covenants running with the land as to use,present and future,of the described real
property.

NOW,THEREFORE,the Owner hereby establishes,grants and imposes restrictions and
covenants running with the land hereto attached described with respect to the use by the
undersigned his successors,heirs,and assigns as follows:
1.The use of extra rigid foundations supporting a flexible superstructure shall be
incorporated into the general design of any proposed structures.
2. A small,square or a nearly square-shaped building pad shall be utilized as opposed to a
large,irregularly shaped building pad.
3.Consideration in design of the superstructure shall include the ability to relevel the
• building and any gravity-dependent utilities.
4. Utility couplings shall be flexible enough to anticipate some post-construction ground
movement.
5.A qualified geotechnical engineer shall be present when site preparation is initiated so
the appropriate corrective actions can be recommended if any mining related fea ar
encountered. /
