HomeMy WebLinkAboutAdden 3 CAG-15-224, Adden #3-18 (,` 4 4)4.N 0 AMENDMENT NO. 3 TO AGREEMENT FOR CEDAR RIVER 205 PROJECT LEVEE RECERTIFICATION CAG-15-224 THIS AMENDMENT, dated June 1, 2018, is by and between the City of Renton (the "City"), a Washington municipal corporation, and Tetra Tech, Inc. ("Consultant"), a Washington corporation. The City and the Consultant are referred to collectively in this Amendment as the "Parties." Once fully executed by the Parties, this Amendment is effective as of the last date signed by both parties. Whereas, the City engaged the services of the Consultant under Agreement CAG-15-224, dated December 7, 2015, to provide necessary services for the Cedar River 205 Project Levee Certification (referred to herein as the "Agreement"); Whereas, the Parties wish to amend the Agreement to change the scope of work, change the time of Completion, and change the compensation/payment in order to complete Phase II of the certification process and respond to comments made by FEMA. NOW THEREFORE, It is mutually agreed upon that in accordance with Section VIII Extra Work, CAG-15-224 is amended as follows: 1. Scope of Work: Section I, Scope of Work, is amended to add work as specified in Exhibit A-3, which is attached and incorporated herein. 2. Time of Completion: Section V, Time of Completion, is amended pursuant to the schedule(s) set forth in Exhibit B-3. All Work shall be performed by no later than June 1, 2019. 3. Payment: Section VI, Payment, is amended so that the maximum amount of compensation payable to Consultant is increased from $538,295 to $603,086 plus any applicable state and local sales taxes. The additional compensation shall be paid based upon Work actually performed according to the rate(s) or amounts specified in Exhibit C- 3 which is attached and incorporated herein. 4. All terms of the Agreement not explicitly modified herein shall remain in full force and effect and such terms shall apply to Work performed according to this Amendment as if fully set forth herein. '' 4istS11N���`\ PAGE 2 OF 2 CEDAR RIVER 205 PROJECT LEVEES CERTIFICATION Scope of Work&Fee Estimate—Phase 2,Amend.3 ATTACHMENT A CEDAR RIVER 205 PROJECT LEVEE CERTIFICATION PHASE II - ENGINEERING ANALYSIS AND CERTIFICATION AMENDMENT 3 SCOPE OF WORK OVERVIEW The following scope of work is for continued professional engineering consulting services to evaluate and certify the Cedar River 205 Levee in accordance with FEMA requirements as codified in 44 CFR Section 65.10.The levee system is located between Lake Washington and approximately the Williams Avenue South Bridge, and is approximately 2.5 miles in length (1.25 miles on each side of the river). This amendment provides additional funds to complete Phase II. The Phase II effort became more extensive than originally scoped because of the need to have a two-step CLOMR submittal process. The first submittal is needed to provide FEMA acceptance of several aspects of the freeboard analysis that can significantly affect the improvement required to meet freeboard requirements.The primary areas of input needed are on the revised hydrology which lowers the 100-year flood from 12,000 cfs to 10,900 cfs,the incorporation of the dredging and sedimentation cycle in the R&U analysis which reduces the freeboard requirement by 1 foot and the interpretation of the upstream high ground tie-in requirements for the Cedar River. The amendment covers additional costs incurred due to the need to perform an initial CLOMR submittal to receive FEMA review of these freeboard related items. This amendment will take the certification effort to the point where a decision on the important freeboard aspects from FEMA is made.At that point, Phase III can begin with the actual design of the improvements needed and submittal of the final CLOMR incorporating the preliminary design of the required improvements. PHASE II — Engineering Analysis and Certification The amendment covers additional costs incurred in developing the CLOMR submittal (Task 11)and finalizing supporting documentation (minor efforts in Tasks 4, 6, 8 and 9)the ongoing coordination with FEMA on the initial CLOMR submittal (Task 12), development of an emergency preparedness plan (Task 13)for the Cedar River 205 Levee and project management(Task 1). Task 1 - Project Management and Meetings This effort includes general project management of the Tetra Tech team from April 1, 2018 going forward for the duration of Amendment 3.This includes Tetra Tech's subcontractor GeoEngineers and their associated internal project management costs. Project management primarily includes scheduling, monitoring progress, invoicing, internal team coordination, and coordination with the City. Assumptions: • Coordination with FEMA is covered in Task 12. Deliverables • Monthly invoices including progress reporting 1. Task 4—Embankment Protection Assessment Minor technical work to incorporate the riprap protection into the initial CLOMR submittal. Assumptions: • One hour of effort by the Hydraulic Engineer Deliverables: • None Task 5— Interior Drainage Analysis No effort in this scope of work. Task 6— Embankment and Foundation Stability Analysis Minor technical work to incorporate the embankment and foundation stability analysis into the initial CLOMR submittal. Assumptions: • Two hours of effort by the Hydraulic Engineer Deliverables: • None Task 7—Settlement Analysis No effort in this scope of work. 'b TETRA TECH 2 May 31, 2018 CEDAR RIVER 205 PROJECT LEVEES CERTIFICATION Scope of Work&Fee Estimate—Phase 2,Amend.3 Task 8—Structural Evaluation Minor technical work to incorporate the structural evaluation into the initial CLOMR submittal. Assumptions: • Six hours of effort by the hydraulic engineer Deliverables: • Finalized structural analysis technical appendix and incorporation into the Certification Report Task 9—Operations and Maintenance Manual Review Minor technical work to complete the review of the O&M manual incorporate the results into the CLOMR submittal. Assumptions: • Twelve hours of hydraulic engineer time • Development of the Emergency Action Plan requested by FEMA is covered in Task 13. • O&M manual will be finalized in Phase III to incorporate any improvements made as well as the EPP Deliverables: • Provide proposed O&M Manual edits to the City Task 10—Identify Improvement Needs No effort in this scope of work. Task 11—Certification Report This task covers a significant effort conducted in finalizing the CLOMR submittal report,the MT-2 Forms and the associated Appendices and Attachments. It also includes the application fee charged by FEMA for review of the CLOMR. Assumptions: • Four hours of effort by the Project Manager • Five Hours of Effort by the H&H QA/QC lead (Patti Sexton) • 73.5 hours of effort by the Hydraulic Engineer • FEMA CLOMR Submittal/Review Fee of$7,000 • Addressing FEMA comments on the certification package is covered in Task 12 Deliverables: • Submittal of the initial CLOMR Package (Submitted April 20, 2018). Task 12— Respond to FEMA Comments Tetra Tech and GeoEngineers will respond to comments submittal provided by FEMA on the initial CLOMR.The number of comments expected and the level of effort necessary to address them is unknown. The actual level of effort to address the comments will depend upon the nature and number of the comments. Therefore, a reserve pool of hours is established to address the comments.This task includes the following work items: ( j ]TETRATECH 3 May 31, 2018 CEDAR RIVER 205 PROJECT LEVEES CERTIFICATION Scope of Work&Fee Estimate—Phase 2,Amend. 3 • Review FEMA comments and participate in a phone call meeting(s)with City staff to discuss approach to addressing the comments.Appropriate staff member from Tetra Tech and GeoEngineers and will participate in this phone call meeting(s). The consultant team will provide a brief written documentation to the City that outlines the approach to addressing the comments and the expected level of effort necessary to address the comments. • Tetra Tech and GeoEngineers will participate in a phone call meeting(s)with the FEMA reviewers and/or FEMA regional engineers to present our approach for addressing the comments. • Tetra Tech and GeoEngineers will address the FEMA comments. • The consultant team will provide to FEMA addenda to the initial CLOMR report that respond to and address the FEMA comments and requests for additional information. Assumptions: • There will likely be multiple rounds of comments necessary to satisfy FEMA requests for information and comments.This is due to the nonstandard nature of the initial CLOMR submittal where we are using it as a vehicle to get FEMA to determine if they will accept several elements of the freeboard analysis. • The effort is higher than the original Phase 2,Task 12 estimate because of the multiple rounds of comments/requests expected from FEMA and additional coordination with FEMA. • The final CLOMR will be developed and submitted as part of Phase Ill. Deliverables: • Addenda as required to respond to FEMA requests for information. Task 13 — Develop Emergency Preparedness Plan This task covers the development of an Emergency Preparedness Plan as requested by FEMA as an additional requirement of the CLOMR submittal. The Emergency Preparedness Plan will be developed to be consistent with The Emergency Action Plan Guidelines Version 2.0 as recommended by the FEMA review team. This task includes the following work items: • Set up Emergency Preparedness Plan document to be consistent with guidance recommended by FEMA review team • Preparation of project maps, floodplain maps, inundation maps, maps of the levee system, and hydraulic profiles consistent with the Emergency Action Plans Guidelines document • Work with the City to prepare: o Tables of organizational charts and key contacts o Lists of tasks to be performed in an emergency event o Tables of shelters, critical facilities, hazardous material locations o Communications protocol o Recommendations for training and list of key personnel to attend training o Maps of evacuation routes Assumptions: • The City of Renton will work with Tetra Tech to provide contact and other information to fill out tables and develop maps identified above • The Emergency Preparedness Plan will need to be approved by the City Council Deliverables: TETRA TECH 4 May 31, 2018 CEDAR RIVER 205 PROJECT LEVEES CERTIFICATION Scope of Work&Fee Estimate—Phase 2,Amend.3 • A draft Emergency Preparedness Plan for the City to review. • A final Emergency Preparedness Plan ( jTETRATECH 5 May 31, 2018 CEDAR RIVER 205 PROJECT LEVEES CERTIFICATION Scope of Work&Fee Estimate—Phase 2,Amend.3 I'Th)TETRATECH 6 May 31, 2018 CEDAR RIVER 205 PROJECT LEVEES CERTIFICATION Scope of Work, Schedule &Fee Estimate Phase 2,Amend.3 ATTACHMENT B CEDAR RIVER 205 PROJECT LEVEE CERTIFICATION PHASE II, AMENDMENT 3 SCHEDULE The schedule for Phase II,Amendment 3 is unknown since it is dependent on FEMA providing comments, requests for information and then reviewing the initial CLOMR submittal from April 2018 and subsequent information provided in response to their requests. FEMA allows themselves 90 days to respond to the CLOMR submittal.
