This Memorandum of Understanding (MOU)represents a mutual understanding between the City of Renton("the City") and King County("the County") for the purpose of allowing the City to use and access fiber from the County-owned fiber optic cable located along 140th Avenue/Way SE from SR169 to SE Petrovitsky Road and for the purpose of clarifying the ownership and access of the fiber on SE Petrovitsky Road between SR 167 and East Renton City limits at about 134th Avenue SE. 2. Through recently approved annexations,the City has acquired a traffic signal at 140th Way SE and SE 158th Street from the County and will be acquiring a number of additional traffic signals from the State located along State Route 169. 3. The County understands that the City has a long term goal to interconnect and have central control of the traffic signals along the SR169 corridor from I-405 to 154th Place SE. The County further understands that when the Fairwood area is annexed, the City intends to centrally control and synchronize the signals along the 140th Way/140th Avenue SE corridor that it will acquire in the annexation process. 4. In the first step of the City's long term plan, the City has a project to interconnect the signal at SR169 andl40th Way SE and the signal at SR169 andl3lst Avenue SE. As part of this project,the County understands that the City will need the following: a. Joint access with King County to the six (6) fibers (identified on Attachment A) on 140th Way SE that connects the signal at SE 158th Street to the splice cabinet at 140th Avenue SE and SE Petrovitsky Road to allow the City to connect the SE 158th Street signal back to the Renton TMC; b. A patch in the splice cabinet to connect the six(6) fibers on 140th Way SE to the City's Trans-Valley fibers running along SE Petrovitsky Road to the City's Traffic Management Center(TMC); c. Access to six(6)additional fibers in the 48-count fiber optic cable on 140th Ave/Way SE between Petrovitsky Road and SR 169; d. Terminate the six(6) additional fibers in the splice cabinet at 140th Avenue SE and SE Petrovitsky Road as necessary; e. Perform a mid-sheath splice in the 48-count fiber on 140th Way SE at SR 169 in the hand hole adjacent to the signal control cabinet on the north side of the highway in order to connect the six(6)fibers to a new facility to be installed to that hand hole; and f. Access into the splice cabinet at SE Petrovitsky Road and 140th Ave/Way SE to install a new fiber optic cable into and terminate six (6) fibers in the splice cabinet and to patch these fiber cables to the 6 fibers in the 48 count cable on 140th Ave/Way. 5. The City understands that it is responsible for all costs related to the City project and in accomplishing the City's long term plan and that the County has no financial responsibilities with regards to the City project(s) described in this MOU. All necessary permits will be obtained by the City at the City's cost. 6. The City further understands that the County will retain ownership of twelve strands of fiber along 140thAve/Way SE, including the section of 140th Way SE that has been recently annexed by the City,just as the County retains ownership of twelve strands of fiber along Petrovitsky Road per the Trans-Valley ITS agreement for TSC Channel 4 and the Spare King County fiber per Attachment A of this MOU. When the Fairwood area that includes 140th Ave/Way is annexed into the City,the County will retain ownership of twelve out of forty-eight strands of fiber along 140th Ave/Way. 7. The County understands that the 12 strands of fiber it owns along Petrovitsky Road between the east City limits at about 134th Avenue SE and the fiber optic communication cabinet at SR 167 is now in the City as a result of the Benson Hill approved annexation. This fiber was installed by the County as part of the County's Trans-Valley ITS project. a. The City understands that the County currently utilizes this fiber for communication between County signals and cameras along Petrovitsky Road and 140th Ave/Way SE and King County Traffic Control Center (KCTCC) in downtown Seattle. b. The City understands that the County must maintain communication between the County equipment and the KCTCC. c. The City understands that the County requires access to fiber optic cable through the City to maintain communication with existing and future County signals and ITS equipment similarly to the City requiring access to fiber optic cable located in unincorporated King County for the City's purposes. 8. It is further understood that the City and the County intend to negotiate a fiber maintenance agreement("Agreement")to enable both parties to make the most efficient use of the fiber optic cable and to outline the long term responsibilities of each party.
