Specifically, the City requests that the Hearing Examiner require the applicant to utilize an alternate location for the cell -on -wheels (COW) on a different site in the downtown area. The original denial of the TUP application did not prevent Verizon from filling gaps in its coverage, and the applicant's statements to that effect were not supported by any evidence. The original TUP denial decision did not result in a blanket denial of all TUP's, but rather a targeted denial that ended a use on a particular site that was objected to by nearby residents, was not properly screened per the original TUP's conditions, and was intended to be installed for only approximately eight months per the applicant's initial application. The COW has now been located on the site and has impacted the nearby residents for double the original period — approximately a year and 4 months. In addition to a more equitable distribution of the impacts that would result from the utilization of a different site in the downtown area, the applicant would be able to continue to provide the capacity and coverage of the network in the area while meeting the intent of temporary use permits which is to allow for uses typically not allowed in a zone due to incompatibility or significant impacts to operate for a short period of time. Alternatively, if the request to require the applicant to locate the COW at an alternative location is not granted, the City requests that the Hearing Examiner amend the additional condition requiring the applicant to post a bond for the landscape screening. The condition added by the Hearing Examiner did not include a deadline for Verizon to post the subject bond, causing compliance uncertainty for both the City and Verizon. In order to ensure a timely posting of the bond, the City requests a deadline of December 31, 2018 be added to the condition.
