in abutting streets, roads, avenues, alleys, lanes, ways or waterways. (c) "mortgage": mortgage, deed of trust, trust deed, or other security instrument. (d) "public records": rewrds established under state statutes at Date of Guarantee for the purpose of imparting constructive notice of matters relating to real property to punchasers for value and without knowledge. (e) "date": the effective date. 2. Notice of Claim to be Given by Assured Claimant. No Duty to Defend or Prosecute. COmpany's OptIon to Defend or Prosecute Actions; Duty of Assured Claimant to Cooperate. Even though the Company has no duty to defend or prosecute as set forth in Paragraph 3 above: (a) The Company shall have the right, at its sole option and cost. to institute and prosecute any action or proceeding, interpose a defense, as limited in (b), or to do any other ad which in its opinion may be necessary or desirabie to establish the title to the estate or Interest as stated herein, or to establish the lien rights of the Assured, or to prevent or reduce loss or damage to the Assured. The Company may take any appropriate action under the tenms of this Guarantee, whether or not it shall be liable hereunder, and shall not thereby concede liability or waive any provision of this Guarantee. If the Company shall exercise its rights under this paragraph, it shall do so diligently. Proof of loss or Damage. In addition to and alter the notices required under Section 2 of these Conditions and Stipulations have been provided to the Company, a proof of loss or damage signed and sworn to by the Assured shall be furnished to the Company within ninety (90) days alter the Assured shall ascertain the facts giving rise to the loss or damage. The proof of loss or damage shall describe the matters covered by this Guarantee which oonstitute the bass of loss or damage and shall state, to the extent possible, the bass of calaJlating the amount of the loss or damage. If the Company is prejudiced by the failure of the Assured to provide the required proof of loss or damage, the Company's obligation to such assured under the Guarantee shall terminate. In addition, the Assured may reasonably be required to subm~ to examination under oath by any authorized representative of the Company and shall produce for examination, inspection and copying, at such reasonable times and places as may be designated by any authorized representative of the Company, all records, books, ledgers, checks, comespondence and memoranda, whether bearing a date before or after Date of Guarantee, which reasonably pertain to the loss or damage. Further, if requested by any authorized representative of the Company, the Assured shall grant its pennission, in writing, for any authorized representative of the Company to examine, inspect and copy all records, books, ledgers, checks, correspondence and memoranda in the OJstody or oontrol of a third party, whicl1 reasonably pertain to the loss or damage. All information designated as confidential by the Assured provided to the Company pursuant to this Section shall not be disclosed to others unless, in the reasonable judgment of the Company, it is necessary in the administration of the daim. Failure of the Assured to submit for examination under oath, produce other reasonably requested information or grant permission to secure reasonably necessary information from third parties as required in the above paragraph, unless prohibited by law or governmental regulation, shall terminate any liability of the Company under this Guarantee to the Assured for that daim. 6. Options to Payor Otherwise Settle Oaim.: Termination of liability. In case of a daim under this Guarantee, the Company shall have the following additional options: Ca) To Payor Tender Payment of the Amount of Uabllity or to Purchase the Indebtedness. The Company shall have the option to pay or settle or compromise for or in the name of the Assured any daim which could resu~ in loss to the Assured within the coverage of this Guarantee, or to pay the full amount of this Guarantee or, if this Guarantee is issued for the benefit of a holder of a mortgage or a lienholder, the Company shall have the opbon to purchase the indebtedness secured by said mortgage or said lien for the amount owing thereon, together with any rosts, reasonable attorneys' fees and expenses inomed by the Assured claimant whidl were authorized by the Company up to the time of purchase. Such purchase, payment or tender of payment of the full amount of the Guarantee shall terminate all liability of the Company hereunder. In the event after notice of claim has been given to the Company by the Assured the Company offers to purchase said indebtedness, the owner of such indebtedness shall transfer and assign said indebtedness, together with any collateral security, to the Company upon payment of the purchase price. Upon the exen:ise by the Company of the option provided for in Paragraph (a) the Company's obligation to the Assured under this Guarantee for the daimed loss or damage, other than to make the payment required in that paragraph, shall terminate, induding any obligation to continue the defense or proseOJtion of any litigation for which the Company has exercised its options under Paragraph 4, and the Guarantee shall be surrendered to the Company for cancellation. (b) To Pay or mherwise Settle With Parties mher Than the Assured or With the Assured Oaimant To pay or otherwise settle with other parties for or in the name of an Assured daimant any dalm assured against under this Guarantee, together with any costs, attorneys' fees and expenses incurred by the Assured daimant which were authorized by the Company up to the time of payment and which the Company is obligated to pay. Upon the exercise by the Company of the option provided for in Paragraph (b) the Company's obligation to the Assured under this Guarantee for the daimed loss or damage, other than to make the payment requrect in that paragraph, shall terminate, induding any obligation to continue the defense or prosection of any litigation for which the Company has exercised its options under Paragraph 4. 7. Detennination and Extent of liability. This Guarantee is a contract of Indemnity against actual monetary loss or damage sustained or inOJmed by the Assured daimant who has suffered loss or damage by reason of reliance upon the assurances set forth in this Guarantee and only to the extent herein described, and subject to the Exdusions From Coverage of This Guarantee. Limitation of Liability. (c) The Company shall not be liable for loss or damage to any Assured for liability voluntarily assumed by the Assured in settling any drum or suit without the prior written consent of the Company. 9. Reduction of Liability or Termination of Liability. All payments under this Guarantee, except payments made for costs, attomeys' fees and expenses pursuant to Paragraph 4 shall reduce the amount of liability pro tanto. 10. Payment of Loss. <a) No payment shall be made without produdng this Guarantee for endorsement of the payment unless the Guarantee has been lost or destroyed, in which case proof of loss or destruction shall be fumished to the satisfaction of the Company. (b) When liabUity and the extent of loss or damage has been definitely fixed In accordance with these Concfotions and Stipulations, the loss or damage shall be payable within thirty (30) days thereafter. 11. Subrogation Upon Payment or Settlement. Whenever the Company shall have settled and paid a claim under this Guarantee, all right of subrogation shall vest in the Company unaffected by any act of the Assured claimant. The Company shall be subrogated to and be entitled to all rights and remedies which the Assured would have had against any person or property in respecI to the daim had this Guarantee not been issued. If requested by the Company, the Assured shall transfer to the Company all rights and remedies against any person or property necessary in order to perfect this right of subrogation. The Assured shall permit the Company to sue, oompromise or settle in the name of the Assured and to use the name of the Assured in any transaction or litigation involving these rights or remedies. If a payment on account of a daim does not fully cover the loss of the Assured the Company shall be subrogated to all rights and remedies of the Assured after the Assured shall have recovered its principal, interest, and costs of collection. 12. Arbitration. Unless prohibited by applicable law, either the Company or the Assured may demand arbitration pursuant to the litle Insurance Arbtration Rules of the American Land libe Association. Arbtrabie matters may include, but are not limited to, any controversy or daim between the Company and the Assured arising out of or relating to this Guarantee, any service of the Company in connection with its issuance or the breach of a Guarantee provision or other obligation.
