RESOLUTION NO. 3 3 6 6
A RESOLUTION OF THE CITY OF RENTON, WASHINGTON, SETTING A
HEARING DATE TO VACATE A PORTION OF LAKE VIEW BOULEVARD
(104TH AVENUE S.E.) (LEGACY PARTNERS/MARTINDALE, ET AL., VAC-
98-004).
WHEREAS, a Petition has been filed with the City Clerk of the City of Renton on or about
December 10, 1998, pursuant to the requirements of RCW 35.79, petitioning for the vacation of a
portion of a certain street, as hereinafter more particularly described, and said petition having been
signed by the owners of more than two-thirds (2/3) of the property abutting upon a portion of said
street sought to be vacated, and same being described as follows:
See Exhibit "A" attached hereto and made a part hereof as if fully set forth herein.
(Portion of Lake View Boulevard (104th Avenue, S.E.) east of Lake Washington
Boulevard and south of N.E. 20th Street)
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON,
WASHINGTON, DO RESOLVE AS FOLLOWS:
SECTION I. That the 25th day of January, 1999, at the hour of 7:30 P.M. at the City
Council Chambers in the Municipal Building, Renton, King County, Washington, be and is hereby
fixed as the time and place when the aforesaid Petition for vacating the aforesaid portion of Lake View
Boulevard (104th Avenue, S.E.) shall be heard and determined, which said hearing date is not more
than sixty nor less than twenty days from the date of passage of this Resolution.
SECTION II. The City Clerk is hereby authorized and directed to give notice of said time and
hearing as provided in RCW 35.79.020 and any and/or all persons interested therein or objecting to
said vacation may then appear and be heard thereon, or they may file their written objections thereto
with the City Clerk at or prior to the time of hearing on said vacation.

SECTION M. The City Council shall determine, as provided in RCW 35.79.030, as to
whether an appraisal shall be secured to determine the fair market value of the property sought to be
vacated as provided for in Ordinance No. 4266, and the amount of compensation to be paid by the
Petitioner-Owners to the City for such vacation but which said amount shall not exceed one-half(1/2)
of the appraised value of the area to be vacated.
The City likewise reserves the right to retain an easement for public utility and related
purposes.

That portion of Lake view Boulevard (104th Avenue S.E.) as dedicated on the plat
of C.D. Hillman's Lake Washington Garden of Eden, Division No. 5, as per the plat
recorded in Volume 11 of Plats, page 83, records of King County, Washington,
lying adjacent to Lots 346, 347, 348, 350, 351, 352, 353, 354, 355 and 356, and
lying south of that City of Renton Road Vacation, Ordinance No. 4029, recorded at
King County Recorder's No. 8612031457 and lying north of that City of Renton
Road Vacation, Ordinance No. 2958, as recorded at No. 7508200648.
Situate in Government Lots 3 and 4 of Section 5, Township
23 North, Range 5 East, W.M. in King County, Washington.
