THE CONTRACT IS MODIFIED AS FOLLOWS:
Description of Change:
Add 13 working days to the contract time.
Reason for Change:
On August 7, 2018,the International Union of Operating Engineers (WOE) Local 302 went on
strike over a labor dispute with the Associated General Contractors (AGC)of Washington.The
strike made it impossible for the work to continue on the project until the union permitted its
members to resume work on September 7, 2018. The strike delayed work on the project for a
total of 13 working days.
In accordance with 2016 WSDOT Standard Specification Section 1-08.8 Extensions of Time,the
Contractor requested to add 13 non-compensable working days to the contract as a result of
the strike and the City granted the request.

The Time for Completion is extended 13 non-compensable Working Days in accordance with
Section 1-08.8.
Equitable Adjustment:

Sections 1-04.4 and 1-04.5 of the 2016 WSDOT/APWA Standard Specifications shall govern
this Change Order.The Work of the referenced Contract is modified to include the changes
detailed herein.The payment provided for herein shall constitute the complete and final
settlement for all costs of labor,equipment, materials,overhead,profit, permit fees,and all
other claims that may be made by the Contractor as a result of this change.

1-08.8 Extension of Time
Operating Engineer's Strike
Dear Derek:
This letter is to submit a request for a time extension to the Engineer in writing no later
than 10 working days after the delay occurs. SB Structures,LLC is a party to the
Washington Master Labor Agreement between the Associated General Contractors of
Washington and the operating engineers,and work on the N 27th Place Bridge Scour
Repair Project is performed under this agreement.
All members of the Operating Engineers working under the Washington Master Labor
Agreement between Associated General Contractors of Washington and I.U.O.E Local
302 have been directed by their union to withhold their labor and not report to work for
the duration of a strike,effective at 6:00 am on Tuesday,August 21,2018.
The contract provides the authorized time for completion will be extended for a period
equal to the time the Engineer determines the work was delayed because of strikes. SB
Structures anticipates that all critical path activities will be affected by the strike,and
requests an extension of contract time,beginning today,and continuing until the union
permits its members to resume work.

RE: SB Structures August 22, 2018 letter requesting a contract time extension for the N 27th Place
Bridge Scour Repair Project,Contract CAG-18-002,due to the strike by the IUOE Local 302
Dear Mr.Garcia,
As we discussed at the weekly meeting on Wednesday, August 29, 2018, the City will grant a time
extension for the above referenced contract.The number of additional working days will depend upon
the duration of the strike by the IUOE Local 302.Since the strike is on-going as of the date of this letter,
the total number of additional working days that are being requested remains unknown.
Please note that the 2016 WSDOT Standard Specification Section 1-08.8 requires the surety to consent to
the time extension if it equals 20 percent or more of the original contract time.The original contract called
for 35 working days.Therefore,the addition of 7 working days would reach the 20 percent threshold.The
strike started on August 21,2018.Since that time,8 working days have occurred.Of those working days,
some work was performed on Thursday,August 23,2018 and Monday,August 27,2018.
After the strike has ended,the City proposes the following steps to finalize the contract time extension:
1. SB Structures,LLC sends a letter to the City requesting a number of additional working days.The
letter shall address the requirements of Section 1-08.8,Including consent from the surety.
2. Upon receipt of the request, the City will evaluate the request and provide a written response
granting some,if not all,of the requested additional working days.
