Our city arborist, Terry Flatley, has confirmed that the trees are dead and/or dying and are in danger of falling on the home, fencing, and/or sidewalk (See Exhibit 2). City staff recommends as a condition of approval that the removals be mitigated with replacement planting of 3 Big leaf maples, minimum size 2 caliper inches, on the east side of the wetland tract near the playground, per Terry Flatley's comments (See Exhibit 2). CRITICAL AREA: Wetland and Wetland Buffer EXEMPTION JUSTIFICATION: Renton Municipal Code, Section 4-3-050C.3.c.iii. Dangerous Trees: Removal of non-native invasive ground cover or weeds listed by King County Noxious Weed Board or other government agency or dangerous trees, as defined in Chapter 4-11 RMC which have been approved by the City and certified dangerous by a licensed landscape architect, or certified arborist, selection of whom to be approved by the City based on the type of information required. Limited to cutting of dangerous trees; such hazardous trees shall be retained as large woody debris in critical areas and/or associated buffers, where feasible. The activity is not prohibited by this or any other provision of the Renton Municipal Code or State or Federal law or regulation; ii. The activity will be conducted using best management practices as specified by industry standards or applicable Federal agencies or scientific principles; iii. Impacts are minimized and, where applicable, disturbed areas are immediately restored; iv. Where water body or buffer disturbance has occurred in accordance with an exemption during construction or other activities, revegetation with native vegetation shall be required; v. If a hazardous material, activity, and/or facility that is exempt pursuant to this Section has a significant or substantial potential to degrade groundwater quality, then the Administrator may require compliance with the Wellhead Protection Area requirements of this Section otherwise relevant to that hazardous material, activity, and/or facility. The tree stumps shall remain for wildlife habitat, per city arborist comments (Exhibit 2). 2. The trees shall be retained as large woody debris on site. 3. The removals shall be mitigated with replacement planting of 3 Big leaf maples, minimum size 2 caliper inches, on the east side of the wetland tract near the playground. The applicant shall notify the Current Planning Project Manager, Angelea Weihs, following installation of trees to schedule an inspection. APPEALS: An appeal of this administrative land use decision must be filed in writing together with the required fee to the City of Renton Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA 98057, on or before 5:00 p.m., on December 02, 2016. RMC 4-8-110 governs appeals to the Hearing Examiner and additional information regarding the appeal process may be obtained from the Renton City Clerk's Office, (425) 430-6510. RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be reopened by the approval body. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After review of the reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame. EXPIRATION: Five (5) years from the date of decision (date signed). The 6 trees can be made into wildlife habitat stems. Three Cottonwood trees (12, 14, 23 inch diameters)are leaning into the common area. The three other Cottonwood trees (23, 17, and 14 inches diameters) have decay/ poor structure. The removals can be mitigated with planting 3 Big leaf maples, 2 inch caliper size, on the east side near the playground. You will need to contact Angelea Weihs, Assistant Planner, at 425-430-7312, to determine which permits are required for the tree removal and replacement prior to scheduling the work. Henning Vanessa Dolbee Sabrina Mirante Jennifer Cisneros Angelea Weihs LOCATION: Two parcels east of 716 S 32nd PL DESCRIPTION: The applicant is requesting a Critical Areas Exemption to remove 6 dead/dying trees on two tracts (parcel numbers 9485750000 and 9485750560) just east of the single family home located at 716 S 32nd PL, within Winsper Development (See Exhibit 1). The tracts are approximately 121,140 square feet and contain wetlands. The proposed tree removal will be located within the wetland and wetland buffer. Our city arborist, Terry Flatley, has confirmed that the trees are dead and/or dying and are in danger of falling on the home, fencing, and/or sidewalk (See Exhibit 2). City staff recommends as a condition of approval that the removals be mitigated with replacement planting of 3 Big leaf maples, minimum size 2 caliper inches, on the east side of the wetland tract near the playground, per Terry Flatley's comments (See Exhibit 2). CRITICAL AREA: Wetland and Wetland Buffer EXEMPTION JUSTIFICATION: Renton Municipal Code, Section 4-3-050C.3.c.iii. Dangerous Trees: Removal of non-native invasive ground cover or weeds listed by King County Noxious Weed Board or other government agency or dangerous trees, as defined in Chapter 4-11 RMC which have been approved by the City and certified dangerous by a licensed landscape architect, or certified arborist, selection of whom to be approved by the City based on the type of information required.
