HomeMy WebLinkAboutORD 4794 Amends: ORD 3454, 4437, 4587, 4722 Amended by Ords: 5355 CITY OF RENTON, WASHINGTON ORDINANCE NO. 4794 AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, AMENDING SUBSECTION 4-8-100.A.2.b OF CHAPTER 8, PERMITS AND DECISIONS, SUBSECTIONS 4-9-020.D, E, G AND H, AND SUBSECTION 4-9-180.F OF CHAPTER 9, PROCEDURES AND REVIEW CRITERIA, OF TITLE 4 (DEVELOPMENT REGULATIONS) OF ORDINANCE NO. 4260 ENTITLED "CODE OF GENERAL ORDINANCES OF THE CITY OF RENTON, WASHINGTON" BY AMENDING THE COMPREHENSIVE PLAN REVIEW PROCESS. THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION I. Section 4-8-100.A.2.b of Chapter 8, Permits and Decisions, of Title 4 (Development Regulations), of Ordinance No 4260 entitled "Code of General Ordinances of the City of Renton" is hereby amended as follows: b. To provide an opportunity for the City to be acquainted with a proposed application prior to review of a formal application. SECTION II. Subsections 4-9-020.D, E, G and H of Chapter 9, Procedures and Review Criteria, of Title 4 (Development Regulations), of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton" are hereby amended as follows: D. TIMING FOR AMENDMENTS: The City Council will consider amendments to the Comprehensive Plan not more than annually except for emergencies. Formal application for Comprehensive Plan amendments shall be submitted by December 15st for consideration the following year. Application for preapplication review is recommended to occur by October 1St. Comprehensive Plan 1 ORDINANCE NO. 4794 amendments shall be given the highest priority in the Planning Commission's work program, and review shall be initiated within the first quarter of the calendar year. E. SUBMITTAL REQUIREMENTS AND FEES Shall be as listed in RMC 4-1-170, Land Use Review Fees, and RMC 4-8-120.C, Land Use Applications. A fee shall only be charged for private amendments. G. REVIEW CRITERIA: The proposal shall demonstrate that the requested amendment is timely and meets at least one of the following criteria: a. The request supports the Vision embodied in the Comprehensive Plan, or b. The request supports the Adopted Business Plan Goals established by the City Council, or c. The request eliminates conflicts with existing Elements or policies, or d. The request amends the Comprehensive Plan to accommodate new policy directives of the City Council. Proposals that include a concurrent rezone request shall also comply with the decision criteria for change of zone classification in subsection 4-9-180.F for the re-zone portions of the application. H. REVIEW PROCESS: 1. Preapplication Review The City Council shall review pre-applications for Comprehensive Plan Amendments submitted by October 1st prior to determining the Planning Commission annual work program and before referring Comprehensive Plan Amendment applications to the Planning Commission. Preapplication review is recommended to advise applicants of City Council policy directives prior to submission of a formal application. The City Council shall consider whether proposed amendments are timely and satisfy the review criteria established in subsection 4-9-020.G. When an application is found to meet these criteria, the City Council shall 2 ORDINANCE NO. 4 7 9 4 authorize the inclusion of the application in the Planning Commission's work program. Authorization does not imply affirmative support of an application, but merely agreement to consider the application on its merits. 2. Review of Formal Applications for Comprehensive Plan Amendments The Planning Commission shall review technical studies and other pertinent information as needed prior to making a recommendation to the City Council on the merits of the application. If a Comprehensive Plan Amendment application is submitted without a preapplication authorization, the review criteria in subsection 4-9-020.G shall be considered by the Planning Commission in making its recommendation to the City Council. SECTION III. Section 4-9-180.F of Chapter 9, Procedures and Review Criteria, of Title 4 (Development Regulations), of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton" is hereby amended as follows. F. DECISION CRITERIA FOR CHANGE OF ZONE CLASSIFICATION: 1. Criteria for Rezones Requiring a Comprehensive Plan Amendment. The Reviewing Official shall find that: a. the proposed amendment meets the review criteria in subsection 4- 9-020.G, and b. the property is potentially classified for the proposed zone being requested pursuant to the polices set forth in the Comprehensive Plan, and c. at least one of the following circumstances applies: i. The subject reclassification was not specifically considered at the time of the last area land use analysis and area zoning; or 3 ORDINANCE NO. 4794 ii. Since the most recent land use analysis or the area zoning of the subject property, authorized public improvements, permitted private development or other circumstances affecting the subject property have undergone significant and material change. 2. Criteria for Rezones Not Requiring Plan Amendment. The Reviewing Official shall make the following findings: a. The rezone is in the public interest, and b. The rezone tends to further the preservation and enjoyment of any substantial property rights of the petitioner, and c. The rezone is not materially detrimental to the public welfare or the properties of other persons located in the vicinity thereof, and d. The rezone meets the review criteria in subsection 4-9- 180.F.1.b. and c. SECTION IV. This ordinance will be effective upon its passage, approval and five days after publication.
