HomeMy WebLinkAboutORD 5708CITY OF RENTON, WASHINGTON ORDINANCE NO. 5708 AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, ACCEPTING THE GIFT AND DEVISE OF CERTAIN REAL PROPERTY IN THE LAST WILL AND TESTAMENT OF ARTHUR R. KENYON, DECEASED, UPON THE CONDITIONS STATED THEREIN. WHEREAS, under RCW 35A.79.010, a code city shall have all powers provided by general law to cities of any class relating to the receipt of donations of money and property, both real and personal, including, but not limited to the acquisition or disposition of municipal property and its use and management; and WHEREAS, pursuant to RCW 35.21.100 every city and town by ordinance has the authority to accept any money or property donated, devised or bequeathed to it and to carry out the terms of the donation, devise, or bequest, if within the powers granted by law; and WHEREAS, Arthur R. Kenyon, deceased, in his Last Will and Testament executed on July 25, 2007, devised, gave and bequeathed to the City of Renton his home and real property commonly located at 3447 Lincoln Drive NE, Renton, WA 98056, King County Parcel Nos. 334510-0054 and 334510-0052, for use as a park to be called "Kenyon-Dobson Park," on the conditions that the trees located thereon be left standing and the park be minimally developed, and that Karen Dobson be permitted to live in his house expense free for five (5) years after the date of his death; and WHEREAS, Arthur R. Kenyon died on December 11, 2008, and his Last Will and Testament was admitted to probate in King County Superior Court, Cause No. 09-4-03961-2 KNT; and more than five (5) years have elapsed since his death and the estate for years granted 1 ORDINANCE NO. 5708 by Arthur R. Kenyon, deceased, to Karen Dobson has expired by the terms of his Last Will and Testament; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DOES ORDAIN AS FOLLOWS: SECTION I. The City of Renton accepts the devise, gift and bequest of real property and the house situated thereon, commonly located at 3447 Lincoln Drive NE, Renton, WA 98056, King County Parcel Nos. 334510-0054 and 334510-0052, for use as a park to be called "Kenyon-Dobson Park" and all other express terms and conditions of the Last Will and Testament of Arthur R. Kenyon as filed in probate in King County Superior Court, Cause No. 09- 4-03961-2 KNT. SECTION II. This ordinance shall be effective upon its passage, approval, and five (5) days after publication.
