The bridge will be located approximately ISO-feet east of the Monster Rd bridge on parcels 722950-0281 and 377920-0090 or 550 Monster Rd. SW. Construction of the bridge supports would be located in a Geologically Hazardous Area. The proposed pedestrian bridge is prefabricated steel girder construction approximately 1l0-feet long and 12-feet wide and will allow trail users to cross the Black River separately from vehicle traffic. Construction activity includes constructing the foundation system on the banks of the Black River and then hoisting the bridge span with a crane to place it on the foundation. All proposed work would occur landward of the Ordinary High Water Mark. The Lake to Sound Trail project was granted Shoreline Substantial Development, Shoreline Conditional Use, and Shoreline Variance permit approval for the alignment with the pedestrian bridge on March 2,2016. The City Hearing Examiner included a condition of approval that required the applicant apply for a Certificate of Exemption for the bridge foundational supports as the construction plans indicated the supports may be within an area of protected slopes. The applicant's Geotechnical Report for the proposed bridge construction has identified deep liquefiable soils that are prone to settlement and lateral spreading during a seismic event. The report recommends a deep soil mixing method that will improve soil structure and create columns of stabilized soil that the bridge foundations can be constructed. Compaction of the slope and restoration would occur following construction of the foundation to maintain long term stability. The proposed development is consistent with the following findings pursuant to RMC section 4-3-0S0C.2.d: i. The activity is not prohibited by this or any other provision of the Renton Municipal Code or State or Federal law or regulation; ii. The activity will be conducted using best management practices as specified by industry standards or applicable Federal agencies or scientific principles; iii. Impacts are minimized and, where applicable, disturbed areas are immediately restored; iv. Where water body or buffer disturbance has occurred in accordance with an exemption during construction or other activities, revegetation with native vegetation shall be required; v. If a hazardous material, activity, and/or facility that is exempt pursuant to this Section has a significant or substantial potential to degrade groundwater quality, then the Administrator may require compliance with the Wellhead Protection Area requirements of this Section otherwise relevant to that hazardous material, activity, and/or facility. Such determinations will be based upon site and/or chemical-specific data. An exemption from the Critical Areas Regulations is hereby Approved with Conditions' . 1. Applicant shall follow all recommendations of the Geotechnical Report. 2. Disturbed areas shall be restored during and immediately after the use of construction equipment. APPEALS: An appeal of this administrative land use decision must be filed in writing together with the required fee to the City of Renton Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA 98057, on or before 5:00 p.m., on February 22, 2017. RMC 4-8-110 governs appeals to the Hearing Examiner and additional information regarding the appeal process may be obtained from the Renton City Clerk's Office, (425) 430-6510. RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be reopened by the approval body. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After review of the reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame. EXPIRATION: Five (5) years from the date of decision (date signed). In response to examiner 20 questions, Vanessa Dolbee, Renton planning manager, noted that although the wetland impacts are addressed through shoreline regulations, compliance with all shoreline regulations would assure compliance with any applicable critical area regulations if critical area regulations were applied to the proposal. Mr. Sorenson noted that the proposed trail will not go beyond the footprint of the existing trail. He also confirmed that the proposed trail improvements will not adjoin any residences. 21 22 23 Jason Rich, applicant, noted that the applicant has exceeded tree replacement standards.
