HomeMy WebLinkAboutUnderground Exemption Decision LetterDenisLawMayorCommunity&EconomicDevelopmentC.E.‘Chip”Vincent,AdministratorJanuary23,2018StefaniaSpencerSENFCOCommunications4610TacomaAveSumner,WA98390SUBJECT:RequestforUndergroundingExemption(JT#243191,MFP17005162,11455SE182ndStreet)DearMs.Spencer:TheCityofRentonhasreviewedyourrequesttograntComcastanexemptionfromRentonMunicipalCode(RMC)4-6-090(C)whichstatesthatallnewelectricalorcommunicationfacilitiesshallberequiredtobeinstalledunderground,pursuanttothestandardsofthesectionofRMC.ComcastproposestohaveSEENCOCommunicationsoverlashapproximately2300linealfeetofaerialcabletoexistingPugetSoundEnergy(PSE)polesbeginningontheeastsideofSE182ndStreetat11455SEl82Street,thensouthtoSEStreet,westalongthesouthsideofSE186thStreet,andtothesouthwestcornerofSE186thStreetand114thAveSE.ANALYSIS:TheCityhasconsideredtherequestforanexemptionfromRMC4-6-090(D)(1)(g)iandU.Ordinance5720grantsComcast,therighttoinstallfiberopticcableandrelatedappurtenancesunder,along,over,below,throughandacrossthestreets,avenuesandalleysofCityofRentonwithintheright-of-wayofRenton.Section3.4ofthefranchiseordinancestatesthatifallofthedistributionlinesallthewirelineserviceproviders,suchastelecommunicationsserviceproviders,asdefinedinRCW35.99.010,autilityserviceprovideroraCableOperator(collectively“ServiceProviders”)inanyportionoftheFranchiseAreaareunderground,GranteeshallplaceitsCableSystem’sdistributioncablesundergroundwithinthatarea;providedthatsuchundergroundlocationsareactuallycapableofaccommodatingGrantee’scableandotherequipmentwithouttechnicaldegradationoftheCableSystems’signalquality.TheproposalwouldutilizeexistingpolesandattachtotheexistingComcastaerialpath.Asminimumverticalheightclearanceof15’-6”wouldneedtobeprovidedfor,andexistingobsoletecablewouldneedtoberemoved;staffrecommendstheseasconditionsofapproval.Therefore,theCityisgrantinganexemptionwithconditions,perRMC4-6-090(D)(1)(g)iandiiwhichallowsforextensionsofexistingoverhead1055SouthGradyWay,Renton,WA98057•rentonwa.gov ComcastJobJT#243191Page2of2January23.2018communicationfacilitieswhentherearecontinuingrequirementsforpolesanditisnotlikelythattherewillbeundergroundingintheforeseeablefuture;and,whenthereareexistingoverheadelectricalorcommunicationfacilitiesthatwillnotberemovedandthefacilitiesthatwouldhavebeenrequiredtoberemovedareparalleltothefacilitiesthatwillnotberemoved.DECISION:Therequestedexemptionfromundergroundutilityinstallationrequirements(RMC4-6-090(C)asrequestedbytheapplicantisapprovedsubjecttotheconditionsbelowastherequestcomplieswithexemptioncriteriaofRMC4-6-090(D)(1)(g)iandii.ConditionsofApproval:1.Anyexistingheightviolationswouldneedtoberesolvedatthetimeofconstruction.Newaerialfibermusthaveaminimumverticalclearanceof15’-G”.2.Anyabandonedorunusedcablewouldneedtoberemovedatthetimethatconstructionistakingplace.3.Thetrafficcontrolplanrequiresseparateapproval.4.Theaerialfiberwillberequiredtobeinstalledundergroundinthefuturewhenotherutilitiesareundergrounded.Thisdecisiontogranttheexemptionwithconditionsissubjecttoafourteen(14)dayappealperiodfromthedateofthisletterperRMC4-8-110.AnyappealsoftheadministrativedecisionmustbefiledwiththeCityClerk,alongwiththerequiredappealfee,by5:00pm,February6,2018.Sincerely,JenniferT.Henning,AICPPlanningDirectorcc:CE.‘Chip’vincent,CEDAdministratorGreggZimmerman,wAdministratorBrianneBannwarth,DevelopmentEngineeringManagerJustinJohnson,CivilEngineerIIScottWarlick,EngineeringSpecialistIIHollyPowers,DevelopmentServicesRepresentativeScottwarlick,EngineeringspecialistPatMiller,ConstructionInspectionSupervisorDannycooley,Comcastddnny_cooeyjconjçatnet1055SouthGradyWay,Renton,WA98057rentonwa.gov
