HomeMy WebLinkAboutC_Approval_LetterDenisLawMayorCommunity&EconomicDevelopmentC.E.“Chip”Vincent,AdministratorAugust8,2017JerrySteeleComcast410ValleyAveNEPuyallup,WA98371ViaEmail:JerrySteele2@cable.comcast.comSUBJECT:RequestforUndergroundingExemption(JT#195912,MFP87029,XCI-NETCedarRiver)DearMr.Ste&e:TheCityofkentonhasreviewedyourrequesttograntComcastanexemptionfromkentonMunicipalCode(RMC)4-6-090(C)whichstatesthatallnewelectricalorcommunicationfacilitiesshallberequiredtobeinstalledunderground,pursuanttothestandardsofthesectionofRMC.ComcastproposestohaveSEFNCOCommunicationsoverlashapproximately5,589linearfeetof48-countfibertoexistingPugetSoundEnergy(PSE)poleslocatedontheeastsideof116thAveSE,thenorthsideofSEl84”Street,andthewestsideof124thAveSE.ANALYSIS:TheCityhasconsideredtherequestforanexemptionfromRMC4-6-090(D)(1)(g)iandii.Ordinance5720grantsComcast,therighttoinstallfiberopticcableandrelatedappurtenancesunder,along,over,below,throughandacrossthestreets,avenuesandalleysofCityofkentonwithintheright-of-wayofkenton.Section3.4ofthefranchiseordinancestatesthatifallofthedistributionlinesallthewirelineserviceproviders,suchastelecommunicationsserviceproviders,asdefinedinRCW35.99.010,autilityserviceprovideroraCableOperator(collectively“ServiceProviders”)inanyportionrtheFranchiseAreaareunderground,GranteeshallplaceitsCableSystem’sdistributioncablesundergroundwithinthatarea;providedthatsuchundergroundlocationsareactuallycapableofaccommodatingGrantee’scableandotherequipmentwithouttechnicaldegradationoftheCableSystems’signalquality.TheproposalwouldutilizeexistingpolesandattachtotheexistingComcastaerialpath.Asminimumverticalheightclearanceof15’-6”wouldneedtobeprovidedfor,and1055SouthGradyWay,Renton,WA98057-rentonwa.gov ComcastJobJT#195912Page2of2August8,2017existingobsoletecablewouldneedtoberemoved;staffrecommendstheseasconditioc;ofapproval.Therefore,theCityisgrantinganexemptionwithconditions,perRMC4-6-090(D)(1)(g)iandiiwhichallowsforextensionsofexistingoverheadcommunicationfacilitieswhentherearecontinuingrequirementsforpolesanditisnotlikelythattherewillbeundergroundingintheforeseeablefuture;and,whenthereareexistingoverheadelectricalorcommunicationfacilitiesthatwillnotberemovedandthefacilitiesthatwouldhavebeenrequiredtoberemovedareparalleltothefacilitiesthatwillnotberemoved.DECISION:Therequestedexemptionfromundergroundutilityinstallationrequirements(RMC4-6-090(C)asrequestedbytheapplicantisapprovedsubjecttotheconditionsbelowastherequestcomplieswithexemptioncriteriaofRMC4-6-090(D)(1)(g)iandii.ConditionsofApproval:1.Anyexistingheightviolationswouldneedtoberesolvedatthetimeofconstruction.Newaerialfibermusthaveaminimumverticalclearanceof15’-6”.2.Anyabandonedorunusedcablewouldneedtoberemovedatthetimethatconstructionistakingplace.3.Thetrafficcontrolplanrequiresseparateapproval.Thisdecisiontogranttheexemptionwithconditionsissubjecttoafourteen(14)dayappe&fl2riodfromthedateofthisletterperRMC4-8-110.AnyappealsoftheadministrativedecisionmustbefiledwiththeCityClerk,alongwiththerequiredappealfee,by5:00pm,August22,2017.Sincerely,JenniferT.Henning,AICPPlanningDirectorcc:Chipvincent,CEDAdministratorGreggZimmerman,pwAdministratorBrianneBannwarth,DevelopmentEngineeringManagerJustinJohnson,CivilEngineerIIHollyPowers,DevelopmentServicesRepresentativeP.’tMiller,ConstructionInspectionsupervisorDann’Cooley,DannyCooleycomcast.comMarkLee,Mlee@sefnco.com1055SouthGradyWay,Renton,WA98057rentonwa.gov
