Summary of Request The applicant is requesting a modification to begin construction, for the Duvall Ave Widening project (LUA06-062), at 8:00 am on -Saturdays. RMC 4-4-030.C.3.b states that nonresidential construction activities shall be restricted to the hours between 9:00 am to 8:00 pm, on Saturdays. In order to begin construction activities one hour earlier that what is allowed by code; the applicant is proposing to end construction activities.at 5:00 pm, on Saturdays. The widening of Duvall Ave, NE l Coal Creek Parkway SE starts just south of SE 95th Way and ends just north of NE Sunset Blvd. The project area is within the Residential Single -Family (RSF) and Residential Low Density (RLD) Comprehensive Land Use designations and is zoned both Residential-8 (R- 8) and Residential-4 (R-4) du/acre. The area of work is approximately 10 acres. The Administrator is allowed to grant modifications from the construction standards for individual cases, provided the modification meets the following criteria (pursuant to RMC 4-9- 250.D.2): a. The City Council permitted Duvall Ave NE/Coal Creek Parkway SE to be closed from Sunset Blvd to SE 95th Way on May 19, 2008. The roadway construction involves; grading, laying base, paving, striping, and signing. Construction activities will include the use of; bulldozers, excavators, dump trucks, front loaders, forklifts, concrete trucks, asphalt pavers, and rollers. The City's contractor closed the roadway to through traffic on June 5, 2008. The contract between the City and the contractor, allows the roadway to be closed for a total of 270 days. The City's contractor is requesting to work on Saturdays during favorable weather conditions. RMC 4-4-030.C.3.b states that nonresidential construction activities shall be restricted to the hours between 9:00 am to 8:00pm (11-hour duration), on Saturdays. The contractor believes starting work at 8:00 am is more productive than the 9:00 am start time and has requested a modification of the construction standards..In order to begin earlier, the contractor has agreed to. end work at 5:00 pm; which is a 9-hour duration. It is anticipated that the one hour earlier start time would reduce the roadway closure by one day. Analysis a) Will meet the objectives and safety, function, appearance, environmental protection and maintainability intended by the Code requirements, based upon sound engineering judgment. The requested modification conforms to the intent and purpose of the construction standards; as the proposed duration of construction activities will not exceed the duration allowed by code. In fact, there is a reduction in the proposed duration to 9 hours, from an l i -hour duration. The start of construction one hour earlier than what is allowed by code; should have no negative impact relative to the environment. However, it may cause a minor inconvenience to neighboring property owners. b) Will not be injurious to other property(ies) in the vicinity. The applicant contends that a one hour earlier start time will not be injurious to properties in the vicinity and is a minimal .change from the existing conditions. For each Saturday worked, starting at 8:00, the road closure will open one day earlier. The applicant estimates that about 20-30 Saturdays will be worked during the entire road closure. Staff concurs with the applicant that no additional impact, other than a minor inconvenience, would be caused by the approval of the proposed modification. c) Conform to the intent and purpose of the Code. The applicant contends that after working 6 days in row, construction workers will get home earlier on Saturday evening; giving them more time to recover for another 6 day work week (58+ hours) starting on the following Monday. Staff concurs that the earlier start time would provide for more productivity during construction activities. e) Will not create adverse impacts to other property(ies) in the vicinity. As stated under criterion "a)" & "b)", the proposed construction hours should not create adverse impacts, other than a minor inconvenience, to other properties in the vicinity of the Duvall Avenue NE / Coal Creek Parkway SE Reconstruction project. The proposal is to widen the road to accommodate four travel lanes, a center turn -lane, sidewalks and a bicycle lane. The amount of impervious area in the project area would increase from 4.49 acres to 8.46 acres. Along the west side of Coal Creek Parkway SE, in the King County segment of the project, a 300 ft. long soldier pile retaining wall, up to 25 ft. in height, would be built to stabilize the slope. A surface water detention vault is proposed under SE 107th Pl. and a 100 ft. by 500 ft. detention pond is proposed just east of Coal Creek Pkwy. SE, south of May Creek. A proposed outfall system running from the detention pond into the buffer of May Creek would require a Critical Areas Exemption. A Critical Areas Modification would also be required, to grade and reconfigure the protected slope along the northwestern portion of street. RMC 4-3-050N2ii c There are three streams in or near the project area. Honey Creek is located to the south of the project site. It is a Class 4 stream at this point, according to the City of Renton stream classification map. Surface water from the south segment of the project area presently flows into Honey Creek. The detention vault proposed to be located under SE 107th PI. would connect to the existing storm water system that drains to Honey Creek. May Creek is located at the north of the project site. May Creek is a class 2 stream at this point, according to the City of Renton classification system, which requires a 100 ft. buffer. The proposed detention pond would be partially located within 100 ft. of the ordinary high water mark of the creek. The outfall portion of the detention facility would be located completely in the buffer area but not within the creek. The Renton Municipal Code allows for a Critical Areas Exemption for stormwater management facilities in stream buffers (RMC 4-3-050C5dii), In addition to Honey Creek and May Creek, there is an unclassified and unnamed stream„ referred to as P-9, which runs from the east side of Coal Creek Pkwy., north of SE 100th St. where the road curves west, and drains into May Creek. The stream is not mapped on the City of Renton critical areas maps, The applicant's environmental consultant has classified this stream as a Class 4. Class 4 streams are non-salmonid bearing. At the time of the first Environmental Review Committee meeting on this project on July 17, 2006, there was question as to the classification of the ditches that run along the edges of the existing road alignment. In particular, a representative of the Muckleshoot Tribe was questioning whether there may be fish present in these ditches, which would increase them to a Class 2 stream, by definition. The applicant's consultant has since clarified that there would be no possibility for fish passage into any of the ditches on or surrounding the project site. It would not be possible for fish to pass through the unnamed stream (AKA P-9) into the ditches on the west and east of the road because there is no channel connection of the stream during periods of low flow. Furthermore, no fish could pass into the ditches at the west because the culvert under the road is an impassible barrier. The consultant also explained that no fish could pass into the ditches on the east side of the road upstream of P-9 because of an approximately 70% slope that the water flows down. The consultant reports that it would not be possible for fish to enter the ditches at the northwestern segment of the road because after the water flow in the ditch crosses under 951h, the water in the ditches disperses into overland flow with no defined channel. Beyond that point, there is a greater than 50 ft. drop into May Creek, which would further prohibit the passage of fish. In the northern reaches of the new road, there are steep slopes of over 40% that would be graded in order to slightly straighten the road, and to build a retaining wall along this portion of the road. The Renton Municipal Code allows for a Critical Areas Modification to permit the grading and reconfiguration of steep slope that are the result of previous road construction (RMC 4-3-050J5bii and RMC 4-3-050N2ii c). A portion of the site lies within the 100 year flood plain of May Creek. A segment of the stormwater outfall system running from the detention pond would be located in the flood plain. The City of Renton critical areas regulations allow for an exemption for public surface water projects in Flood Hazard Areas (RMC 4-3-050(c)5diii_ The portion of the site in the City of Renton is designated Residential Single -Family (RSF) on the cities Comprehensive Land Use Map and Residential 8 units/acre (R-8) on the zoning map. The portion of the site in unincorporated King County is proposed for annexation and will likely be designated Residential Low Density (RLD) on the Comprehensive Land Use Map and Residential 4 units/acre (R-4) on the zoning map. ENVIRONMENTAL IMPACTS In compliance with RCW 43.21 C. 240, the following project environmental review addresses only those project impacts that are not adequately addressed under existing development standards and environmental regulations. 1. Earth Impacts: Construction of the widened road, the detention vault and the detention pond will require excavation and grading. The proposed retaining wall along the west side of the road at the north end of the project area would also require excavation and filling. Construction of the detention pond and retaining wall would take place in areas with sensitive and protected steep slopes. A Critical Areas Exemption will be required for this work. The possible impacts of disturbing the soils for the proposed work in the slopes include erosion, sedimentation, and sliding. The applicant has submitted a geotechnical report completed by GeoEngineers, Inc. of Redmond, WA on January 27, 2005. The report describes how possible impacts and risks could be avoided and minimized during the project construction phase. The Conclusions and Design Recommendations section of the report provides recommendations on the design and construction of the street, the retaining wall and the detention facilities. Mitigation Measures: 1. The applicant shall follow the submitted geotechnical report by GeoEngineers, Inc. dated January 27, 2005. 2. The applicant shall provide a Temporary Erosion and Sedimentation Control Plan (TESCP) designed pursuant to the State Department of Ecology's Erosion and Sediment Control Requirements, outlined in Volume II of the 2001 Stormwater Management Manual. Policy Nexus: NIA 2. Air I Noise Impacts: During construction, dust and exhaust from construction equipment would occur. Trucks needed to haul debris and fill would cause dust and emit exhaust. Short-term noise from construction equipment would occur during the duration of construction, and be limited to the hours of 7:00 AM to 8:00 PM. The applicant submitted an Air Quality Discipline Report, completed by Widener & Associates on May 20, 2005, which lists impacts and mitigation measures. The mitigation measures include maintaining construction equipment in good working order, using best management practices to control fugitive dust, and following a traffic mitigation plan during construction. The applicant also submitted a Noise Report completed by Widener & Associates on October 20, 2004, which analyzes the construction noise and future noise environment and proposes mitigation. The report states that construction noise will be minimized by limiting work hours to the hours between 7 am and 10 pm, enforcing the City noise ordinance and utilizing the best available noise abatement technology on construction equipment. The Noise Report does not recommend noise abatement for the long-term noise impacts of the project. The report states that the cost of such measures would be cost prohibitive given the scale and location of the project. In addition to the measures listed in the noise and air reports, the equipment and construction of this project would be required to meet federal, state, and local emissions and noise regulations; therefore no further mitigation is recommended. Mitigation Measures: 1. The applicant shall follow the recommendations made in the Noise Report completed by Widener & Associates for the project, dated October 20, 2004. 2. The applicant will be required to follow this report and meet code requirements. Staff does not recommend any further mitigation of impacts from new surface water runoff through SEPA. Plants Impacts: Areas surrounding the proposed detention facility near May Creek will require clearing of vegetation. The Critical Areas Exemptions that will be granted to complete the part of the work in the buffer of May Creek will contain conditions that require that the amount of vegetation disturbance be kept at the minimum necessary. It will require that any areas where vegetation is removed or disturbed that lie outside of the footprint of the new facility be revegetated. Staff recommends as a mitigation measure that the applicant be required to meet the same requirements in the area outside of the buffer where the pond would be built also to mitigate for removal of a large amount of vegetation in proximity to May Creek. The area of steep slopes along the northwestern side of Duvall that would be graded to widen the road and construct a large retaining wail would also require the removal of vegetation. The Critical Areas Exemption to grade these slopes for road widening will also require that the amount of disturbance be kept to a minimum and that disturbed areas outside the footprint of the new structures be replanted with native vegetation. Mitigation Measures: 1. The applicant shall submit to the Development Services Division project manager, a clearing plan for the area around the detention pond and outfall facility at the time of submittal for construction permits. The area to be cleared for the detention and drainage facilities shall be the minimum amount necessary to construct the facilities. 2. The applicant shall submit to the Development Services Division project manager, a planting plan for all areas that will be disturbed during construction of the detention pond and outfall facility, outside the footprint of the facilities, prior to the issuance of building permits. The planting plan shall show the proposed new vegetation in all areas that were disturbed by construction. A professional, qualified in the use of native vegetation, shall plan and carry out the revegetation. Policy Nexus: NIA 5. Animals Impacts: Increasing the impervious area substantially in the Honey Creek and May Creek sub -basins has the potential for impacting fish in both of these streams. Providing surface water management according to the 2001 DOE Stormwater Management Manual, including water detention and water quality treatment, will reduce the possibility of impacts to an acceptable level. Removing vegetation to build the detention pond and surface water outfall above May Creek also has the potential of degrading the natural drainage function and impacting fish habitat. The water quality facilities though, would provide an important service in improving the quality of the increased runoff from the street before the surface water enters the stream. This benefit outweighs the impact from a loss of vegetation necessary to build the facilities. Clearing only the vegetation that is absolutely necessary to construct the facilities would further limit any possible impact to the creek. The Critical Areas Exemptions to place the surface water outfall facility in the stream buffer and Flood Hazard Area will contain a condition to keep the amount of vegetation removed to a minimum, and to revegetate disturbed areas with appropriate native vegetation. Staff has also recommended as a mitigation measure under Section 4. Plants, above, that revegetation also be required outside of the stream buffer around the detention pond. Please supplement the information in your studies. a. There are no fish in the roadside ditches along the project length. No Fish were observed during either site visit (Photos 1, 2, 3, 4, 5, 6 & 7). An impassible barrier exists on the northeast of the project site at the location of the culvert which "shot -guns" (Photo 8) from the hill side. The interior of the pipe/culvert was dry during the July site visit and only a small amount of water was visible in February. The hill side is estimated to be a 70% slope. The elevation drops from 408 feet at the edge of the road to 381 feet at the bottom of the basin. The outlet of the pipe/culvert is approximately 30ft from the roadway (measured horizontally). In addition there is no water present within the ditches and no water was observed on a site visit July 24, 2006. b. No fish were observed in P9 during either site visit (February and July). Sporadic, non -connected puddles of water approximately 1-2 inches deep were observed along the defined channel in July (Photo 9). The channel width was approximately 2 ft wide at its widest point at the outlet of the culvert (Figure 8 & 9). The channel reduced in size to less than 1 ft wide prior to entering a section of canary reed grass (Photo 10). No defined channel could be found at the time of the survey which would outlet from the canary reed grass. The channel had no surface water visible in the area of the canary reed grass (Photo 11). Therefore, there is no channel connection during periods of low flow. 2. Please classify all waterways on and surrounding the site using City of Renton stream / wetland classification system. (RMC 4-3-050L and M). This should include all ditches along the street the full length of the project. a. According to the Renton Municipal Code (RMC), May Creek within the area of the proposed stormwater outlet and bridge crossing of Duvall Ave/Coal Creek Parkway is Class 2. May Creek is mapped as Class 2 on the RMC Water Class Map of RMC 4-3-050Q4. b. Honey Creek is classified as Class 3 and Class 4. Honey Creek flows from east to west. West of Union Ave (downstream of Union Ave), Honey Creek is classified as class 3. East of Union Ave (upstream of Union Ave), Honey Creek is a class 4 stream_ Honey Creek is mapped on the RN.MC Water Class Map of RMC 4-3-050Q4. c. According to the RMC 4-3-050M1e, (i) the ditches that line the project site are classified as non -regulated wetlands. These ditches are not accessible to fish due to the impassible barrier present at the north end of the project site (north of SE 100`" St, at the first bend in the road, down the hill). Vegetation is mostly canary reed grass, and in some location has been cut down by residents with property that abuts the ditches. The ditches are manmade and function as storm -water conveyance for the adjacent properties and existing roadway. Photos 1 to 7 below. d. P9 is classified as a Class 4 stream. The head of the stream is located at the culvert. The ditch area above the culvert is classified as non -regulated wetland / ditches. e. Wetland E (located just northeast of the culvert at the head of stream P9) is classified as a non -regulated category 3 wetland under the Riti1C 4-3-050M1e- ii(c) because it is non -jurisdictional as determined by the U.S. Army Corps of Engineers. 3. Please provide a map illustrating all critical areas (as defined by our code) and their buffers. (Include May Creek and its buffer, the wetlands, streams, protected slopes along the upper portion of the street, etc.). Please show the location of the road widening, retaining wall and the new detention facilities in relation to the critical areas. a. A maximum area of 5 ft around the outfall and associated gravel and liner may be disturbed. f. A representative of the Muckleshoot tribe points to the fact that the ditches along the edge of the road, identified as wetlands in the submitted studies, are connected to May Creek and could thus be salmonid-bearing. The studies submitted for the project do not rule out the presence of fish in the wetlands or in the unnamed stream referred to as P9. The presence or absence of salmonids is central to the classification of the waterways under the City's critical areas regulations. It is a question that must be answered before the Environmental Review Committee can make a determination on the project. We ask that you please have the consultants address the question of the presence of fish and fish habitat on the site more conclusively. They should explain the interconnection of all of the waters on the site, including the roadside wetlands, the unnamed stream and May and Honey Creeks. Please have them classify the wetlands and streams in the study area according to the City of Renton classification for streams (RMC 4-3-050L1) and wetlands (RMC 4-3-050M1), and discuss permitting implications. The consultants appear to be unaware that in urban streams, salmon are often found in streams that are considered degraded by most subjective survey methods (such as roadside "ditches" that are connected to streams). The onside ditches that are proposed to be filled may contain salmonids if they are connected to the affected streams in the project area. If fish are actually using the affected streams for at least some portion of their life history stages without being documented, then project impacts may occur that could otherwise be avoided and/or mitigated. We recommend that the stream study be supplemented by collecting additional information as we noted in the comments above for the affected streams. 4. The stream report lacks any analysis of the culverts in the project area. They all should have been assessed for being potential fish barriers with discussion about being repaired as part of this project. 5_ The stream report fails to explain why a 25 feet "buffer strip" was surveyed on both sides of Stream P9 and May Creek. If the water tying is correct for the streams in question, then the riparian buffer to be evaluated should be at a minimum the distance of the regulated buffer and up to the largest ecological functional buffer, or the height of a mature conifer tree species capable of growing on the site (i.e. 150- 200+ feet). Anything less will ignore potential adverse impacts to riparian functions including but not limited to shading/water temperature and wood recruitment from the removal of trees beyond 25 feet. 6. The report also fails to discuss why Honey Creek is discussed in the main report but not in Appendix E. Also, if there was no survey conducted for Honey Creek, then it is inappropriate to make any conclusions about the habitat in Honey Creek (see page 22). In addition, the BA implies that the proposed stormwater birdcage outfall will be built in the May Creek Channel (page 12); however on page 16 the BA describes the outfall outside of the ordinary high water mark, but potentially within the flood plain of May Creek. In summary, additional information is needed about the affected streams in the project area and potential impacts as the result of this proposal. I appreciate the notification that the City of Renton intends to annex the Merritt Annexation area as soon as the award of the construction contract takes place and prior to issuing a "Notice to Proceed" on the project. I concur with your understanding that since the annexation is taking place prior to construction, the project will become a City of Renton project and should follow the Renton guidelines for permitting. To recap the project,.the City of Renton has been working with you for the past few years on the design of improvements to Duvall Avenue NE. These improvements run from NE Sunset Boulevard northerly to the current Renton north city -limit, and extend beyond our current city limit north through King County to the City of Newcastle city limit. Residents in the vicinity of Duvall Avenue NE proposed the Merritt lI Annexation in March 2005. The Merritt H Annexation started as a 28-acre annexation proposal that slid not.abut Duvall (arid its extensions). The county invoked jurisdiction at the Boundary -Review Board and asked that it be expanded to 133� acres: The City accepted this recommendation:- This annexation will bring all of the -Duvall Avenue NE road improvements into the City. Our agreement with King County calls for us to annex the area after award of the Construction contract. This approach allows King County to make the appropriate contribution to the Duvall Avenue NE construction without raising concerns about diversion of funds. Because the construction contract has been delayed, we have revised our annexation ordinance that called for annexation to be completed by May of this year. However, the City intends to annex the. Merritt Annexation area immediately upon award of the construction contract, and prior to issuing a "Notice to Proceed" on the project. With the annexation taking place before construction begins, the project will be within the City of Renton jurisdiction. According to correspondence with Don Bleasdale of your staff, with the annexation taking place prior to construction, the project will become a City of Renton project and should follow the City of Renton guidelines for permitting. TO SOUTHEAST 95TI WAY THIS AGREEMENT is made and entered into by and between King County, apolitical subdivision of the State of Washington ("the County"), and the City of Renton ("the City") regarding the improvements to Coal Creek Parkway. The: City and the County are collectively referred to as "the parties." RECITALS A. Whereas, the County has a capital improvement project (CIP #200891) on Coal Creek Parkway from the Renton city limits, in the vicinity of Northeast 23rd Street and Northeast 241' Street, to Southeast 95th Way ("the County Project"). B_ Whereas, the City also has a capital improvement project on Coal Creek Parkway from State Route 900 to its City limits ("the City Project,,). The City Project and the County Project are collectively referred to as "the Projects." C. Whereas, the Projects are grant funded by the Transportation Improvement Board t ("TIB") and it is in the best interest of the parties to administer their own grant separately. O- Whereas, the City and the County each have franchise agreements with utility companies which govern the relocation of utilities; E. Whereas the City has identified the need for water and sewer utility improvements in the southerly 200 feet of the County Project (the "Utility Improvements") and will include these improvements in the Projects at the City's expense; _ F- Whereas any Coal Creek Utility District improvements are not a part of this work and will be dealt with separately from this agreement; G. Whereas, the parties agree that the construction of the projects shall provide an important link in the regional transportation system; H- Whereas, it is in the best interest of the parties to establish a lead agency to manage and to provide for the design, environmental review, permitting and construction of the Projects; �. Whereas this Agreement's "n"ted to "the County Project" and the joint project detention/retention pond. f NOW, THEREFORE, the parties agree as follows: AGREEMENT 1 • SCOPE OF WORK The Scope of Work includes the design and construction of the Projects which are to be managed by the City. 2 1.1 The County Project includes: design, environmental review and permitting, property acquisition if needed, and improvement of the existing two through -lanes roadway to a roadway geometry which is based on a twenty year traffic model projection. 1.1.1 The County Project also includes a drainage system with a retention/detention pond. The drainage system shall be designed to meet the Washington State Department of Ecology 2001 Stormwater Management Manual for Westem Washington (DOE Manual). 1.1.2 All other improvements related to the County Project shall be consistent with the King County Road Standards and all applicable requirements including but not limited to King County Code Titles 16 and 21A. 1.2 The schedule and budget for the County Project shall be established by the s City in coordination with the County and in conjunction with any stat gent administrative guidelines, in accordance with Section;L 2.1 1.3 The City shall submit progress reports to the County no less than every 30 days: 2. GENERAL RESPONSIBILITIES 2.1 The City shall be the lead agency for the County Project with regard to Plans. specifications and estimates (PS&E); environmental review and Permitting pursuant to Section 4; and construction. This includes coordinating with the City of Newcastle to align the County Project with a 3 E City of Newcastle project also on Coal Creek Parkway. 2.2 The City shall provide six copies of 30%, 60%, and 90% PS&E, reports, and all environmental documents to the County for review. The County shall provide written comments on PS&E and reports to the City within four weeks after receiving them. The City shalt make any necessary revisions to include the County's comments. 2.3 All new and relocated utilities shall be installed or relocated at the expense of the utility. 2.3.1 The City shall work within the terms and conditions of King County"s existing franchise agreements for relocating utilities. 2.3.2 1f one of the parties requests enhanced installation of new or relocated utilities, including but not limited to, conversion of utility facilities from above ground to underground, the requesting party shall pay for the. enhancement. 2.3.3 1n the event that a utility refuses to pay for the relocation, the j+RMction where that utility is located shall be responsible for installation or relocation of the utility. 2.4 The final design of the County Project shall be mutually agreed upon by the parties. 2.4.1 The City shall notify the County of any variances it may request from King County Road Standards for the design of the County Project. I 4 n 2.4.2 Any variances from the King County Road Standards and the King County Code shall be paid for by the County, except in the case that the City requests the variance independent of requirements placed upon the County Project by third party agencies_ In the case that the City is the sole agency requesting the variance, the City shall pay for the variance. 2.5 The City shall develop and arrange for a joint public information and involvement process that includes the following: 2.5.1 There shall be at least two open houses, one in the City and one in unincorporated King County. The City shall arrange -both open houses. 2.5.2 Each party shall develop a mailing list for joint notice to its residents and shall mail notices to their respective residents. The notice shall include contact information for each parry's residents. 2-5.3 The County shall handle all public information and involvement contacts from members of the public who reside in unincorporated King County. 2.5.4 The City shall handle all public information and involvement contacts from members of the public who reside in the City of Renton. 2.5.5 The County shall handle all public information and involvement contacts from members of the public who do not reside in the City of Renton or in unincorporated King County. W 3 U 2.6 The County shall be responsible for the acquisition of all property necessary for the County Project. Title to any property acquired within the County shall be vested in the County. 2.7 The County hereby grants the City right of entry into the jurisdiction of the County for the purpose of performing any and all tasks necessary to implement this Agreement. 2.8 The County shall be given the opportunity to participate in the value engineering study required as part of the T'IB grant. 2.9 The Parties shall appoint a contact person or persons to act as liaisons for the Projects. These contact persons shall meet on a regular basis to provide guidance for the Projects and serve as a coordination body between the two agencies. 2.9.1 Representing the City of Renton Leslie Lahndt, City Project Mgr. Should the County disagree with elements of this project schedule, the issue shall be addressed in conformance with Section 10, Dispute Resolution. 2.10.1 This schedule will identify major milestones and timelines, including but not limited to the following: 30%, 60%, 90•/o and 100% design documents, environmental review, project permitting, Property acquisition, public involvement, advertisement for bid and award of bid, construction duration, and final acceptance of the County Project. 2.10.2 Tasks that are the responsibility of each party shall be identified in the project schedule. Each party shall review this schedule, and the schedule may be periodically amended with the approval of both the City and the County_ 2.10.3 Should any of the City or the County Road Service Division's tasks not be performed within 30 days of the timeline established by the mutually approved project schedule, the City or the County shall have the right to issue a Notice of Schedule Noncompliance. 2.10.4 If the County Road Services Division or the City fails to accomplish its tasks in a timely manner, resulting in delays of the Projects' schedule, either party may invoke termination under Section 8.4. 3. WATER QUALITY FACILITY AND RETENTION/DETENTION POND 3.1 The parties agree to share the total costs related to the acquisition of property, design, and construction of the water quality facility and the retention/detention pond that shall serve the completed Projects. 3.2 Each party's share of the costs, including property acquisition, shall be proportional to the square footage of impervious surface of roadways constructed within the parties' respective jurisdictions. 3.3 The parties agree to enter into a separate agreement regarding each party's E 7 0 responsibilities on the future maintenance of the retention/detention pond. 4. ENVIRONMENTAL REVIEW AND PERMITS 4• I The City shall be the lead agency for environmental review and shall take the responsibility for fulfilling all State Environmental Policy Act (SEPA) requirements for the work under this Agreement. The County shall review all environmental documents and shall provide continents to the City according to the City's Environmental Review Process. 4-2 11m City shall Prepare all federal, state and local permit application 'documents. 4.2.1 'The City shall obtain aIi state and federal permits, licenses, and aPPmv-s required to complete the County Project. The County Shall support the City in filling out and reviewing all documentation required to secure these approvals. The County shall have four (4) weeks for review and comment on permit documents. 4.3 The County shall be responsible for obtaining approvals for local permits, i construction, licenses, easements, and ROW dedication or any other local approvals required to complete the County Project. 4.4 The County shall process any variances requested from the King County Road Standards related to the County Project. - i [ r P 5. CONSTRUCTION CONTRACT BIDDING 5.1 The City shall prepare the contract bid documents for the City and County Projects in such manner as to allow identification of cost allocations between the parties (by use of bid schedules or other mutually acceptable methods). 5.2 The City shall provide the County with twenty copies of the plans and specifications advertised for bid. 5.3 The City shall advertise the contract in the official legal publication for the City and if necessary other newspapers to provide the widest possible coverage commensurate with the size of the project. The City shall also advertise the Projects in compliance with the T1B Administrative Guidelines. 5.4 The City shall open the bids and shall notify the County of the time and date of the bid opening, which is typically three weeks after the project is advertised. The County may attend the. opening of the bids. 5.5 The City shall tabulate the bids and shall provide a dated, verified copy of the bid tabulations to the County. The bid tabulations shall identify the estimated construction and contractor overhead cost, based upon the lowest responsible bid. 5.6 The City shall provide the County with inspection and administrative costs based on bid tabulations estimates. 5.7 The City shall award the contract to the lowest responsible bidder for the total City and County Projects subject to applicable laws and regulations. 9 S-g The City shall require that the County is included as an additional insured on the contractor(s) insurance policy(s), and that the County is included in the contract(s) indemnification provisions and receives the same Protection as received by the City. 5-9 The City shall be responsible for following all applicable Federal, State and local laws, rules and regulations in the expenditure of the funds to be paid by the County to the City in connection with the County Projec, The City assures the County that its procedures are consistent with applicable laws relating to public contract bidding procedures, and the County neither incurs nor assumes any responsibility for the City's bid, award or contracting procM. 5-10 In connection with this Agreement, neither the City nor any party contracting or subcontracting in connection with the County Project shall discriminate on the basis of race, color, sex, religion, nationality, creed, marital status, sexual orientation, age or the presence of any sensory, mental or physical handicap in employment or application for employment - - or in the administration of the delivery of services or any other benefits under this Agreement, The City shall comply fully with all applicable Federal, State, and local laws, ordinances, executive orders and regulations that prohibit such discrimination. 6. CONTRACT ADMINISTRATION 6.1 The City shall provide the necessary engineering, administrative, ;r UU4 inspection, clerical and other services necessary for the completion of the County Project. 6.2 The County may furnish an inspector (at the County's expense) to insure proper compliance with requirements during the construction of the County Project. The County's inspector shall advise the City of any deficiencies noted. The City shall take any necessary action to resolve the deficiencies noted by the County's inspector. The County's inspector shall not communicate directly with or instruct the contractor directly on any matters regarding contract performance and compliance. 6.3 The City shall at all times keep the County advised as to the progress of the County Project. The City shall not order or approve any changes in the County Project's approved design that constitute a one percent or greater change in the construction budget of the County Project without first consulting and receiving approval from the County. Any changes that are less than one percent of the construction budget shall be included in Progress reports in accordance with Section 1.3. 6.3.1 Any changes in the approved County Project design requested by either the City or the County and approved by the County shall be at the County's expense. County approval of change orders shall not be unreasonably withheld. 6.4 The County Road Engineer shall have the final authority to determine whether any changes to the County Project shall be implemented. 6.5 Prior to the County Project completion, both parties shall perform a mutual final inspection of the County Project. The County may provide a written deficiency list to the City within ten working days after the final inspection. The list shall contain only construction deficiencies that are out of compliance with the contract specifications. Final acceptance of the Projects shall be by the City Planning/Building/Public Works Administrator and the County Road Engineer. 7. 7.1 The County shall pay the City for actual costs of the County project incurred by the City, including, without limitation, construction contractor costs, permit fees, and all costs incurred by the City for engineering, clerical, construction, administrative, inspection and other services attributable to the County project. 7.1.1 The County shall pay the City for costs of the County Project related to County -approved change orders, unforeseen field conditions, geotechnical testing and services, environmental Mitigation conditions, and any utility relocation or installation as Provided by Section 2.3.3. 7-2 The City shall bill the County for actual expenses incurred, on no more than a monthly basis. These bills shall reflect actual project costs. All Payments shall be due within 30 days of the billing date. - M 12 8. DURATIOWFERMWATION 8.1 This Agreement shall remain in effect until final acceptance of the County Project and payment by the County of all monies due from the County to the City. 8.2 If expected or actual funding is withdrawn, reduced or limited in any way, or if Federal funding requirements affect the County Project, prior to the completion of the County Project, either party may, with thirty (30) days written notice to the other party, terminate this Agreement. 8.3 In the event of termination prior to completion of the County Project, the party requesting termination shall pay all direct and indirect phasing -out costs. Payable termination costs shall not exceed the actual costs incurred as a result of termination of this Agreement. 8.4 Either party may terminate this Agreement for default in the event the other party materially breaches this Agreement. Termination shall be effected by serving a Notice of Termination by certified mail, return receipt requested, on the other party setting forth the manner in which said party is in default and the effective date of termination, which shall not be Iess than fourteen (14) calendar days after the date of the notice; provided, however, such termination shall not take effect if the default has been cured within seven (7) calendar days after the date of the notice of termination. 8.5 The City or County may terminate this agreement on 90 days written notice. q 13 9. LIAR Washington State law shall govern the respective liabilities of the parties to this Agreement for any loss due to property damage or injury to persons arising out of activities conducted pursuant to this Agreement. 10.- DISPUTE RESOLUT ON 10.1 In the event of a dispute between the parties regarding this Agreement, the parties shall attempt to resolve the matter informally. If the parties are unable to resolve the matter informally within 30 days, the matter shall be decided by the Director of the King County Road Services Division and the City Planning(Buildingftblic Works Administrator. 10.2 The Icing County Executive and the Mayor of Renton may also agree in writing to use an alternative dispute resolution process including mediation and binding arbitration. 10.3 Unless otherwise expressly P Y agreed to by the parties in writing, both the City and the County shall continue to perform all their respective obligations under this Agreement during the resolution of the dispute. l 1. AUDITS AND fNSPECTI4NS 11.1 The records and documents with respect to all matters covered by this Agreement shall be subject to inspection, review or audit by the County or 1' 14 i the City during the term of this Agreement and three years after termination. 11.2 Audits and inspections by the grant agency shall be the responsibility of the City. The County shall support the City in meeting audit and inspection requirements. 12. The proposed project is located within the City of Renton, and un-incorporated King County, Washington along the Duvall Avenue NE/Coal Creek Parkway SE roadway. It begins approximately 250 feet north of the intersection of Duvall Avenue NE and NE Sunset Boulevard (SR900) and ends south of SE 95th Way. North of the Renton City limits {between NE 23rd and NE 24th Streets), in unincorporated King County, the roadway is called Coal Creek Parkway SE. The entire project area is located within the urban growth boundary (King County Comprehensive Plan, 2002). The legal geographic description of this area is: Township 23 North, Range 5 East, Section 3 and Township 24 North, Range 5 East, Section 34. King County has agreed to make the City of Renton the lead agency for the project. The areas of the project that fall within King County from SE 95`h Way southward will be annexed as part of an on -going annexation. The annexation process will be complete prior to construction; therefore the City of Renton will be issuing the permits for the project. The proposed name for the project reflects the dual names for the road being widened. The road is named Duvall Avenue NE within Renton City limits and Coal Creek Parkway SE within unincorporated King County. The project will not alter the current road names along the corridor. The road currently is used as local access between the Cities of Renton, Newcastle and Bellevue for the residential and commercial developments throughout the corridor. It is also part of a commuter and freight route between the cities of Renton and Bellevue. Coal Creek Parkway is also used by motorists as an alternate route to access I-405 during peak hours and to access major employment centers. The existing Right -of -Way (ROW) varies from 60 to 100 feet (ROW line to ROW line) within the City of Renton and varies from 60 to 164 feet (ROW line to ROW line) within King County. The proposed ROW varies from 84 to 100 feet (ROW line to ROW line) within the City of Renton and varies from 84 to 164 feet (ROW line to ROW line) within King County. South of SE 100"' Street in the straighter portion of the project, the ROW will vary between 42 and 50 feet (center -line to ROW line) and will be approximately balanced on both sides of the road. For the northern portion of the project the ROW will not be balanced on both sides due to the alignment shift for the proposed roadway. The width in the northern portion will vary between 30 and 134 feet from new center -line to ROW line. For the proposed project, 1.0 acres of ROW will be acquired within the City of Renton and 1.88 acres will be acquired in King County, for a total of 2.88 acres of new ROW. Two properties have been purchased in their entirety for use in the proposed project. They are the Brant and Oehrling properties_ Total cost for the acquisition of ROW is estimated at $2 Million. The proposed project area is 10.697 acres. The existing impervious surface area is 4.492 acres. The proposed impervious surface area is 8.463 acres. This will result in an increase in impervious area of 3.971 acres. Roadway construction would involve grading, laying base, paving, striping and signing. The new roadway would consist of four 11-foot asphalt lanes and one 12-foot center left -turn lane, two 5-foot bicycle lanes on both sides of the road, 5 to 6 foot -wide sidewalks on both sides of the road, as well as cement concrete curb and gutters. Due to groundwater seepage expected from cuts along the west side of the roadway within Unincorporated King County, a soldier pile wall will be constructed. For fill sections, mechanically stabilized earth walls will be used. Layers of crushed gravel and asphalt would then be placed, followed by grading, paving and striping. Construction activities will involve the use of bulldozers, excavators, dump trucks, front loaders, forklifts, concrete trucks, asphalt pavers and rollers. A stormwater pond will be constructed on the north end of the project and will discharge directly to May Creek through an outfall located above the ordinary high water mark. On the south end of the project at NE 107`h Place, a stormwater vault system, consisting of a detention vault and treatment vault will be constructed and will discharge into an existing manhole along Sunset Boulevard (SR900). The existing stormwater system eventually discharges to Honey Creek at the northwest corner of Union Avenue and Sunset Boulevard. Within the project area there exist three streams: May Creek, Honey Creek and the Unnamed Stream P9. There will be no work within the stream or buffers of Stream P9 or Honey Creek. As discussed above there will be an outfall constructed for the stormwater pond within the May Creek buffer. The City of Renton Public Works Department requests a certificate of exemption for the outfall that occurs within the buffer of May Creek, per the Renton administrative code 4-3-050 (c) 5 d i, and requests a certificate of exemption for work within the 100-year flood plain of May Creek, per the Renton administrative code 4-3-050 (c) 5 d iii. The topography of the project site is generally flat with some hilly areas and steep slopes. The steep slopes within the project area near 40% slope. The project will not conduct activities on any slope that is 40% or greater. Most of the area slopes are in the 20% range. The one slope associated with May Creek outfall is slightly less than 40% slope_ The project will not impact jurisdictional wetlands. Five wetlands have been identified in the wetland delineation report, wetlands A, B, C, D, and E. Wetlands A, B and C are considered non jurisdictional under City of Renton ordinances. They were inadvertently created from upland as a result of the excavation of ditch channels for stormwater drainage along the roadway are within the project limits. One jurisdictional wetland, wetland E, located east of Coal Creek Parkway SE and north of SE 100 St is outside of the project limits and will not be impacted by the project. Wetland D is outside the project limits and will not be impacted by the project. Historical investigations indicate that the area was used for coal mining and logging activities. There are no archaeological resources, no ethnographic or archaeological sites within one mile of the project area. An evaluation of the critical areas within the project corridor indicates the presence of the following: (King County) aquatic areas, erosion hazard areas, landslide hazard areas, steep slope hazard areas, and wetlands; (City of Renton) aquifer protection zone and erosion hazard areas. The proposed project has the potential to impact erosion hazard areas, landslide hazard areas, steep slope hazard areas and aquifer protection zones. Mitigation, minimization and conservation measures will be implemented to reduce the impacts to the critical areas within the project corridor. Funding for the proposed project will come from a variety of public sources. The project is estimated to cost $11.30 million, which includes approximately $2.0 million for ROW acquisition and $1.90 million for the engineering, permitting and administration costs. The project is proposed to begin in 2006 and take approximately eighteen months to complete. The project site is located along the Duvall Avenue NE1138'h Avenue/Coal Creek Parkway SE roadway. It begins 260 feet north of the intersection at Duvall Avenue NE and NE Sunset Boulevard (SR900) in Renton, and ends at SE 951h Street to the north in Newcastle. The project involves widening of the road to provide four travel lanes, a center two-way left -turn lane with turn pockets at intersections, bicycle lanes, curb and gutter, sidewalks, as well as including drainage improvements, illumination, and construction of retaining walls. Realignment of the road begins at SE 100th Street to increase the radii of curves in the alignment of the road to the north. The project impacts 0.8 miles of Duvall Ave and the total project area is approximately 10 acres. 2 12. Location of the proposal. Give sufficient information for a person to understand the precise location of your proposed project, including a street address, if any, and section, township, and range if known. If a proposal would occur over a range of area, provide the range or boundaries of the site(s). Provide a legal description, site plan, vicinity map, and topographic map, if reasonably available. ENVIRONMENTAL ELEMENTS EARTH General description of the site (circle one); flat, rolling, hilly, steep slopes, mountainous, other. The project area is generally flat, with some hilly areas, including steep slopes. What is the steepest slope on the site (approximate percent slope?) 20% slope at the northeast corner of the Brant properly (north of SE 95th Way and east of Coal Creek Parkway). The promect contains slopes between 20% and 40%, but no construction_ activities will be conducted on slopes greater than 40%. C. What general types of soils are found on the site (for example, clay, sand, gravel, peat, muck)? If you know the classification of agricultural soils, specify them and note any prime farmland. Area is mapped as Alderwood gravelly, sandy loam, 6 to 15 percent; Alderwood gravelly sandy loam, 15 to 30 percent slopes; and Everett gravelly sandy loam, 5 to 15 percent slopes (Soil Survey of King County Area, Washington) d. According to the King County Sensitive Areas Ordinance Designations, the area approximately 350 feet north of the project site, along the May Creek ravine, has been designated as a Landslide Hazard zone (map dated 12/5/2000). e. Clearing, grading, laying base, and paving will not result in large areas of disturbance that will result in erosion. g. The project area has approximately 4.9 acres of existing impervious surface. The proiect will increase the impervious area to approximately 8.5 acres. The net increase in impervious surface will be approximately 4.0 acres. Proposed measures to reduce or control erosion, or other impacts to the earth, if any: Temporary erosion and sedimentation control measures (BMPs) would be imolemented to minimize siltation and deposition of material into adjacent drainage courses during the construction phase until permanent vegetation and erosion control measures can be established. The stormwater plan has been designed for both water quality and Quantity. 2. AIR a. What types of emissions to the air would result from the proposal (i.e., dust, automobile, odors, industrial wood smoke) during construction and when the project is completed? If any, generally describe and give approximate quantities if known. Impacts to air quality have been addressed in the air Quality analysis. Construction of the project would result in short-term exhaust emissions from construction equipment, dust generation during grading and hauling activities, and an increase in CO (carbon monoxide) emissions from idling vehicles, Are there any off -site sources of emission or odor that may affect your proposal? If so, generally describe_ There are no off -site sources of emission or odor that would affect the proposal. The proiect is included in the Transportation Improvement Plan (TIP) for Puget Sound Region and is therefore in conformance with the State Implementation Plan (SIP) for air quality, The proiect is located within the maintenance area for criteria pollutants carbon dioxide CO) and ozone fO C. Proposed measures to reduce or control emissions or other impacts to air, if any: Minimization measures to be implemented during the project include: maintain proper working construction vehicles, implement BMPs to control fugitive dust (i.e. the use of water spray for dust suppression and covering stock ices) and using a traffic management plan with appropriate signage on alternate routes. 3. WATER a. Surface Water: 1) Is there any surface water body on or in the immediate vicinity of the site (including year- round and seasonal streams, saltwater, lakes, ponds, wetlands)? If yes, describe type and provide names. If appropriate, state what stream or river it flows into. • May Creek is located north of project area. It flows into East Lake Washington. • Honey Creek is located lust south of the Duvall Avenue NE/SR 900 intersection. It is a tributary of May Creek. 4 • One intermittent unnamed stream (P9) is located east of the roadway_ It flows into May, Creek through wetlands and small tributaries. Work will not occur within the 75ft buffer of Stream P9. _ • Waters of the U.S. are located in the immediate vicinity within ditch lines along the roadway and one isolated wetland east of the roadway. 2) Will the project require any work over, in, or adjacent to (within 200 feet) the described waters? If yes, please describe and attach available plans. Fill activities will take place within the ditches in order to accommodate the road widening. These ditches have been inadvertently created from upland as a result of the excavation of ditch channels for stormwater drainage along the roadway. They are considered non- lurisdictional under the City of Renton Administrative Code. Work will occur adiacent to one isolated wetland, east of roadway but is not expected to be directly impacted by the ro'ect activities. Construction of the stormwater QQnd outfall will require work within 200ft of May Creek (Figure A). 3) Estimate the amount of fill and dredge material that would be placed in or removed from surface water or wetlands and indicate the area of the site that would be affected. Indicate the source of fill material. Total area of fill in ditches is approximately 0,18 acres. Fill and borrow will come from a commercial source that meets the criteria of structural fill as described in the 2004 WSDOT Standard Specifications. 4) Will the proposal require surface water withdrawals or diversions? Give general description, purpose, and approximate quantities if known. There will be no surface water withdrawals. The existing drainage patterns will be maintained. The proposed surface water conveyance was analyzed and designed in accordance with current guidelines listed in the stormwater Management Manual for Western Washington (SMMWW). It includes a wet pond, for detention and flow control, as well as vaults, and outfall. The water quality volume required for the drainage areas is 1160 Yard3 (May Creek and 135 yard3 (HoneyCreek). For more detailed information refer to the Hydraulic Report. 5) Does the proposal lie within a 100-year flood plain? If so, note location on the site plan. Yes the outfall of the stormwater pond is within the 100- ear flood plain of May Creek. A certificate is being requested for work at that location. 6) Does the proposal involve any discharges of waste materials to surface waters? If so, describe the type of waste and anticipated volume of discharge. No b. Ground Water: 1) Will ground water be withdrawn, or will water be discharged to ground water? Give general description, purpose, and approximate quantities if known. Ground water will not be withdrawn. Off site flows will be discharged to groundwater as they are now. Roadway runoff will be detained and treated then released to groundwater. 2) Describe waste material that will be discharged into the ground from septic tanks or other sources, if any (for example: Domestic sewage; industrial, containing the following chemicals...; agricultural; etc.). Describe the general size of the system, the number of such systems, the number of houses to be served (if applicable), or the number of animals or humans the system(s) are expected to serve. None. C. Water Runoff (including storm water): 5 1) Describe the source of runoff (including storm water) and method of collection and disposal, if any (include quantities, if known). Where will this water flow? Will this water flow into other waters, if so, describe. Primary source of runoff is from impervious surfaces in the immediate area and stormwater. Roadway runoff within the ro'ect limits will be collected and conveyed to water quality treatment facilities. Water quality treatment facilities will be designed, operated, and maintained in accordance with the stormwater desi n standards specified by the 2001 DOE Stormwater Management Manual for Western Washin ton SMMWW The conveyance system includes a wet pond, for detention and flow control, as well as vaults, and outfall. Outflow from the stormwater pond will discharge through a bubble up catch_ basin into May Creek. Outflow from the detention vaults will discharge into the existing manhole which discharges to Honey Creek. For more detailed information refer to the Hydraulic Report. 2) Could waste material enter ground or surface waters? If so, generally describe. The disposal of waste material. will be conducted in accordance with the WSDOT Manual in order to . prevent waste material from entering ground or surface waters during construction. _ The manual also calls_ for monitoring of waste material disposal and containment. Proposed measures to reduce or control surface, ground, and runoff water impacts, if any: The roadway improvements could potentially have temporary impacts to water duality during construction operations. These impacts would be mitigated using erosion control and water pollution prevention technigues_as required by the Department of Ecology (DOE). Roadway runoff within the ro'ect limits will be collected and conveyed to water quality treatment facilities. Water quality treatment facilities will be designed, operated, and maintained in accordance with the stormwater design standards specified by the 2001 DOE Stormwater Management Manual for Western Washington (SMMWW). 4. Approximately 0.18 acres of waters of US will be impacted_ The vegetation is comprised of invasive weeds and grasses. List threatened or endangered species known to be on or near the site. There are no listed threatened or endangered species known to be on or near the site. Proposed landscaping, use of native plants, or other measures to preserve or enhance vegetation on the site, if any: A The proposed landscaping plan is under development_ The project will include hydroseeding, and both native and drought tolerant plants. 5. ANIMALS Circle any birds and animals which have been observed on or near the site or are known to be on or near the site: Birds: hawk, heron, eagle, songbirds, other: Songbirds. irds. Mammals: deer, bear, elk, beaver, other: Deer and other small mammals. Fish: bass, salmon, trout, herring, shellfish, other: Coho and sockeye salmon, fall Chinook, resident_ cutthroat, and winter steelhead in May Creek (WDFW Habitat and Species Data, September 29, 2003). List any threatened or endangered species known to be on or near the site. Priority anadromous and resident fish are known to be present in May Creek (northeast of the project area : Fall Chinook Coho Salmon Sockeye Salmon Winter Steelhead and resident cutthroat (WDFW Habitat and Species Data, September 29, 2003). There are no terrestrial species known to be on or near the project site. C. Is the site part of a migration route? If so, explain The immediate project vicinity is likely not part of a migration route due to the density of urban development and traffic through the roadway corridor. The riparian corridor along May Creek north of the prolect area serves as a migration route for birds fish and other wildlife. d. Proposed measures to preserve or enhance wildlife, if any: None. 6. ENERGY AND NATURAL RESOURCES a. What kinds of energy (electric, natural gas, oil, wood stove, solar) will be used to meet the completed project's energy needs? Describe whether it will be used for heating, manufacturing, etc. Reconstruction of the road would require the use of crushed aggregate, a natural resource, for base and pavement. Indicate what hours noise would come from the site. Short-term impacts would occur as a result of construction activities, which may include jack hammering. Construction _noise will predominantly result from pavers, graders, rollers, etc. Based on the data tabulated by the EPA and WSDOT (1971, 1991), sound levels generated during construction would likely not exceed 105 dBA, which would be the worst -case scenario. Work will be limited__to the hours of lam and 10pm, in compliance with the city noise ordinances. Long-term noise impacts would occur as a result of the proiect. At several locations noise levels would meet or exceed established FHWA / WSDOT thresholds. The greatest increase between the "no build" and "build" alternatives is approximately.4 dBA. Utilities, currently above ground within the City of Renton will be moved under the road. Within the City of Renton and King County, power lines will be relocated underground, which will improve the view Quality of the proiect corridor. The road will not pass through any new landscapes. Some of the homes adjacent to the proposed widening will experience view alteration due to the reduction in distance to the roadway. C. Proposed measures to reduce or control aesthetic impacts, if any: None, the impact is considered to be minimal. 11. LIGHT AND GLARE What type of light or glare will the proposal produce? What time of day would it mainly occur? The proiect will not produce any additional glare: however, there may be additional light poles installed. It is not known at this time how many additional light poles will be needed. These light poles will be directed towards the roadway and will operate during the evening and early morning hours. Light and glare associated with construction activities would involve any lighting used to illuminate the proiect area as needed between 7am and 1 Opm. b. Could light or glare from the finished project be a safety hazard or interfere with views? The permanent lighting along the roadway will enhance the view of the road and will aid in the safety of travel along the route. C. What existing off -site sources of light or glare may affect your proposal? None Proposed measures to reduce or control light and glare impacts, if any: Permanent Lighting will be directed downward, toward the roadway, to reduce light and glare impacts. The use of construction lighting will be limited. Lighting will not be used after construction has stopped each day by '1 Opm, and will be used no earlier than 7am. 12. None Proposed measures to reduce or control impacts on recreation, including recreation opportunities to be provided by the project or applicant, if any: The completed project will enhance the area by providing sidewalks, bicycle lanes, and roadway illumination for vehicles, pedestrians, and cyclists. 13. HISTORIC AND CULTURAL PRESERVATION a_ Are there any places or objects listed on, or proposed for, national state, or local preservation registers known to be on or next to the site? If so, generally describe. liM Based on a cultural resources assessment of the area, no archaeological resources were identified that are recommended eligible for the National Register of Historic Places (NRHP), or the Washington Heritage Register (WHR). There have been no ethnographic or archaeological sites recorded within a radius_ of one -mile of the project. b. Generally describe any landmarks or evidence of historic, archaeological, scientific, or cultural importance known to be on or next to the site. Indications of past logging activities were recorded (i.e. springboard notch and a rusted logging cable) in Parcel f#3424.059086;_however, this is not considered to have further research potential or contribute to a greater understanding of historic logging in Renton. The project is a roadway widening of a public road. The proposed roadway improvements would provide four lanes of travel with curbs, gutters, sidewalks, and bike lanes along both sides of the_ road, as well as a closed stormwater drainage system and other necessary features.
