HomeMy WebLinkAboutOverhead Exemption Approval LetterDenisLawMayorCommunity&EconomicDevelopmentC.E.“Chip”Vincent,AdministratorDecember1,2017BillWalkerComcast410ValleyAveNWPuyallup,WA98371ViaEmail:BillWalkerCable.Comcast.comSUBJECT:RequestforUndergroundingExemption(JT#226057,5610NE10thStreet,MEP17003780)DearMr.Walker:TheCityofRentonhasreviewedyourrequesttograntComcastanexemptionfromRentonMunicipalCode(RMC)4-6-090(C)whichstatesthatallnewelectricalorcommunicationfacilitiesshallberequiredtobeinstalledunderground,pursuanttothestandardsofthesectionofRMC.ComcastproposestohaveSEFNCOoverlashapproximately4,000linealfeetof144-countCOAXaerialfibertoexistingPugetSoundEnergy(PSE)polesbeginningonNE10thStreet(westofNileAveNE)thenalongtheeastsideof148thAveSE/NileAveNEtothenorthsideofNE4thPlace,foradistanceofthreehomes.ANALYSIS:TheCityhasconsideredtherequestforanexemptionfromRMC4-6-090(D)(1)(g)iandii.Ordinance5720grantsComcast,therighttoinstallfiberopticcableandrelatedappurtenancesunder,along,over,below,throughandacrossthestreets,avenuesandalleysofCityofRentonwithintheright-of-wayofRenton.Section3.4ofthefranchiseordinancestatesthatifallofthedistributionlinesallthewirelineserviceproviders,suchastelecommunicationsserviceproviders,asdefinedinRCW35.99.010,autilityserviceprovideroraCableOperator(collectively“ServiceProviders”)inanyportionoftheFranchiseAreaareunderground,GranteeshallplaceitsCableSystem’sdistributioncablesundergroundwithinthatarea;providedthatsuchundergroundlocationsareactuallycapableofaccommodatingGrantee’scableandotherequipmentwithouttechnicaldegradationoftheCableSystems’signalquality.TheproposalwouldutilizeexistingpolesandattachtotheexistingComcastaerialpath.Asminimumverticalheightclearanceof15’-G”wouldneedtobeprovidedfor,andexistingobsoletecablewouldneedtoberemoved;staffrecommendstheseasconditionsofapproval.Therefore,theCityisgrantinganexemptionwithconditions,perRMC4-6-090(D)(1)(g)iandiiwhichallowsforextensionsofexistingoverhead1055SouthGradyWay,Renton,WA98057•rentonwa.gov ComcastJobJTh246823Page2of2December1,2017communicationfacilitieswhentherearecontinuingrequirementsforpolesanditisnotlikelythattherewillbeundergroundingintheforeseeablefuture;and,whenthereareexistingoverheadelectricalorcommunicationfacilitiesthatwillnotberemovedandthefacilitiesthatwouldhavebeenrequiredtoberemovedareparalleltothefacilitiesthatwillnotberemoved.DECISION:Therequestedexemptionfromundergroundutilityinstallationrequirements(RMC4-6-090(C)asrequestedbytheapplicantisapprovedsubjecttotheconditionsbelowastherequestcomplieswithexemptioncriteriaofRMC4-6-090(D)(1)(g)iandH.ConditionsofApproval:1.Anyexistingheightviolationswouldneedtoberesolvedatthetimeofconstruction.Newaerialfibermusthaveaminimumverticalclearanceof15’-6”.2.Anyabandonedorunusedcablewouldneedtoberemovedatthetimethatconstructionistakingplace.3.Thetrafficcontrolplanrequiresseparateapproval.4.Theaerialfiberwillberequiredtobeinstalledundergroundinthefuturewhenotherutilitiesareundergrounded.Thisdecisiontogranttheexemptionwithconditionsissubjecttoafourteen(14)dayappealperiodfromthedateofthisletterperRMC4-8-110.AnyappealsoftheadministrativedecisionmustbefiledwiththeCityClerk,alongwiththerequiredappealfee,by5:00pm,December15,2017.Sincerely,JenniferT.Henning,AICPPlanningDirectorcc:C.E.“chip”Vincent,CEDAdministratorGreggZimmerman,PwAdministratorBrianneBannwarth,DevelopmentEngineeringManagerJustinJohnson,civilEngineerIIScottWarlick,EngineeringSpecialistIIHollyPowers,DevelopmentServicesRepresentativePatMiller,constructionInspectionSupervisorDannycooley,Comcastdannycooley@comcast.netJoshBlakeslee,SEFNCO,iblakesleesefnco.com1055SouthGradyWay,Renton,WAp8057rentonwa.gov
