Comcast is applying for a variance request in order to upgrade their existing facilities. Comcast proposes to overlash 24 ct fiber; place new riser; trench approximately 5 feet; place 1 (2”) conduit and place a new vault along SE 128th Street. Comcast is requesting that the City of Renton approve this variance request based on the fact that the requirements for undergrounding this proposed over-lash will not cause substantial adverse impacts to other person or entities in the immediate area and will cause undue hardship. 1. Installation of undergrounding facilities will increase the total cost of construction roughly 15-25 times the amount of an aerial over-lash on the existing Comcast strand. 2. Potential damage to underground facilities will be increased. 3. Over-lash will not cause substantial adverse impact to other persons or entities in the immediate area. Over-lashing the cable will be accomplished in a few days, and the residents will not notice any impact. Comcast will clean up the over-lashed spans as necessary and identify and remove any existing dead cables along this route. 4. The variance is necessary to prevent and undue hardship due to the increased construction costs if forced to install the proposed extension underground. 5. The granting of the variance will not be materially detrimental to the public welfare because Comcast does agree to underground the cable system, but they are waiving the obligation into the future when all other utilities are underground to prevent an undue hardship against Comcast currently. Upon the granting of the Variance, Comcast will coordinate construction and traffic control as per your requirements. Comcast and their contractors want to cooperate at the highest level and agree to adhere to all provisions and requirements set forth by the City of Renton to insure safe installation and maintenance of the proposed facilities. Traffic Control Plan July 27, 2018 Cody Shackett Comcast Cable Communications, LLC 410 Valley Ave NW Puyallup, WA 98371 Via Email: owen_shackett@comcast.com SUBJECT: Request for Undergrounding Exemption (JT#279208, MFP18002622, 15800 SE 128th St) Dear Mr. Shackett: The City of Renton has reviewed your request to grant Comcast an exemption from Renton Municipal Code (RMC) 4-6-090(C) which states that all new electrical or communication facilities shall be required to be installed underground, pursuant to the standards of the section of RMC. Comcast proposes to have SEFNCO Communications overlash approximately 460 lineal feet of 24-count aerial fiber to existing Puget Sound Energy (PSE) poles beginning at a located on the north side of SE 128th Street at 158th Avenue SE extending 460 feet west along the north side of SE 128th Street to an existing pole on the west side of the driveway for 15606 NE 4th Street/SE 128th Street. ANALYSIS: The City has considered the request for an exemption from RMC 4-6-090(D)(1)(h) i and ii. Ordinance 5720 grants Comcast, the right to install fiber optic cable and related appurtenances under, along, over, below, through and across the streets, avenues and alleys of City of Renton within the right- of-way of Renton. Section 3.4 of the franchise ordinance states that if all of the distribution lines all the wireline service providers, such as telecommunications service providers, as defined in RCW 35.99.010, a utility service provider or a Cable Operator (collectively “Service Providers”) in any portion of the Franchise Area are underground, Grantee shall place its Cable System’s distribution cables underground within that area; provided that such underground locations are actually capable of accommodating Grantee’s cable and other equipment without technical degradation of the Cable Systems’ signal quality. The proposal would utilize existing poles and attach to the existing Comcast aerial path. As minimum vertical height clearance of 15’-6” would need to be provided for, and existing obsolete cable would need to be removed; staff recommends these as conditions of approval. Therefore, the City is granting an exemption with conditions, per RMC 4-6-090(D)(1)(h) i and ii which allows for extensions of existing overhead communication facilities when there are continuing requirements for poles and it is not likely that there will be undergrounding in the foreseeable future; and, when there are existing overhead electrical or communication facilities that will not be removed and the facilities that would have been required to be removed are parallel to the facilities that will not be removed. Conditions of Approval: 1. Any existing height violations would need to be resolved at the time of construction. New aerial fiber must have a minimum vertical clearance of 15’-6”. 2. Any abandoned or unused cable would need to be removed at the time that construction is taking place. 3. The traffic control plan requires separate approval. 4. The aerial fiber will be required to be installed underground in the future when other utilities are undergrounded. This decision to grant the exemption with conditions is subject to a fourteen (14) day appeal period from the date of this letter per RMC 4-8-110. Any appeals of the administrative decision must be filed with the City Clerk, along with the required appeal fee, by 5:00 pm, August 13, 2018.
