HomeMy WebLinkAboutAdden 4 CAG-17-125,Adden#4-19 t AMENDMENT NO. 4 TO AGREEMENT FOR BOARDING FLOAT DESIGN, RENTON BOATHOUSE THIS AMENDMENT,dated '4, 7 ,2019 is by and between the City of Renton(the"City"), a Washington municipal co oration, and PND Engineers, Inc. ("Consultant"), a Washington corporation. The City and the Consultant are referred to collectively in this Amendment as the "Parties." Once fully executed by the Parties, this Amendment is effective as of the last date signed by both parties. Whereas, the City engaged the services of the Consultant under Agreement CAG-17-125, dated June 14, 2017, to provide necessary services for the boarding float design (referred to herein as the "Agreement"); Whereas, the Parties wish to amend the Agreement to modify the scope of work and related com pensation. NOW THEREFORE, It is mutually agreed upon that CAG-17-125 is amended as follows: 1. Scope of Work: Section 1, Scope of Work, is amended to modify the scope of work to reflect the added effort and design modifications related to permit approvals. 2. Compensation: Section 4, Compensation, is amended so that the maximum amount of compensation payable to Consultant is increased by $5,000.00 from $65,644.34 to $70,644.34, plus any applicable state and local sales taxes. The additional compensation shall be paid based upon Work actually performed according to the amounts specified in Exhibit A, which is attached and incorporated herein. 3. All terms of the Agreement not explicitly modified herein shall remain in full force and effect and such terms shall apply to Work performed according to this Amendment as if fully set forth herein. (PND)and the City of Renton (City)signed June 14,2017 for the Cedar River Boathouse Float Reconfiguration final design and permitting support.The project was originally scheduled for submission of 100% drawings near the end of March 2018 per Amendment#01.The schedule was significantly pushed as the permitting process remained at the discretion of the agencies through the balance of 2018 and the first half of 2019, until USACE permits were received on June 28,2019.As a result,supplemental efforts were required to ensure the permitting efforts continued as expeditiously as possible, including regular inquiries and communication with the agencies.The net effect of the lengthened permitting timeline was the project sitting on the shelf at a 90%design level for over a year as we rigorously pursued final permits. This request is for amendment to our contract based on the following items which required and will require additional effort: 1. Additional Permitting Support: Process to receive permits was changed by regulatory agencies. Unanticipated continued effort to provide supplemental documents and answer supplemental questions continued to arise over the course of the permit process. 2. Final Design Package: With the project design nearly complete(90%),the permitting process required the design to be shelved pending receipt of final permits.With over a year passing,the design needs to be fully reviewed for conformance with current standards and best practices. Deliverables—Assumptions: The contract deliverables and assumptions will remain unchanged. Schedule: Following approval of this proposal by the City of Renton, PND agrees to perform the above-described services and to diligently pursue the project and make every reasonable effort to finish all items in a timely manner. The following is a proposed schedule for the project. PND will refine this schedule based on further discussion with the City. General 100%Design Package Friday,August 2nd Fee: The total compensation for the work on this project shall be adjusted with this amendment and shall be completed under the current contract terms. 1 of 2 Base Contract+Amendments 1&2(Hourly, Not-to-Exceed NTE) $65,644.34 Amendment No.3-Time Extension $ - Amendment No.4- Permitting&Final Design(Hourly, NTE) $ 5,000.00 Total Fee $70,644.34 We look forward to performing this work for the City.
