HomeMy WebLinkAboutORD 5438CITY OF RENTON,WASHINGTON ORDINANCE NO.5438 AN ORDINANCE OF THE CITY OF RENTON,WASHINGTON, CHANGING THE ZONING CLASSIFICATION OF CERTAIN PROPERTIES (FORMERLY THE BENSON HILL COMMUNITIES SE 16S th STREET AREA REZONE)WITHIN THE CITY OF RENTON FROM RESIDENTIAL EIGHT DWELLING UNITS PER ACRE (R-S)TO COMMERCIAL ARTERIAL (CA). WHEREAS,under Section 4-2-020 of Chapter 2,Zoning Districts -Uses and Standards, of Title IV (Development Regulations)of Ordinance No.4260 entitled "Code of General Ordinances of the City of Renton,Washington,"as amended,and the maps and reports adopted in conjunction therewith,the three properties herein below described were incorrectly zoned Residential-8 (R-8)as part of the Benson Hill annexation process and are to be rezoned Commercial Arterial (CA);and WHEREAS,these properties were designated and zoned as commercial properties in King County prior to annexation and each property has a commercial building with commercial uses;and WHEREAS,the City initiated a Comprehensive Plan Amendment to redesignate the land use for the properties from Residential Single Family to Commercial Corridor and concurrently rezone the properties from Residential-8 (R-8)to Commercial Arterial (CA);and WHEREAS,this matter was duly referred to the Planning Commission for investigation, study,and public hearing,and a public hearing having been held thereon on September 24,2008, and this matter having been duly considered by the Planning Commission,and the zoning request being in conformity with the City'S Comprehensive Plan,as amended,and the City Council having duly considered all matters relevant thereto,and all parties having been he.ard appearing in support or in opposition to the proposed zoning; 1 ORDINANCE NO.5438 NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON,DOES ORDAIN AS FOLLOWS: SECTION I.The following described property in the City of Renton is hereby zoned to CA.The annual ordinance adopting the maps of the City's Zoning Ordinance is hereby amended to show the rezoning and the Department of Community &Economic Development Administrator is hereby authorized and directed to change the maps of the Zoning Ordinance,as amended,to evidence the rezoning,to wit: See Exhibits "A"and "B"attached hereto and made a part hereof as if fully set forth herein.(Cascade Area in Benson Hill Annexation.) SECTION II.This Ordinance shall be effective upon its passage,approval,and five (5)days after its publication. PASSED BY THE CITY COUNCIL this 8th day of December ,2008.
