Home My WebLink AboutAdden 09 LAG-04-003 ADDENDUM NO 9-18 ADDENDUM NO. 9-18 TO LAG-04-003 PARK AND RIDE GARAGE AGREEMENT Between City of Renton and King County THIS ADDENDUM No. 9 to Lease Agreement LAG-4-003 ("ADDENDUM No. 9") is effective January 1, 2018 ("Effective Date") by and between the City of Renton ("City" or "Owner"), a Washington municipal corporation, and King County, a home rule charter county acting through the Transit Division of its Department of Transportation ("KCDOT"). The City and KCDOT are referred to collectively in this Agreement as the "Parties." WHEREAS, by this Addendum, the Parties mutually agree to amend the original and existing Park and Ride Garage Agreement, which permitted transit and rideshare commuters to use a portion of Renton' s property for a park and ride lot, entered into by the Parties on June 1, 2004 LAG-04-003 ("Original Agreement"), and the previous mutually agreed written amendments/addenda of that original and existing Park and Ride Garage Agreement (with each amendment and addendum and the original agreement collectively referred to as the "Agreement"). Subsequent Amendments/Addenda to LAG 04-003 ("Amendment" and "Addendum" are used interchangeably): Amendment 1-08- executed on October 22, 2008, expanded the number of commuter parking spaces to serve transit customer ridership and modify the compensation under Section 2 payment) of the Original Agreement. Amendment 2-09- executed on November 24, 2008, extended the Term to December 31, 2009. Amendment 3-09- executed on December 31, 2009, extended the Term to December 31, 2010. Amendment 4-10- executed on December 31, 2010, extended the Term to December 31, 2011. Amendment 5-12- executed on December 31, 2011, extended the Term to December 31, 2012. Amendment 6-13- executed on December 31, 2012, extended the Term to December 31, 2013. Addendum 7-14- executed on November 17, 2014, extende l.the Term"to oec`� er 34`, 2015 Addendum 8-16- November 30, 2015 letter extended the term for 2Q16 and 201 _ " ''' ' NOW, THEREFORE, in consideration of the mutual promises and covenants in this Addendum and other good and valuable consideration, the sufficiency and receipt of which is hereby acknowledged/the Parties agree to the following: SECTION 1. Paragraph 3 Term of the Agreement is amended to read as follows: This Agreement shall be in full force and effect and binding upon the Parties beginning June 1, 2004, and shall continue until it expires on December 31, 2018. KCDOT shall pay the rent and use the parking spaces as indicated on Exhibit 9-A, attached and fully incorporated into Addendum 9-18. All terms and conditions of the Agreement not amended by this Addendum 9-18 shall remain in full force and effect and are ratified and re-confirmed. To the extent any term(s) and/or condition(s) of the Agreement conflicts with any term(s) and/ or condition(s) of this Addendum, the term(s) and/or condition(s) of this Addendum shall control.
