AMENDMENT NO. 1 TO AGREEMENT FOR LEGAL DEFENSE
SERVICES RE RYAN CLAIM FOR DAMAGES (CLAIM NO. CL-19-
006) AND LAWSUIT
THIS AMENDMENT, dated for reference purposes only as June 5, 2019, is by and between the
City of Renton (the "City"), a Washington municipal corporation, and Freimund Jackson &Tardif,
PLLC ("Consultant"), a Washington professional limited liability company. The City and the
Consultant are referred to collectively in this Amendment as the "Parties." Once fully executed
by the Parties, this Amendment is effective as of the last date signed by both parties.
Whereas, the City engaged the services of the Consultant under Agreement CAG-19-042, dated
February 5, 2019,to provide necessary services for legal defense of the City regarding a claim for
damages submitted by Gregory A. and Nereyda Ryan (the "Ryans") (Claim No. 19-006) (referred
to herein as the "Agreement");
Whereas, the Parties wish to amend the Agreement to expand the scope of work to cover
litigation defense services with respect to the lawsuit that the Ryans filed against the City in King
County Superior Court and to change the compensation to cover the expanded scope of work.
NOW THEREFORE, It is mutually agreed upon that CAG-19-042 is amended as follows:
1. Scope of Work: Section 1, Scope of Work, is amended to add the provision of litigation
defense services regarding the lawsuit commenced by the Ryans under King County
Superior Court Cause No. 19-2-07209-1 KNT.
2. Compensation: Section 4, Compensation, is amended so that the maximum amount of
compensation payable to Consultant is increased by $50,000 (Fifty Thousand Dollars),
from a total sum of$10,000 to a total sum of$60,000, plus any applicable state and local
sales taxes. The additional compensation shall be paid based upon Work actually
performed according to the rate(s) or amounts specified in the Agreement.
3. All terms of the Agreement not explicitly modified herein shall remain in full force and
effect and such terms shall apply to Work performed according to this Amendment as if
fully set forth herein.
IN WITNESS WHEREOF, the Parties have voluntarily entered into this Amendment as of the date
last signed by the Parties below.
