HomeMy WebLinkAboutORD 5024Amends ORD 4964 CITY OF RENTON, WASHINGTON ORDINANCE NO. 5024 AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, AMENDING SECTIONS 6-6-4 AND 6-6-11 OF CHAPTER 6, ANIMALS AND FOWL AT LARGE, OF TITLE VI (POLICE REGULATIONS) OF ORDINANCE NO. 4260 ENTITLED "CODE OF GENERAL ORDINANCES OF THE CITY OF RENTON, WASHINGTON" BY DEFINING "ANIMAL," AUTHORIZING THE FORFEITURE OF AN ANIMAL, AND ADOPTING RCW 16.52.085 TO AUTHORIZE THE TERMS OF THE REMOVAL AND RESTORATION OF AN ANIMAL. THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION I. Section 6-6-4 of Chapter 6, Animals and Fowl at Large, of Title VI (Police Regulations) of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton, Washington" is hereby amended by adding the following definition, to read as follows: ANIMAL: Any nonhuman mammal, bird, reptile, or amphibian. SECTION II. Section 6-6-11 of Chapter 6, Animals and Fowl at Large, of Title VI (Pohce Regulations) of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton, Washington" is hereby amended to read as follows: CRUELTY TO ANIMALS; FAILURE TO AID INJURED ANIMAL UNLAWFUL A. It shall be unlawful for any person to wilfully or cruelly injure or kill any animal by any mode or means causing it unnecessary fright or pain; it shall further be unlawful for any person, by neglect or otherwise, to cause or allow any animal to endure pain, suffering, or injury, or to fail or neglect to aid or attempt alleviation of any pain, suffering or injury so caused to any animal by such person or persons. A violation ofthis Section shall constitute a misdemeanor punishable by a fine of up to $1,000, not including costs, and up to 90 days in jail, and forfeiture of the animal or animals involved. Forfeiture is not mandatory. 1 ORDINANCE NO. 5024 Amends ORD 4964 B. Any law enforcement or animal control officer having probable cause to believe a violation ofthis Section has occurred may remove and restore the animal or animals in accordance with the applicable provisions of RCW 16.52.085. C. RCW 16.52.085 is hereby adopted by reference, as now or hereafter amended, and all other statutes adopted by reference therein as if fully set forth herein. SECTION III.
