That said Grantee shall have the right without prior institution of any suit or proceeding at law,at times as may be necessary,to enter upon said property for the purpose of construction access,fencing,staging, storage and other uses and work as needed for construction of the stormwater project without incurring any legal obligation or liability therefore;provided that such work shall be accomplished using ordinary care to avoid unnecessary disturbance or damage to the property. In the event that there is disturbance or damage,the property will be restored to the same condition as it was before the property was entered upon by the Grantee The Grantee shall obtain a permit from Seattle Public Utilities for construction on the SPU property parcels. This Agreement shall become effective upon execution by the Grantor from date hereof,and shall continue for two(2)years.
