RE: Maintenance Letter of Understanding
BNSF Woodinville Branchline East Side Ditch Cleaning(MP 3.13 to 3.40)
Dear Mr. MacDonald:
The City of Renton requests your assistance in maintaining a ditch along the east side of the BNSF
Woodinville Branchline between Mile Post (MP) 3.13 and MP 3.40. This request is made in accordance
with agreement CAG-95-065 dated April 13, 1995 between the City of Renton and BNSF.The
agreement assigned the maintenance of this section of ditch to the City of Renton, although it is
located within BNSF right-of-way.The ditch in BNSF right-of-way was utilized by the City for roadway
drainage improvements, as part of the Houser Way North Extension Transportation Improvement
Project from Bronson Way North to North 8th Street.The agreement provides for the basic
understanding of the need to perform maintenance on a cooperative basis as both parties have a
shared interest.The ditch is in need of maintenance and there have been flooding incidents, including
water over the tracks. Due to the location of the ditch on BNSF property and the impact to the tracks,
BNSF is in the position to provide the more efficient and economically feasible maintenance to the
ditch with the least amount of impact to the parties and other businesses in the area.Therefore the
City requests that BNSF clean the ditch along the section of track from MP 3.13 to MP 3.40 of the
Woodinville Branchline.The City will provide any necessary grade control to ensure the ditch drains
appropriately.The City agrees to reimburse BNSF for the actual cost of this work, in an amount not to
exceed$25,000, per the attached estimate provided by BNSF.
Please sign and date both copies of this Maintenance Letter of Understanding,and return a copy to the
City.Once the work is completed please submit an invoice for the actual cost of work to the City for
payment.
