HomeMy WebLinkAboutAdden 1 CAG-18-268,Adden#1-19 AMENDMENT NO. 1 TO AGREEMENT FOR POLICE/ATTORNEY 4TH FLOOR TENANT IMPROVEMENT. THIS AMENDMENT, dated July 3, 2019, is by and between the City of Renton (the "City"), a Washington municipal corporation,and Mackenzie Engineering, Inc. ("consultant").The City and the Consultant are referred to collectively in this Amendment as the "Parties." Once fully executed by the Parties,this Amendment is effective as of the last date signed by both parties. Whereas,the City engaged the services of the Consultant under Agreement CAG-18-268, dated December 10, 2018, to provide necessary services for the Police & Attorneys Tenant Improvement(referred to herein as the "Agreement"); Whereas,the Parties wish to amend the Agreement to change the scope of work and change the compensation in order to add requested services NOW THEREFORE, It is mutually agreed upon that CAG-18-268 is amended as follows: 1. Scope of Work:Section 1,Scope of Work, is amended to add work as specified in Exhibit A-1,which is attached and incorporated herein. 2. Time of Performance:Section 3,Time of Performance, is not amended. 3. Compensation: Section 4, Compensation, is amended so that the maximum amount of compensation payable to Consultant is increased by approximately $4,000.00 from $192,000.00 to $196,000.00, plus any applicable state and local sales taxes. The additional compensation shall be paid based upon Work actual performed according to the rate(s)or amounts specified in Exhibit 8-1,which is attached and incorporated herein. 4. All terms of the Agreement not explicitly modified herein shall remain in full force and effect and such terms shall apply to Work performed according to this Amendment as if fully set forth herein. It is agreed that these tasks will be provided as Additional Services in accordance with our original agreement for this project, dated December 10, 2018. Per our recent telephone conversation on April 23,2019,we will perform the tasks outlined below for the subject project. • Scope of Services under this expanded hourly agreement include: o Travel to and from 50% and 100% Document Review Meetings, time for design review meeting held under our original contract. o Prepare additional(third) interior finish palette,as per request at our April 30,2019 meeting. o Review meeting (and travel) to review three (3) interior finish palettes with the City and the Mayor. • As additional expanded services are requested beyond those state above, Mackenzie will advise you on the anticipated level of design effort, fee and schedule. Approval to proceed will be requested prior to implementation. No services are included in this agreement other than those specifically set forth in the Scope of Services. In addition to any Exclusions outlined within the project proposal(if attached), items which are specifically excluded from the Scope of Services include, but are not limited to the following: • Reimbursable expenses. • Special billing requirements required by Client outside of Mackenzie's standard billing procedures. • Building permit fees, design review fees, or any other fees paid to public bodies having jurisdiction over the project. Additional Services Agreement Project Number 2170712.13 April 30, 2019 (Revised May 28, 2019) Page 2 • Meetings with public agencies or other meetings other than those specifically identified in Scope of Services above. • Square footage calculations beyond those required to confirm compliance with building and zoning code requirements. (Calculation of gross, net, and rentable square footages, such as BOMA calculations, are not included.) • Mechanical/electrical/fire protection design or layout and related specifications. • Presentation-level 3D renderings other than conceptual studies to describe design intent or as utilized as part of Mackenzie's design process unless specifically noted within our scope of services above. • Furniture selection,specifications,requirements and all related coordination. • Accessibility compliance design other than that required by Authority Having Jurisdiction (AHJ) as required for Building Permit per the current editions of the Oregon Structural Specialty Code and by reference therein ANSI ICC/A117.1 for new construction.(Since compliance with the Americans with Disabilities Act - Accessibility Guidelines (ADAAG) is not required for Building Permit by AHJ, review, analysis and design for compliance therewith is specifically excluded from basic services. Client may request for expanded accessibility review and compliance design to include that of the ADAAG as an Optional Additional Service. However,there are inherent conflicts and/or discrepancies between the codes required for Building Permit and the ADAAG and design and compliance with all of them may not be possible). • Accessibility compliance design other than that required by Authority Having Jurisdiction (AHJ) as required for Building Permit per the 2015 International Building Code (IBC) with Washington State Amendments (Effective July 1,2016)and the 2015 Seattle Building Code and by reference therein ANSI ICC/A117.1 for new construction. (Since compliance with the Americans with Disabilities Act-Accessibility Guidelines (ADAAG) is not required for Building Permit by AHJ, review, analysis and design for compliance therewith is specifically excluded from basic services.Client may request for expanded accessibility review and compliance design to include that of the ADAAG as an Optional Additional Service. Our fees for the services outlined above will be billed on an hourly basis in accordance with the attached Hourly Billing Rate Schedule and are estimated to be$4,000. It is understood that this estimate is neither a minimum nor a maximum, but simply an estimate of the level of effort we anticipate will be required for the scope of work described.
