HomeMy WebLinkAboutContract Noe CAG-04-124 CITY OF RENTON COMMUNITY SERVICES DEPARTMENT CONTRACT AGREEMENT THIS AGREEMENT is made as of the--4t a/.-W- �P cr RENTON, a municipal co day of ,2004, between the CITY OF p corporation of the State of Washington, hereinafter referred to as"CITY,"and Edlund Associates, Inc., hereinafter referred to as"CONTRACTOR,"to renovate the baseball infield at Philip Arnold Park by removing the infield silt,installing an irrigation system (including a new main line and new wires for irrigation clock),and hauling and releveling the infield silt. The City and Contractor agree as set forth below. I. Scope of Services. The Contractor will provide all material and labor necessary to perform all work described in the Proposal which is included with this Agreement as Attachment"A." 2. Changes in Scope of Services The City,without invalidating the Contract, may order changes in the Services consisting of additions, deletions or modifications,the Contract Sum being adjusted accordingly. Such changes in the work shall be authorized by written Change Order signed by the City and the Contractor. 3. Time of Performance. The Contractor shall commence performance of the Contract no later than ten (10)calendar days after Contract's final execution, and shall complete the full performance of the Contract not later than sixty(60)days calendar days from the date of commencement. 4. Term Of Contract.The Term of this Agreement shall end at completion of the enclosed scope of work. This Agreement may be extended to accomplish change orders, if required, upon mutual written agreement of the City and the Contractor. 5. Contract Sum. The total amount of this Contract is the sum of $42,679.00,which includes Washington State Sales Tax. 6. Method of Payment Payment by the City for the Services will only be made after the Services have been performed and a voucher or invoice is submitted in the form specified by the City. Payment will be made thirty(30)days after receipt of such voucher or invoice. The City shall have the right to withhold payment to the Contractor for any work not completed in a satisfactory manner until such time as the Contractor modifies such work so that the same is satisfactory. 7. Warranty. The Contractor shall be under the duty to remedy any defects in the work and pay for any damage to other work resulting therefrom which shall appear within the period of one(1)year from the date of final acceptance of the work, unless a longer period is specified. 8. Assignment and Subcontract The Contractor shall not assign or subcontract any portion of this " Contract without express written consent of the City of Renton. 2004-132aa t. 9. Record Keeping and Reporting The Contractor shall maintain accounts and records,which properly reflect all direct and indirect costs expended and services provided in the performance of this Agreement. The Contractor agrees to provide access to any records required by the City. 10. Hold Harmless. The Contractor shall indemnify,defend and hold harmless the City, its officers, agents,employees and volunteers,from and against any and all claims, losses or liability, or any portion thereof, including attorneys fees and costs, arising from injury or death to persons, including injuries, sickness,disease or death to Contractor's own employees, or damage to property occasioned by a negligent act,omission or failure of the Contractor. 11. Insurance. The Contractor shall secure and maintain in force throughout the duration of this contract Commercial General Liability insurance. A Certificate of Insurance evidencing the contractor's insurance coverage shall be delivered to the City before executing the Work of this Agreement. 12. Compliance with Laws The Contractor and all of the Contractor's employees shall perform the services in accordance with all applicable federal,state,county and city laws,codes and ordinances. 13. Conflicts. In the event of any inconsistencies between contractor proposals and this contract, the City of Renton contract shall prevail. 14. Prevailing Wage Rates By executing this Contact, the Contractor agrees to comply with the State prevailing wage requirements as set forth in the Contract Documents. Work will start August 23,04 Infield Soil and Preparation: Before starting the project, wrap grates on all catch basins within 20 feet of the work area with filter fabric. Leave following area undisturbed: a four-foot section parallel with the sideline fences. This four-foot soil section should be graded 1 inch below concrete strip under sideline fence. Contractor is responsible for this grade;the home plate,pitchers rubber and base elevations will remain the same. Contractor is responsible to provide a finished infield grade that will slope from pitcher's area to infield edge/grass not less.5%to not greater than 1%.An 8-foot circle of existing infield mix will rem around the pitching area and the home plate area. am Remove infield material to a depth of 8 inches. Remove soil ridge behind home plate to backstop. Roto-till/plow the infield to a minimum depth of 12 inches in two directions,thoroughly mixing the sub base. Irrigation Layout: The owner will lay out the head locations on paper but the contractor is to design and install irrigation system. Existing system has approximately 90 lbs of pressure on the mainline. Owner will provide diagram of existing.system. The system shall be zoned so that the full heads will be on a separate zone and the half heads in the edge of the outfield grass and heads on half heads on the infield dirt shall be on separate zone or zones. The equipment to be used is listed below. No substation of equipment will be allowed. All valve boxes shall be off the field behind the first base line fenoe; except the quick coupler located approximately 70 feet from home plate, in line with the pitching rubber and home plate. A quick coupler exists behind the pitchers mound,this needs to be straightened up. All heads located in the infield grass shall be approximately Moot in the grass.
