One purpose of the ULS code is to provide an alternative to condominiums that allows ownership of the land. In order to afford existing townhouse owners the opportunity to build equity in land, a provision was included in the ULS code that allows it to apply to existing townhouse developments. DECISION: The application of ULS code to existing townhouse developments will have a provision that requires the development to have obtained a Certificate of Occupancy before the adoption date of Ord. 5818 (10-17- 2016). JUSTIFICATION: ULS code requires certain improvements that would not be required of townhouse development that does not utilize the ULS code. Once the ULS code was adopted, developers had the option of creating condominiums or creating fee-simple townhouse units; if a developer opted to create condominiums they should not have the option to utilize ULS code and circumvent those higher standards required.
