SUMMARY OF ACTION: Development Services Recommendation. Approve subject to conditions DEVELOPMENT SERVICES REPORT: The Development Services Report was received by the Examiner on July 11, 2006. PUBLIC HEARING: After reviewing the Development Services Report, examining available information on file with the application, field checking the property and surrounding area; the Examiner conducted a public hearing on the subject as follows: ML\'UTES The following minutes are a summary of the July IS, 2006 hearing. The legal record is recorded on CD. The hearing opened on Tuesday, July 18, 2006, at 9:56 a.m. in the Council Chambers on the seventh floor of the Renton City HaII. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit No. 1: Yellow file containing the original application, proof of posting, proof of publication and other documentation pertinent to this request. Exhibit No. 2: Preliminary Short Plat Exhibit No. 3 Utilities Plan Exhibit No. 4: Grading Plan Exhibit No. 5: Preliminary Landscape Plan Exhibit No. 6: Recommended Front Yard Orientation Duvall Short Plat File No.: LUA-06-031, SHPL-H August 10, 2006 Page 2 Exhibit No. 7: Neighborhood Detail Map The hearing opened with a presentation of the staff report by Valerie Kinast, Senior Planner, Development Services, City of Renton, 1055 S Grady Way, Renton, Washington 98055. The site is located on the west side of Duvall Avenue NE where NE 10'h Street meets Duvall. The site is zoned R-8 and is designated RSF in the Comprehensive Plan Land Use Map. The 1.17-acre site would be subdivided into 8 lots for the eventual development of detached single-family homes. The site is vacant except for a shed, which would be demolished. The net density would be 7.94 dulac, which meets the requirements for the R-8 zone. All lots meet the minimum requirements for the parcels over an acre in size. The also comply with the width and depth requirements. Lots 1-3 should have their front facing Duvall, Lots 6 and 7 would front on NE I O'h and Lot 8 would front on Chelan Avenue NE. Lots 4 and 5 would front on the proposed alley because they have no other access. Access to the lots would be from a proposed 20-foot wide alley that would run from NE 101h Street to the north property line. Two lots would access from Chelan Avenue NE. A street modification was applied for and approved to allow for the 20-foot wide alley to be used as access for the short plat. The alley would be dedicated to the City as a public right-of-way. The new public alley would be paved with 5-foot wide sidewalks and no parking signage. On Chelan Avenue NE the applicant would be required to complete the street, paved to a width of 32 feet with 5-foot sidewalks. The site is currently vegetated with grasses and wild rose and blackberry bushes. There are no significant trees on the property. Five feet of landscaping has been proposed along the frontages of the property. The landscape strip along Duvall would need to be increased to 10-feet in width to meet code. Two trees need to be added on Lots 4 and 5. A revised landscape plan should be submitted at the time of application for street and utility construction. Traffic, Park and Fire Mitigation Fees were imposed on this plat. Johnathan Kurth, Davis Real Estate Group, 1201 Monster Rd SW, Suite 320, Renton, WA 98055 stated that they agree with the staff recommendations. Darrel Offe, 13932 SE 159`h Place, Renton, WA 98058 stated that he is the project engineer. There is a short plat that has been approved by the City to the west called Vuong Short Plat. That short plat has a proposed hammerhead on the northerly end of Chelan Avenue, this project in conjunction with the Vuong Short Plat will be doing the improvements to Chelan Avenue. The Examiner questioned the address of the listed owners. Mr. Kurth stated that he, Mike Davis, labeled as KD Properties Duvall, LLC are now the current owners of this plat. Kayren Kittrick the Vuong Short Plat does take care of what turnaround is required at this point, there is also a future right-of-way to the north of Chelan. It is an area that is reserved for a road and will eventually become a road. Regarding the 20-foot alley, the modification request was for a primary access that is not off of a Duvall Short Plat File No.: LUA-06-031, SHPL-H August 10, 2006 Page 3 dedicated street. The six lots could have been served through a 26-foot wide private road, but the City did not feel that that was to their advantage. The 20-foot dedication gives a slightly oversized alley and also meets the fire requirements for access. There is no turnaround required because the Fire Department will not be going beyond Lots 1 and 6. Storm drainage, sewer and water are all currently in place. Mr. Kurth further stated that the Vuong Short Plat will be purchasing this plat and developing everything to the City's recommendations. The Examiner called for further testimony regarding this project. There was no one else wishing to speak, and no further comments from staff, The hearing closed at 10:15. a.m. FINDINGS CONCLUSIONS & RECOMMENDATION Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: The applicant, 3ohnathan Kurth, Davis Real Estate Group, filed a request for a Short Plat. 2. The yellow file containing the staff report, the State Environmental Policy Act (SEPA) documentation and other pertinent materials was entered into the record as Exhibit #1. The Environmental Review Committee (ERC), the City's responsible official determined that the proposal is exempt from environmental review. 4. The subject proposal was reviewed by all departments with an interest in the matter. The subject site is located at the northwest corner of Duvall Avenue NE and NE 1 Oth Street. Chelan Avenue NE would be located along the western boundary of the plat. 6. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of single-family uses, but does not mandate such development without consideration of other policies of the Plan. 7. The subject site is currently zoned R-S (Single Family - 8 dwelling units/acre). The subject site was annexed to the City with the adoption of Ordinance 5161 enacted in November 2005. 9. The subject site is approximately 1.17 acres or 48,647 square feet. The parcel is approximately 286 feet wide (east to west) by 170 feet deep. 10. The subject site slopes slightly downward to the northwest. There is a shed on the site that would be removed if the plat is approved. The site is covered by grasses and some other non-descript vegetation but contains no significant trees. 11. The applicant proposes dividing the subject site into eight (8) single-family lots. The lots will range in size from 4,500 square feet to 6,377 square feet. There would be two tiers of three lots and one tier of Duvall Short Plat File No.: LUA-06-031, SHPL-H August 10, 2006 Page 4 two lots. Proposed Lots 1, 2 and 3 (south to north) would be located along Duvall Avenue. Proposed Lots 4, 5 and 6 (north to south) would be located in the middle of the plat. Proposed Lots 7 and 8 (south to north) would be located along Chelan Avenue NE, the western edge of the plat. Proposed Lots 7 and 8 would also take their access to Chelan. 12. A 20 foot wide public alley access would run north to south west of Lots 1, 2 and 3 and east of Lots 4, 5 and 6. It would provide access to Proposed Lots I to 6. It is intended to replace access to Duvall an arterial street, and therefore, restrict access to Duvall from Proposed Lots 1, 2 and 3. A modification to allow the 20-foot alley was approved by the Administrator. The applicant will be responsible for improving the alley and it will need to be dedicated as a public right-of-way. 13. A portion of Chelan Avenue is being extended along the west side of the plat as part of another approved plat. There will be a hammerhead turnaround as part of that development. The applicant will be responsible for dedicating and improving approximately 14 feet to develop a portion of Chelan as part of this current plat proposal. 14. The density for the plat would be 7.94 dwelling units per acre after subtracting roadways. 15. The subject site is located within the Renton School District. The project is expected to generate approximately 4 school age children. These students would be spread across the grades and would be assigned on a space available basis. 16. The development will increase traffic approximately 10 trips per unit or approximately 80 trips for the 8 single-family homes. Approximately ten percent of the trips, or approximately 8 additional peak hour trips will be generated in the morning and evening. 17. Stormwater detention, if required, will be detained within a tank or vault. If it were required under the 1990 Manual it would have to comply with the 2005 manual standards. Temporary erosion control will be necessary. 18. The site is within both the sewer and domestic water service area of the City. Service is available although lines will have to be extended to serve the proposed plat. 19. The applicant will have to meet the City's landscaping standards for individual lots and street trees. 20. The City has adopted mitigation fees for transportation improvements, fire services and parks and recreational needs based on an analysis of the needs and costs of those services. These fees are applied to new development to help offset the impacts new homes and residents have on the existing community and the additional demand for services_ 21. Staff recommended that Lots 1 through 6 must use the new public alley as access and not Duvall Avenue NE or NE 10`h Street. Restrictive covenants shall be recorded on the lots to the effect. Staff also recommended that Lots 1, 2 and 3 shall have their front yards along Duvall Avenue NE and Lots 6 and 7 shall have their front yards along NE IOth Street. 22. At the hearing it was determined that a seven (7) foot dedication along Chelan Avenue NE was necessary. The division of the lot will create additional detached housing opportunities in an area of the City where urban services are already available. The plat will tape advantage of an underutilized parcel and create a series of lots that meet City standards in a plat that also uses alley access to reduce congestion on arterial streets. 2. The development will increase the demands on the City's parks, roads and emergency services. The applicant shall therefore help offset those impacts by providing mitigation that matches the fees established by the City. In other areas of fiscal impact, the development should increase the tax base of the City, thereby providing some offsets to other impacts that will be generated by the new residents. 4. As noted, the plat will use an alley to provide access to a series of lots that would otherwise gain their primary access from arterial streets like Duvall and NE 10th. The plat will be surrounded by three streets, but access would be limited to avoid a series of new driveways from these homes. Staffs recommendation on access and front yard orientation is appropriate. In conclusion, the proposed plat appears to provide a reasonable layout for dividing this approximately one -acre parcel. DECISION: The Short Plat is approved subject to the following conditions: 1. The applicant shall obtain a demolition permit for the existing shed and have the final inspection prior to short plat recording. Lots 1 through 6 must use the new public alley as access and not Duvall Avenue NE or NE 10`s Street. Restrictive covenants shall be recorded on the lots to the effect. This can occur consecutively with short plat recording. A space should be left on the face of the short plat for the recording number of the covenant. Lots 1, 2 and 3 shall have their front yards along Duvall Avenue NE and Lots 6 and 7 shall have their front yards along NE 10 h Street. A note shall be placed on the face of the short plat to this effect. 4. A revised landscape plan shall be submitted at the time of application for site improvement construction permits. In the plan, the landscape strip along Duvall Avenue NE should be increased to the required 10-foot width and the required two trees per lot should be shown on Lots 4 and 5. 5. A homeowner's association or maintenance agreement shall be created concurrently with the recording of the final short plat, which would be responsible for any common improvements and/or tracts within the plat. 6. The applicant shall pay the appropriate Traffic Mitigation Fee based on $75.00 per new average daily trip attributed to the project prior to the recording of the final plat. 7.
