Meeting Minutes — November 22, 2016
COMMISSIONERS PRESENT: Brent Beden,Andee Jorgensen,Jim Matthew,Jim Phelan
COMMISSIONERS ABSENT: Bill Larson

1. Call To Order:
Chair Jim Phelan called the meeting to order at 4:18 p.m.
2. Approval Of Minutes:
Moved by Andee lorgensen and Seconded by Brent Beden to approve the October 25, 2016 meeting minutes.
Carried.
3. Unfinished Business:
Chairman Jim Phelan began the discussion regarding scheduling of the Evidentiary Hearing for Firefighter Tim
Smith's demotion appeal. The parties discussed who would have the burden of proof and how that would be
determined. Assistant City Attorney, Shane Moloney, recommended to allow for a briefing on the issues. This
will lead to an orderly hearing if the addresses are issued up front.
Moved by Jim Matthew to set a date to allow for a briefing on the issue. Seconded by Andee. Motion Carried.
Mr. Moloney said we should allow for a briefing schedule so that the briefings are provided to all Counsel and
to the Commission. Discussion continued on when the exchange of briefings would be submitted. The
simultaneous submission of the exchange of information was suggested.
Mr. Moloney continued to say that he provided the model Civil Service rules written by Stephen DiJulio since
the City's Civil Service rules didn't have details on hearings including timelines on submitting subpoenas.
Moved by erent eeden to withdraw the previous motion. Seconded by Andee Jorgensen. Motion Carried.
Motion by erent eeden to adopt model Civil Service rule 19.07 to provide authority to the Civil Service
Secretary some of the preliminary matters including scheduling. Seconded by lim Matthew. Motion Carried.
Moved by erent eeden to set the deadline for the exchange of information would be January 6, 2016, and the
procedural hearing schedule forJanuary 12, 2016. Seconded byJim Matthew. Motion Carried.
