HomeMy WebLinkAboutORD 5639CITY OF RENTON, WASHINGTON ORDINANCE NO. 5639 AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, AMENDING SECTION 4-1-110 OF CHAPTER 1, ADMINISTRATION AND ENFORCEMENT, SECTIONS 4-2- 060 AND 4-2-080 OF CHAPTER 2, ZONING DISTRICTS - USES AND STANDARDS AND SECTIONS 4-11-190, 4-11-220 AND 4-11-230 OF CHAPTER 11, DEFINITIONS, OF TITLE IV (DEVELOPMENT REGULATIONS) OF ORDINANCE NO. 4260 ENTITLED "CODE OF GENERAL ORDINANCES OF THE CITY OF RENTON, WASHINGTON", BY AMENDING THE REGULATIONS REGARDING VEHICLE SALES AND REPAIR AND THE DEFINITIONS OF "STORAGE, VEHICLE", "VEHICLE SERVICE AND REPAIR" AND "WRECKING YARD, AUTO". THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DOES ORDAIN AS FOLLOWS: SECTION I. Subsection 4-1-110C, Initiation of Proceedings Against Violation, of Chapter 1, Administration and Enforcement, of Title IV (Development Regulations) of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton, Washington", is hereby amended to add a new subsection 4-1-110C.3, to read as follows: 3. Regarding requests to inspect or review active repair invoices, City code compliance officers may enter an area that is open to the public and request to see the active repair invoice or invoices for vehicles that are being stored or that are present on or at a vehicle service and repair facility. If the request is refused, the vehicle service and repair facility shall have forty-eight (48) hours from the time that the request was made to take the active repair invoice or invoices, and any other necessary documents or information, to City Hall, to the appropriate code compliance or City official, for inspection or review. 1 ORDINANCE NO. 5639 If the vehicle service and repair facility fails to comply with the request to inspect or review the active repair invoice or invoices, there is a presumption that the vehicle or vehicles are being stored. SECTION II. The rows labeled "Body Shops" and "Vehicle Service and Repair, Small" of subsection 4-2-060L, Vehicle Related Activities, of Chapter 2, Zoning Districts - Uses and Standards, of Title IV (Development Regulations) of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton, Washington", are hereby amended as shown below. All other subsections shall remain as currently codified. Subsection 4-2-080A.2 of subsection 4-2-080A, Subject to the Following Conditions, of Chapter 2, Zoning Districts - Uses and Standards, of Title IV (Development Regulations) of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton, Washington", is hereby amended as follows: 2. In addition to the criteria of RMC 4 9 030, Conditional Use Permits, the use must bo sited in conjunction with a gas station. Size restrictions apply per use in RMC 4 2 120A. In the CN Zone, the use is limited to operations enclosed within a building, and sited in conjunction with an existing gas station All 2 ORDINANCE NO. 5639 operations shall be conducted entirely within an enclosed structure. In the CN or CV zone, this use must be associated with a gas station. Vehicles shall only be held on the property while being serviced and shall have an active repair or service invoice that shall be made available to the City upon the City's request- Vehicle storage before or after service shall not be allowed. Vehicles held on the site shall be subject to the screening and landscaping provisions in RMC 4-4-120 Storage-Outside, unless enclosed within a building. Vehicle holding areas shall count toward the maximum lot coverage standard of the zone. Any overnight vehicle parking accessory to this use shall not be located in the front setback or in a side setback along a street. SECTION IV. The definition of "Storage, Vehicle" in section 4-11-190, Definitions S, of Chapter 11, Definitions, of Title IV (Development Regulations) of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton, Washington", is hereby amended as follows: STORAGE, VEHICLE: An indoor or outdoor area for parking or holding of motor vehicles and boats or wheeled equipment for more than seventy two (72) hours. This definition excludes vehicle sales, vehicle rental, body shops, tow truck operation/auto impoundment yard, auto wrecking yard, outdoor storage, and indoor storage. SECTION V. The definition of "Vehicle Service and Repair" in section 4-11-220, Definitions V, of Chapter 11, Definitions, of Title IV (Development Regulations) of Ordinance No. 3 ORDINANCE NO. 5639 4260 entitled "Code of General Ordinances of the City of Renton, Washington", is hereby amended as follows: VEHICLE SERVICE AND REPAIR: Maintenance of motorized vehicles including exchange of parts, installation of lubricants, tires, batteries, and similar vehicle accessories, minor customizing and detail operations, and body shops, but excluding operations associated with body shops, and industrial engine or transmission rebuild operations. SECTION VI. The definition of "Wrecking Yard, Auto" in section 4-11-230, Definitions W, of Chapter 11, Definitions, of Title IV (Development Regulations) of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton, Washington", is hereby amended as follows: WRECKING YARD, AUTO: A facility for the dismantling or wrecking of used motor vehicles or trailers, or the storage, sale, or dumping of dismantled or wrecked vehicles or their parts, including the repair of wrecked vehicles, consistent with RCW 46.80.
