Nos. 4525 and 4526. WHEREAS, Renton School District # 403, are the owners of the following real property in the City of Renton, County of King, State of Washington: Tracts 14 and 15, Black Loam Five Acre Tracts, according to the plat thereof, recorded in Volume 12 of Plats, page 101, in King County, Washington. WHEREAS, the owner(s) of said described property desire to impose the following restrictive covenants running with the land as a condition placed on the title of the remaining undeveloped property regarding the 11.4 requirement, obligation and promise to pay the Sanitary Sewer System Development Charge when that If) portion of the property is developed. The Sanitary Sewer System Development Charge shall be at the rates 0 in effect at the time a formal application is submitted which would invoke the charge. rwiD NOW, THEREFORE, the aforesaid owner(s) hereby establish, grant and impose restrictions and covenants running with the land hereinabove described with respect to the substantial open space area described as follows: EXEMPTED PUBLIC USE AREA (Undeveloped Property is Designated as Parcel "2") The east 180 feet, and the south 150 feet, of Tracts 14 and 15, Black Loam Five Acre Tracts, according to the plat thereof, recorded in Volume 12 of Plats, page 101, in King County, Washington. Contains an area of 176,067.60 square feet or 4.04 acre M/L. The owner(s) of the above described property, their successors, heirs and assigns, hereby agree and covenant to pay the Sanitary Sewer System Development Charge, at the rate in effect at the time of formal application for the above described Parcel 2. ti DURATION LD These covenants shall run with the land and shall not expire.
