' I WHEREAS, pursuant to Article 3 of the Declaration, prior to termination of the Development Period,the Developer is authorized to subject additional properties to the Declaration; and WHEREAS,the Development Period has not terminated; NOW, THEREFORE, pursuant to Article 3 and Section 16.1 of the Declaration, Developer hereby amends the Declaration as follows: 1. The Plat of Windstone Division 5, recorded with the King County Recorder under Recording No. a01306.k(000-490 ("Division 5"), is hereby subjected to the Declaration. The land within Division 5 is shown on the Map for Division 5 and is legally described on Exhibit A attached hereto. 2. In addition to the Tracts, easements and other areas set forth in Section 1.5 of the Declaration, the Common Area shall include Tracts A, B and C as shown on the Division 5 Plat Map and other the easements and appurtenances (if any) located within Division 5 as shown on the Windstone Division 5 Plat Map that are intended for common use and enjoyment. The City of Renton shall have access to the easement areas as necessary to inspect or maintain the drainage facilities and appurtenances thereon. 3. Pursuant to the Declaration of Easement, recorded under King County Recording No. 20060926001123 (the "2006 Easement"), upon recording this Ninth Amendment, the Storm Drainage Easement Area created by the 2006 Easement shall be deemed a Common Area and the Association shall have all maintenance, repair and reconstruction obligations set forth in the Declaration for the storm water drainage system benefiting Division 5. 4. The Lot Owners of Lots within Division 5 shall be Members of the Association and shall be entitled to all benefits and subject to all obligations of Members of the Association. 5. Unless otherwise stated herein, all capitalized terms used in this Ninth Amendment shall have the meanings set forth in the Declaration. Any references to "Div. V" in the Declaration shall be deemed to refer to Division 5. 6. Except for the matters stated in this Ninth Amendment, all of the provisions contained in the Declaration remain in full force and effect. This Amendment shall be effective upon recording.
