THE CITY COUNCIL OF THE CITY OF RENTON,WASHINGTON,DOES ORDAIN AS FOLLOWS: SECTIONL Section 1006-8 of Chapter 6,Code of Ethics,of Title I (Administrative)of Ordinance No.4260 entitled "Code of General Ordinances ofthe City of Renton,Washington"is hereby repealed. SECTIONIL Section 4-4-080.1.6 of Chapter 4,City-Wide Property Development Standards,of Title IV (Development Regulations)of Ordinance No.4260 entitled "Code of General Ordinances ofthe City ofRenton,Washington"is hereby amended to read as follows: 6.Driveway Grades -Maximum Based Upon Land Use: a.Single Family and Two (2)Family Uses:Maximum driveway slopes shall not exceed fifteen percent (15%),provided that driveways exceeding eight percent (8%)shall provide slotted drains at the lower end with positive drainage discharge to restrict runoff from entering the garage/residence or crossing any public sidewalk.To exceed fifteen percent (15%), a variance from the PlanninglBuilding/Public Works Administrator or hislher designee is required. 1 ORDINANCE NO.5157 b.All Other Uses:Maximum driveway slope shall not exceed eight percent (8%).The PlanninglBuilding/Public Works Administrator or hislher designee may allow a driveway to exceed eight percent (8%)slope but not more than fifteen percent (15%)slope,upon proper application in writing and for good cause shown,which shall include,but not be limited to,the absence of any reasonable alternative.To exceed fifteen percent (15%),a variance from the Administrator is required. SECTION m Section 4-4-100.S of Chapter 4,City-Wide Property Development Standards,of Title IV (Development Regulations)of Ordinance No.4260 entitled "Code of General Ordinances ofthe City ofRenton,Washington"is hereby amended to read as follows: S.VARIANCES: Applications for variances from the provisions ofthis Chapter shall be heard by the PlanninglBuildinglPublic Works Administrator or hislher designee as provided in RMC 4-1- 050.0 and consistent with the provisions ofRMC 4-9-250.B. SECTION IV.Section 4-5-050.D.4 of Chapter 5,Building and Fire Prevention Standards,of Title IV (Development Regulations)of Ordinance No.4260 entitled "Code of General Ordinances ofthe City ofRenton,Washington"is hereby amended to read as follows: 4.Appeals Board:The Appeals Board for purposes of section 112 of the International Building Code shall be the PlanningfBuildinglPublic Works Administrator or his/her designee. SECTION V.Section 4-5-055.0.3 of Chapter 5,Building and Fire Prevention Standards,of Title IV (Development Regulations)of Ordinance No.4260 entitled "Code of General Ordinances ofthe City ofRenton,Washington"is hereby amended to read as follows: 2 ORDINANCE NO.5157 3.Appeals Board:The Appeals Board for purposes of Section R112.1 ofthe International Residential Code shall hereafter be the PlanninglBuildinglPublic Works Administrator or his/her designee. SECTION VIll.Section 4-8-070.C of Chapter 8,Permits -General and Appeals,of Title IV (Development Regulations)of Ordinance No.4260 entitled "Code of General Ordinances ofthe City ofRenton,Washington"is hereby amended to read as follows: C.PLANNINGIBUILDINGIPUBLIC WORKS ADMINISTRATOR OR DESIGNEE: Authority:The PlanningIBuildinglPublic Works Administrator or his/her designee shall review and act on the following: 1.Appeals of administrative decisions/determinations regarding requests for modification of storm drainage regulations; 3 ORDINANCE NO.5157 2.Appeals relating to Uniform Building Code Sections:Section 105,Section 110, and Section 1.18 -Alternative Materials; 3.Building and grading permits; 4.Conditional approval permits for nonconforming structures; 5.Conditional use permit,administrative; 6.Critical area regulation alternates and modifications; 7 Critical areas regulation administrative determinations per RMC 4-3-050.D.4; 8.Interpretation of flood insurance rate map boundaries; 9.Lot line adjustments; 10.Modifications: (a)Minor modifications to previously approved site plan; (b)Modifications of storm drainage requirements; (c)Modification ofgeologic hazard regulations for man-made slopes; (d)Modifications/waivers of sewer code requirements; (e)Modifications ofthe number ofrequired parking stalls and the requirements ofthe parking,loading and driveway regulations;and (t)Modifications to development standards in the Center Village Residential Bonus District and the Urban Design Regulation Overlay District; 11.Public art exemption certificate; 12.Review ofbusiness licenses for home occupations; 13.Revocable permits for the temporary use of public right-of-way; 14.Routine vegetation management permits; 4 ORDINANCE NO.5157 IS.Sewer modifications,alternates,and appeals pursuant to RMC 4-9-250.D and E and 4-8-11O.D,respectively; 16.Shoreline exemptions; 17.Shoreline permits; 18.Short plats -four (4)or less; 19.Site plan approval,administrative; 20.Master Plan review (individual phases); 21.Temporary emergency wetland permits; 22.Temporary use permits; 23.Variances: (a)Administrative pursuant to RMC 4-9-250.B.l.c; (b)Variances not associated with a development permit that requires review by the Hearing Examiner,provided the variance authority is not specifically given to another authority elsewhere in this Chapter,and any building permits submitted in conjunction with such variance application;and (c)Variances from chapter 8-7 RMC,Noise Level Regulations;and 24.Waivers: (a)Waivers of right-of-way dedication for plat; (b)On-and off-site improvements (including deferrals);and (c)Allowing a commercial or multi-family residential driveway grade of between eight percent (8%)and fifteen percent (15%). 5 ORDINANCE NO.5157 SECTION IX.Sections 4-8-070.D and F of Chapter 8,Permits -General and Appeals,ofTitle IV (Development Regulations)of Ordinance No.4260 entitled "Code of General Ordinances ofthe City ofRenton,Washington"are hereby repealed. §ECTION X.The Table entitled "Type IV -Land Use Permits Board of Adjustment"in Section 4-8-080.H of Chapter 8,Permits -General and Appeals,ofTitle IV (Development Regulations)of Ordinance No.4260 entitled "Code of General Ordinances ofthe City ofRenton,Washington"is hereby repealed. SECTION XI.Section 4-8-IIO.A of Chapter 8,Permits -General and Appeals,of Title IV (Development Regulations)of Ordinance No.4260 entitled "Code of General Ordinances ofthe City ofRenton,Washington"is hereby amended to read as follows: A.SCOPE AND PURPOSE: This Section provides the basic procedures for processing all types of land use and development-related appeals.Specific requirements are based upon the type/level of appeal and the appeal authority.Procedures for the following types of appeals are included in this Section: I.Appeals of administrative decisions to the Planning/BuildingfPublic Works Administrator or his/her designee; 2.Appeals to Hearing Examiner of administrative decisions and environmental determinations; 3.Appeals to City Council; 4.Appeals to Superior Court;and 5.Appeals to the State Shorelines Hearings Board. 6 ORDINANCE NO.5157 SECTION xu.Section 4-8-120.D.22 of Chapter 8,Permits -General and Appeals,of Title N (Development Regulations)of Ordinance No.4260 entitled "Code of General Ordinances ofthe City of Renton,Washington"is hereby amended to read as follows: 22.Definitions V: Variance Justification:A written statement setting forth the reasons in favor ofthe application and addressing the criteria listed in RMC 4-9-250.B.5 which are used by the Hearing Examiner or PlanningfBuildinglPublic Works Administrator or his/her designee when reviewing the variance request. SECTION XIll.Section 4-9-250.Rl.b of Title N (Development Regulations)of Ordinance No.4260 entitled "Code ofGeneral Ordinances ofthe City ofRenton,Washington"is hereby repealed. SECTION XIV.Section 4-9-250 R13 of Chapter 9,Permits -Specific,of Title N (Development Regulations)of Ordinance No.4260 entitled "Code of General Ordinances ofthe City ofRenton,Washington"is hereby amended to read as follows: 13.Decision Process: a.The PlanninglBuildinglPublic Works Administrator or his/her designee Shall Announce Findings and Decisions:Not more than thirty (30)days after the termination of the proceedings ofthe public hearing on any variance,the PlanninglBuildinglPublic Works Administrator or his/her designee shall announce the Administrator's fmdings and decision.If a variance is granted,the record shall show such conditions and limitations in writing as the Administrator may impose. b.Notice ofDecision ofthe PlanningfBuildinglPublicWorks Administrator or his/her designee:Following the rendering of a decision on a variance application,a copy of 7 ORDINANCE NO.51 57 the written order by the Administrator shall be mailed to the applicant at the address shown on the application and filed with the PlanningfBuildinglPublic Works Department and to any other person who requests a copy thereof c.Reconsideration:(Reserved) d.Record ofDecision:Whenever a variance is approved by the PlanningfBuildinglPublic Work&Administrator or his/her designee,the Building Department shall forthwith make an appropriate record and shall inform the administrative department having jurisdiction over the matter. SECTION xv. 30 days after publication.
