3.RENTONshallcollaboratewiththeCOUNTYtorunanapprovedprocurementprocessforengineeringservicesforthedesignandconstructionoversightofthePROJECT.RENTONshallassumeresponsibilityforensuringthefollowing:a.RENTONshallhireandsubcontractwitharegisteredprofessionalengineer(hereinafterreferredtoasEngineer),subjecttoCOUNTYapproval,toprepareallplansandspecificationsnecessarytopubliclybidthePROJECTforawardtothePRIME,andtohavetheoptiontoprovideconstructionoversight,includingstaking,surveyingandallinspectionsofthePROJECTorhireconstructionmanagementincoordinationwiththeCOUNTYandPRIME.b.Thesub-contractshallrequiretheEngineertomaintaincomprehensivegeneral(includingcontractualliability)andautomobileliabilityinsuranceintheamountofnotlessthan$1,000,000combinedsinglelimitperoccurrence,$2,000,000generalannualaggregateforpersonalinjuryandpropertydamagefortheprotectionoftheCOUNTY,itsofficers,RENTONandemployeesagainstliabilityfordamagesbecauseofpersonalinjury,bodilyinjury,deathordamagetoproperty,includinglossofusethereof,inanywayrelatedtoanyofEngineer’ssubcontractor’sperformanceofthisContract.c.Thesub-contractshaltrequiretheEngineertomaintainprofessionalliabilityinsuranceinanamountofnotlessthan$1,000,000perclaim.SuchinsuranceshallincludelimitedcontractualliabilitycoverageandshallprovideforthirtydayspriorwrittennoticetotheCOUNTYineventofcancellation.TheEngineershaltendeavortousegoodfaithinordertomaintaininforcesuchcoveragefornotlessthanthreeyearsfollowingcompletionofthePROJECT.TheCOUNTY,atitsoption,mayrequireacompletecopyoftheabovepolicyandevidenceofrequiredcoverage.d.Thesub-contractshallrequiretheEngineertoincludetheCOUNTYasanadditionalinsuredandrefertoandsupporttheEngineer’sobligationtoholdharmlesstheCOUNTY,itsofficers,RENTONandemployees.Suchinsuranceshallprovide30dayswrittennoticetotheCOUNTYintheeventofcancellation,non-renewal,ormaterialchangeandincludeastatementthatnoactonthepartoftheinsuredshallaffectthecoverageaffordedtotheCOUNTYunderthisinsurance.TheinsurancecompanywillprovidewrittennoticetotheCOUNTYwithin30daysafteranyreductiononthegeneralannualaggregatelimit.e.Thesub-contractshallrequiretheEngineertofurnishtheCOUNTYevidenceoftheinsurancerequitedin111.5.3(b)and(c)priortotheissuanceofaNoticeToProceed.f.Thesub-contractshallensurethattheEngineer’sresponsibilitiesinclude,butarenotlimitedto,thefollowing:DuringconstructiontheEngineershallendeavortoguardtheCOUNTYagainstapparentdefectsanddeficienciesinthepermanentworkconstructedbyRENTON.ii.AllreportsandrecommendationsconcerningconstructionshallbesubmittedtotheCOUNTYforapproval.TheCOUNTYagreesCftyofRentonPage4of102018ContractAmendment6022484-ExhIII Allresponsivebidswillbereadandtabulatedwiththeapparentlowbidderannounced.Allbidswillbetakenforverificationandresponsivenesspriortonoticeofaward.2.10WithdrawalofBidsAbidmaybewithdrawnpriortobidopeningbysubmittalofaletterofwithdrawaltoRENTON.TheOwnersRepresentativemustmakesure,bydirectquestion,thatitisabidwithdrawalletter.TheOwner’sRepresentativemustthenopentheletter,readit,andstapleittothebidthatistobewithdrawn.Thisbidmustbesetaside,tobereturnedtothebidderunopened.2.11DeterminationofContractorResponsibilityTheOwner’sRepresentativeisresponsibleforcompletingtheresponsibilitydeterminationfortheapparentlowbidder.AsspecifiedinthecontractGeneralConditions,thereisspecificinformationthatmustbeprovidedbythelowbidderwithinafixedperiodoftimeafterbidopeningforRENTONtobeabletomakethisdetermination.IntheeventRENTONdeterminestheapparentlowbidderisnotresponsible,thereisaspecifiedperiodwithinwhichacontractorcanappealthedetermination.Aftertheappealperiod,theprocesswillstartagainwiththenextapparentlowbidder.Anypotentialdeterminationofnon-responsibilitymustbediscussedinadvancewithRENTONAttorney.2.12BidProtestsTheOwner’sRepresentativewillimmediatelyconferwiththeRENTONAttorney,andsuspendcontractaward,ifaprotestisreceivedfromanybidderswithinthespecifiedprotestperiod.3.00CONSTRUCTIONPHASE3.01PreconstructionMeetingTheOwner’sRepresentativeisresponsibleforschedulingapreconstructionmeetingatthenearestappropriatelocationtoprojectsiteatthetimeofexecutionofthecontractwiththesuccessfulprimecontractor(normallypriortotheNoticetoProceed).AttendanceatthismeetingincludestheOwner’sRepresentative,otherRENTONstaff;theEngineer;thecontractor;andHCDProjectManager.Themaindutiesandresponsibilitiesofthepersonsfillingthesepositionsareoutlinedatthismeeting.TheOwner’sRepresentativeshallchairthismeeting,whichwillbebasedonthepreconstructionmeetingagenda.HCDProjectManagershallpresenteachprimecontractorandtheiraccountingand/orpayrollstaffwithdetailedinformationregardingcompliancewithCDBGProgramRegulationsincluding,butnotlimitedto,federallaborstandardsandSection3regulations.PertinentfederalformswillbedistributedatthepreconstructionmeetingpriortotheNoticetoProceedbeingissued.3.02ProgressScheduleandContractBidCostBreakdownAsspecifiedandasrequiredbythecontract,thePRIMEshallprepareaconstructionscheduleandacontractbidcostbreakdown,andsubmitcopiestotheOwner’sRepresentative,HCDProjectManagerandtheEngineer.TheEngineer,withinputfromtheOwner’sRepresentative,HCDProjectManagerandProjectTeam,willreviewandapproveboththescheduleandthebreakdown.ResponsesshallbecompiledbytheEngineerandreturnedtothePRIMEwithcopiestotheProjectTeam.ProjectTeamisresponsibleforreviewingtheprogresscompletionscheduleonamonthlybasisandalertingtheEngineerofanyslipinthePRIME’sperformanceoftheapprovedconstructionschedule.3.03Contractor’sPaymentRequestTheapprovedbidcostbreakdownshallbeusedbythePRIMEinthepreparationoftheregularmonthlypaymentrequestonstandardpaymentrequestforms.ThePRIMEshallsubmitfoursetsofpaymentCityofRentonPage9of162018Contract6022484-ExhIIAUB requests,allwithoriginalsignatures.TheOwner’sRepresentativeandHCDProjectManagerandEngineershallsignthepaymentrequestcertifyingthatthecompletedpercentageofworkisaccurate.ThecertifiedpaymentrequestshallbereviewedthenforwardedtotheFinanceDirectorforapproval,processing,anddistribution.ThePRIMEwillsubmitanupdatedconstructionscheduleaspartofthepaymentrequest.3.04DailyDiaryDuringConstructiontheOwner’sRepresentativeshallkeepseparatedailydiaries.Attheendofeachdayhe/sheshallsignanddatethepagedirectlyunderthelastwrittenlinetopreventpostdateentries.Diariesmayalsobemaintainedelectronically.Ifthediaryismaintainedelectronically,itisadvisedthatattheendofeachdaytheOwner’sRepresentativeprintoutthatday’sentry,andthensignanddatethepagedirectlyunderthelastlineoftexttopreventpostdateentries,andkeepthatsignedpageinafile.Thedailydiaryisextremelyimportantandmustbeproperlykept.3.05RecordDrawingsTheOwner’sRepresentativeandtheEngineershallseethatthecontractormaintains“as-builtdrawings”duringthecourseofconstructionasrequiredbythecontract.ThecontractorwilltransmitrecorddrawingstotheEngineeraspartofthecompletiondocuments.TheEngineerwillcorrecthis/hertracingsatthecompletionofthecontractinaccordancewithhis/herdesignagreement.Thesedrawingsshallshowactualas-builtconditionsincludingchangesofdimensionsorlocationsofitemsfromtheplans.Eachchangeordertothecontractshallbeshownbyreferenceorsketchdrawingonthe“recorddrawings.”Supplementarydrawingsandchangeorderdrawingsshallbecomeapartoftherecordpackage.Everysheetofthecontractdrawingsthatdiffersfromtherecordconditionshallbemarkedtoreflecttheactualconditions,andsheetssochangedshallbenotedonthedrawingtitlesheet.“Recorddrawings”shallbesufficientlyexactanddetailedsothatanyfutureworktothestructureandadjacentareasmayproceedwithaminimumofdifficulty.3.06RENTON-FurnishedItemsTheOwner’sRepresentativeshallberesponsibleforcoordinatingthedeliveryofprojectitemstobefurnishedbyRENTON.3.07TestingAtthebeginningofthecontract,theEngineerwilllistthematerialsandthetypesoftestingrequiredbythecontract.ThePRIMEwillprovideasubmittalforacertifiedtestinglabthatOwner’sRepresentativewillreviewandapprove.PRIMEwillschedulethecertifiedtestingandprovideallresultstotheEngineer.TheEngineerretainstherighttoemployanalternatetestinglabtoconfirmthetestingresults.Completerecordsshallbekeptofallsamplestakenandtestedaswellastheresultsofthetests.Fieldticketsshallbeattachedtoreimbursementforlaboratorypaymentrequestsorinvoicesasaservicessourcedocument.3.08SafetySafetyshallbeaprimeconsiderationineveryoperationonaconstructionproject.ThePRIMEshallhavetheappropriatesafetymeasuresinplaceandprovideaSafetyPlanforOwner’sRepresentativereview.Acleanandsafejobisarequirementofthecontract,andadequatemeansareprovidedinthecontracttoenforcetheseconditions.LiabilityforsafetyshallbesolelytheresponsibilityofthePRIME.3.09FieldInstructionsFieldinstructionsaretheofficialwrittencommunicationbetweentheOwner’sRepresentative/constructioninspectorandthePRIME.CopiesofallfieldinstructionsshallbesenttotheEngineer.Fieldinstructionsmaybeservedoraddressedtothecontractorfor:CityofRentonPage10of762018Contract6022484-ExhIIAUB
