The property you have proposed for annexation into the City of Renton has been included in the City of Newport Hills. We did not receive the annexation petition in time to present the petition to our City Council prior to the election process. Thus, the City Council had not formally accepted your petition for annexation at the time that the property in .question was included in the new City of Newport Hills. The question of whether we could legally proceed with your petition at this time was presented to the City Attorney. He has recommended that we can not proceed with an annexation of your property. Since the incorporation of the new city was successful, he feels that the City of Renton is precluded from annexing any of the territory included in the new city's boundaries. A copy of his memo is attached. If it is possible to have your property removed from the legal description of the City of Newport Hills, we would be willing to reconsider your petition to annex into the City of Renton. I would note that my staff has indicated that there will be Significant problems in trying to develop the properties in this area due to the landslide potential. Although this is not a reason to deny an annexation petition, it is an issue that will need to be addressed by any future development proposed for this area. Warren, City Attorney Staff Contact:;> Mark Pywell, Senior Planner Date: November 11, 1993 Subject: Van Valin Annexation I have not tried to do any legal research to determine whether or not the City can proceed with the proposed Van Valin annexation in light of the incorporation of the City of Newport Hills. The Van Valin property was included within the legal description of the. property that will soon be the City of Newport Hills. If the City of Renton proceeded with this annexation, then the Boundary. Review Board would have to resolve the matter. Since the Boundary Review Board has already approved the inclusion of this property within the boundaries of the City of Newport Hills for the election, this issue appears to have been foreclosed .. If the City wished to proceed with the Van Valin annexation it should have done so or, alternatively, protested the inclusion of this property within . the potential City boundaries of the City of Newport Hills. I think the City is foreclosed from pursing this annexation. Even if it is not, it is probably not prudent to pursue this annexation as it likely will result in a legal battle. Land use designations: Parcels 1,2 and 3 were designated to annex as Single Family, parcel 4 as Community Center. 3. Critical and resource areas: Site is mapped as forest wildlife habitat, landslide hazard area, and partially as erosion hazard area. 4. Environmental impacts: NA. 5. Policy considerations: The proposal does not conflict with City policies. 6. Conclusion: Should the incorporation fail for any reason, we. support this annexation. '. Pywell Planning/Building Department Re: Lin/Van Valin/Yuen Annexation Request Dear Mr. pywell: Attached and enclosed are the Master Applications and other documents requested in connection with the request for the annexation into the City of Renton of King County Assessor's Tax Parcel Nos. 334330-0740; 0741; 0742; 0842 plus adj acent public right of ways. The documents refer to this annexation request as the "Lin/VanValin/Yuen Annexation." The proposed annexation covers 5.31 acres located just northerly of what is now S.E. 76th St. near to and easterly of the intersection of said street and Lake Washington Boulevard N.E. The property to be annexed is rectangular in shape and bordered on two sides by the current Renton city limits. One of the parcels included in the area to be annexed, namely, the .5 acre parcel owned by Huson/Hoof, has a single family dwelling located on it. The remaining parcels are unimproved and are currently a jumble of brush and small alders. The property has a modest east-west slope. There are no development proposals outstanding with respect to the property to 'be annexed, but under the current comprehensive plan of the City of Renton it is zoned for single family dwelling use.
