RELEASE AND HOLD HARMLESS
For and in consideration of the donation by the City of Renton Wellness Committee
(hereinafter"Donor") of certain equipment(hereinafter"Donated Equipment")to the
Renton School District(hereinafter"Recipient"):
1) Recipient agrees to RELEASE the city of Renton, its employees or agents, and the
Renton Employees Wellness Committee and its agents from any and all claims of any
sort or kind,whether now known or contemplated or later discovered, that may be
brought against the city of Renton, its employees or agents, and the Renton Employees
Wellness Committee or its agents as a result of or in any way related to the use of the
Donated Equipment.
2)By way of further consideration,Recipient agrees to HOLD HARMLESS,
INDEMNIFY,AND DEFEND the city of Renton, its employees or agents, and the
Renton Employees Wellness Committee and its agents from any and all claims of any
sort or kind, including any claims brought by THIRD PARTIES, including all costs,
judgments,and attorneys fees,whether now known or contemplated, or later discovered,
that may be brought against the city of Renton, its employees or agents, and the Renton
Employees Wellness Committee or its agents as a result of or in any way related to the
use of the Donated Equipment.
3)Recipient hereby acknowledges that Donor has, by separate correspondence, signed
contemporaneously herewith, disclaimed any warranties for fitness for any intended
purpose or use. Further, Recipient acknowledges that it will rely on its own inspection of
the Donated Equipment to ascertain the condition of said equipment for the Recipient's
intended use.
