HomeMy WebLinkAboutContract • CAQ)-42- l0S AGREEMENT THIS AGREEMENT, made and entered into this /02 T1/ day of NO11 V°W1 D dr , 19 9Z-r by and between the State of Washington, Department of Transportation, acting by and through the Secretary of the Department of Transportation, hereinafter called the "State" and the City of Renton, 200 Mill Avenue South, Renton, Washington, 98055, hereinafter called the "City". project on WHEREAS, the State is currentlyconstructing a p j SR- 405, entitled "S" Curves, which is located within the corporate q; limits of the City, and if WHEREAS, on December 6, 1991 the State and City entered into Agreement GC-9226 for the State to construct at City expense a new g� pedestrian bridge over the Ceder River, and • !II WHEREAS, the City is planning to construct a pedestrian and bicycle path within the controlled access of SR-405 right-of-way to connect to the new Ceder River structure, and WHEREAS, the pedestrian and bike path location is more readily nd it is considered to be in the best accessible to the City a 1 interest for the City to operate and maintain the bike path within it's corporate limits, and NOW, THEREFORE, it is mutually agreed as follows: I The State agrees to grant the City permission to construct the bike path work within State right of way at the location described in Exhibit "A", attached hereto and by this reference made a part of this agreement. GM 1273 06 /07/2019 • II The State shall review and approve the final plans arid specifications for the accomplishment of the above described work. III The City agrees to construct the project as shown on Exhibit "A" at 100 percent City expense and responsibility. afi Should the City choose to perform the work outlined herein $g with other then it's own forces, a representative of the City shall be present at all times unless otherwise agreed to by the tS District Administrator. All contact between the State and City's contractor shall be through the representative of the City. 2 The City, at it's own expense, shall adequately supervise all work on the above described project by itself, it's contractor(s) , subcontractor(s), agent(s), and others, so as to z not endanger or injure any person or property. 95 IV The City shall be responsible for the maintenance and operation of the bike path within the City limits as oatlinad in Exhibit "A". The City's maintenance is defined as general upkeep of the trail, litter control, sweeping, resurfacing, pothole repair, etc. V The State reserves the right to examine and approve or disapprove the City maintenance and operation of the bike path. If any such section should no meet recognized minimum requirements for bike path maintenance, the State shall notify GM 127 3 0 6/ 0 7/ 2 0 1 9 the City in writing, setting a specified period of time in which corrective measures must be taken. If the City fails to comply with the request, the State may bring said section up to the proper standards with it's own forces and bill the City for payment. If payment is not received within ninety (90) days, the amount may be deducted from any monies due or to become due the City from it's allocation of motor vehicles funds. VI No liability shall attach the City or State by reason of =VW 54 51Uenteringinto this agreement except as expressly provided herein.
