The payment specified and agreed to in this change order includes every claim by the contractor for any

SUBJ: Delay in Pouring Pervious Concrete
Dear Todd,
Since the first of the year, Road Construction Northwest, Inc. (RCNW)and our concrete
subcontractor Four Seasons has been diligently grading,preparing and installing the concrete
curbing and flatwork in the Park. Fortunately the site has drained well to which we were not
greatly impacted by the wet winter weather. However the consistent cold weather has delayed us
in scheduling the pour of test panel and any pervious concrete.
The concrete curb edging, drainage fabric and ballast rock for the pervious pavement on the
eastside of the park has been completed since the third week of February ready for the pervious
concrete. We have been told by Four Seasons that due to the sensitively of the pervious concrete
mix, ambient temperatures need to be 40-degrees and rising to properly place &cure this
concrete. In the winter we are not able to get these needed temperatures on a consistent basis.
This morning temperatures were still in the low 30's with frost on the ground. At this point,we
are not sure of when we will be able to schedule this remaining concrete work. To date we have
been delayed over 3-weeks. RCNW is requesting that our contract time be extended by 25-
calendar days plus any future days until we can get the required temperatures needed.
Please be assured that we will continue to track the weather forecast and coordinate this pervious
