Signature of Requesting Party CITY OF RENTON,WASHINGTON ORDINANCE NO. 5370 AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, VACATING A PORTION OF ALLEY RIGHT-OF-WAY LOCATED SOUTH OF SOUTH TOBIN STREET, BETWEEN BURNETT AVENUE SOUTH AND WILLIAMS AVENUE SOUTH, (FRIEDMAN DEVELOPMENT,L.L.C.;VAC-04-004). WHEREAS, a proper petition for vacating an alley right-of-way ten feet wide and approximately 50 feet in length running north and south and approximately 115 feet in length running east and west, located south of South Tobin Street,between Burnett Avenue South and Williams Avenue South, was filed with the City Clerk on August 5, 2004, and that petition was signed by the owners representing more than two-thirds (2/3) of the property abutting upon the street or alley to be vacated;and WHEREAS,the City Council, by Resolution No. 3719,passed on September 27, 2004, set October 25, 2004, at 7:30 p.m., in the City Council Chambers of the City of Renton as the time and place for a public hearing on this matter; and the City Clerk having given proper notice of this hearing as provided by law, and all persons having been heard who appeared to testify in favor or in opposition on this matter,and the City Council having considered all information and arguments presented to it;and WHEREAS, the Administrator of the Planning/Building/Public Works Department has considered this petition for vacation, and has found it to be in the public interest and for the public benefit, and that no injury or damage to any person or properties will result from this vacation;and WHEREAS, on April 11, 2005, City Council adopted the recommendation of the Planning and Development Committee to accept compensation at$25,500 for the alley vacation CFRTH:IC/ + , 1l. the undersigned City Clerk of the City of Renton, Washington, certify that this is a true and correct copy of OrdinQhcc '5370 . SECTION II. Compensation is set in the amount of $25,500 for this alley vacation and a 20-foot right-of-way dedication has been accepted in lieu of the cash compensation. SECTION III. This ordinance shall be effective upon its passage, approval, and five days after its publication. A certified copy of this ordinance shall be filed with the Office of Records and Elections, and as otherwise provided by law.
