Said percentage representing the portion of the property in the process of being developed; and WHEREAS, the owners of said property desire to impose the following restrictive covenants running with the land as a condition placed on the title of the remaining undeveloped property regarding the requirement, obligation, and promise to pay the SDC fees when that portion to the property is developed. The SDC fees shall be payable at the rates in effect at the time a formal application is submitted which would invoke the SDC fees.
