That the said Grantor does by these presents grant unto the Grantee the right to Use the following described property for the purpose of:construction access,fencing,staging,storage and other uses and work as needed for construction of the stormwater project upon the following described property: A portion of Seattle's Cedar River Pipeline right of way,66 feet in width,in Section 18,Township 23 North, Range 5 East,W.M.,in the City of Renton,King County,Washington (Please see Exhibit"A"for complete legal description.) • That said Grantee shall have the right without prior institution of any suit or proceeding at law,at times as may be necessary,to enter upon said property for the purpose of construction access,fencing,staging, storage and other uses and work as needed for construction of the stormwater project without incurring any legal obligation or liability therefore;provided that such work shall be accomplished using ordinary care to avoid unnecessary disturbance or damage to the property. In the event that there is disturbance or damage,the property will be restored to the same condition as it was before the property was entered upon by the Grantee The Grantee shall obtain a permit from Seattle Public Utilities for construction on the SPU property parcels. This Agreement shall become effective upon execution by the Grantor from date hereof,and shall continue for two(2)years.
