Clearing would occur on the vacant parcel, PIO 3224059081, within the Residential-6 zoning designation. The proposed area of work is approximately 40,000 square feet. The property has May Creek located on the site, a Shoreline of the State, and associated wetlands. No development is proposed. No trees are proposed to be removed. A tractor with brush cutter would cut brush and leave cut vegetation in place. Work is not proposed on steep slopes, within 200 feet of May Creek, or in other critical areas including wetlands. Work hours are proposed between 8am and 5pm, Saturday through Tuesday. EXPIRATION DATE: GENERAL REVIEW CRITERIA 4-4-130HS: YES 1. YES 2. YES 3. Land clearing and tree removal shall be conducted in a way so as to expose the smallest practical area of soil to erosion for the least possible time, consistent with an approved build-out schedule and including any necessary erosion control measures. Land clearing and tree removal shall be consistent with subsection D2 of this Section, Restrictions for Critical Areas -General, and RMC 4-3-050 -Critical Areas Regulations. Retained trees will not create or contribute to hazardous conditions as the result of blowdown, insect or pest infestation, disease, or other problems that may be created as a result of selectively removing trees and other vegetation from the lot. Land clearing and tree removal shall be conducted to maximize the preservation of any tree(s) in good health that is an outstanding specimen because of its size, form, shape, age, color, rarity, or other distinction as a community landmark. DECISION: The Fawcett Brush and Blackberry Removal RVMP Routine Vegetation Management Permit is Approved with Conditions*. *CONDITIONS OF APPROVAL: 1. Any area of work is limited and shall not be permitted on steep slopes, within 200 feet of May Creek, or within wetlands and wetland buffers on the parcel. 2. A National Permit Discharge Elimination System {NPDES) permit is required when more than one acre is being cleared. Contact state Department of Ecology. 3. Commercial, multi-family, new single family and other nonresidential construction activities shall be restricted to the hours between seven o'clock {7:00) a.m. and eight o'clock {8:00) p.m., Monday through Friday. Work on Saturdays shall be restricted to the hours between nine o'clock {9:00) a.m. and eight o'clock {8:00) p.m. No work shall be permitted on Sundays. 4. Within thirty (30) days of completion of grading work, the applicant shall hydroseed or plant an appropriate ground cover over any portion of the site that is graded or cleared of vegetation and where no further construction work will occur within ninety (90) days. Alternative measures such as mulch, sodding, or plastic covering as specified in the current King County Surface Water Management Design Manual as adopted by the City of Renton may be proposed between the dates of November 1st and March 31st of each year. The Development Services Division's approval of this work is required prior to final inspection and approval of the permit. Appeals to the Examiner are governed by RMC 4-8-110 and more information regarding the appeal process may be obtained from the Renton City Clerk's Office, 425-430-6510. Reconsideration: Within 14 days of the decision date, any party may request that the decision be reopened by the approval body. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After review of the reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame. Expiration: The Routine Vegetation Management Permit shall be valid for one year from the date of issuance. An extension may be granted by the Planning Division for a period of one year upon application by the property owner or manager. Application for such an extension must be made at least thirty (30) days in advance of the expiration of the original permit and shall include a statement of justification for the extension. Within thirty (30) days of completion of grading work, the applicant shall hydroseed or plant an appropriate ground cover over any portion of the site that is graded or cleared of vegetation and where no further construction work will occur within ninety (90) days. Alternative measures such as mulch, sodding, or plastic covering as specified in the current King County Surface Water Management Design Manual as adopted by the City of Renton may be proposed between the dates of November 1st and March 31st of each year. Appeals to the Examiner are governed by RMC 4-8-110 and more information regarding the appeal process may be obtained from the Renton City Clerk's Office, 425-430-6510. Reconsideration: Within 14 days of the decision date, any party may request that the decision be reopened by the approval body. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After review of the reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame. Expiration: The Routine Vegetation Management Permit shall be valid for one year from the date of issuance. An extension may be granted by the Planning Division for a period of one year upon application by the property owner or manager.
