HomeMy WebLinkAboutRES 3177AM EN DIQ .61i -'.:>zJ' 3Cj l1O ~2-11 CITY OF RENTON,WASHINGTON I '15/7 I ORDINANCE NO.3177 AN ORDINANCE OF THE CITY OF RENTON,WASHINGTON AMENDING CHAPTER 3,TITLE X (TRAFFIC)OF ORDINANCE NO.1628 ENTITLED"f','CODE OFI'GENERAl:"ORDINANCES OF THE CITY OF RENTON,WASHINGTON"RELATING TO PARKING REGULATIONS ': THE CITY COUNCIL OF THE CITY OF RENTON,WASHINGTON,DO ORDAIN AS FOLLOWS: SECTION I:Existing Chapter 3,Title X (Traffic)of Ordinance No.1628 entitled "Code of General Ordinances of the City of Renton,Washington"is hereby amended to read as follows: ,-I' \ 10-301: 10-302: 10-303: 10-304: 10-305: 10-306: 10-307: 10-308: 10-309: 10-310: 10-311 : 10-301: CHAPTER 3 PARKING REGULATIONS DEFINITIONS METHOD OF PARKING PARKING RESTRICTED OR PROHIBITED AT ALL TIMES PARKING RESTRICTED OR PROHIBITED BY TIME LIMIT OR DURING CERTAIN HOURS STOPPING AND PARKING OF TRANSIT COACHES AND TAXI- CABS REGULATED SIGNS AND{OR MARKINGS REQUIRED PENALTIES AUTHORITY TO DESIGNATE PARKING RESTRICTIONS AND PROHIBITATIONS SEVERABILITY EMERGENCY POWERS EXISTING ORDINANCES REPEALED DEFINITIONS:The following definitions shall apply in the interpretation and enforcement of this Chapter. / Police Officer:Every officer of the Municipal Police Department or any official authorized by that Department to direct or regulate traffic or to issue citations for violations of parking regulations. Park,Parking,Stop,Stand or Standing:Means the halting of a vehicle,other than an Emergency Vehicle, whether occupied or not,except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic-control sign or signal. Vehicle:A machine propelled by power other than human power designed to travel along the ground or rail,by use of wheels,treads,runners or slides,and transport persons or property,or pull machinery,and shall include, without limitations,automobile,truck,trailer,motor- cycle,tractor,buggy,wagon and locomotive. -2"7 Transit Coach or Bus:Includes every vehicle designed for carrying more than ten (10)persons,and licensed for the commercial transportation of persons. Taxicab:A "for-hire"vehicle licensed by the City of Renton·for the carriage of passengers on the hasis of distance traveled. Public Carrier Zone or Stop:Means that portion of the street along the curb,or within a public property,for loading and unloading transit coaches. Taxicab Zone:Means that portion of the street along the curb for loading and unloadirlg City licensed taxicabs. Street:Every way,lane,road,public highway,boulevard, or place in the City of Renton,including parkways and boulevards within or without the limits of parks,open as a matter of right to public vehicle travel. Planting Strip:That portion of property lying between the constructed curb and the property line exclusive of the sidewalk area. Curb:The laterial boundaries of that portion of the street designated or intended for the use of vehicles, whether marked by curbing construction or not. Sidewalk:That portion of property adjacent to the planting strip,or if there be no planting strip,the curb,designated or intended for the use of pedestrians, whether marked by sidewalk construction or not. Alley:A puBlic thoroughfare within the ordinary meaning of alley not designated for general travel and primarily used as a means of access to the rear of residences and business establishments. Official Time Standard:Hhenever certain hours are sign- posted they shall mean standard time or daylight saving time as may be in current use in this City. Crosswalk:The portion of the roadway between the inter- section area and the prolongation or connection of the farthest sidewalk line,or,in the event there are no sidewalks,then between the intersection area and a line ten (10)feet therefrom,except as modified by marked crosswalks. Intersection:The area embraced within the prolongation of the lateral curb lines,or,if there he no curbs,then the lateral roadway boundary lines,of two or more streets which join one another at an angle,whether or not such streets cross one another. -3- Railroad Crossing:Means the crossing of a street and a railroad track,one over the other. Traffic-Control Signs or Signals:All signs,signals, markings and device'splaced,painted,or erected by authority of the City Council,the Director of Public Works,or a city official having jurisdiction for the purpose of regulating,warning,or guiding traffic. Driveway:That portion of street area which provides access to an offstreet vehicular facility through a depression in the constructed curb or when there is no constructed curb,that area in front of such vehic- ular facility as is well defined or as is designated by authorized signs or markings.Shall also include that portion of a driveway which curves to meet the street curb plus that portion extending five (5)feet beyond. Loading Zbne!A space adjacent to the curb reserved for the exclusive use of vehicles during the loading or unloading of passengers or materials. Fire Zone:That area within any public right of way, easement,or private property designated for the purpose of permitting fire trucks and other fire fighting or prevention equipment to use,travel upon and park. School Zone:That area upon either or both sides of any street adjacent to any school property on which the parking of a vehicle is prohibited or restricted. School Bus Zone or Stop:Means that portion of the street along the curb reserved for loading and unloading school buses. Restricted Parking Zone or Area:That portion of the street or public property on which the stopping,stand- ing or parking of a vehicle is limited to a specified period of time or for a specified purpose. Prohibited Parking Zone or Area:That portion of the street or public property on which the stopping,stand- ing or parking of a vehicle is prohibited during certain hours,or on certain days,or at all times. Public Property:Includes all real property owned or under the control of the City of Renton and maintained for the public's use. Licensed Vehicle:Means any vehicle which in accordance with State of Washington Department of Licenses Rules and Regula~ions,must bear one or more vehicle license plates while traveling upon a street or highway. 10-302: -4- Commercial Vehicle:Means any truck,or any passenger- type vehicle which is properly licensed as a truck and marked and/or modified in accordance with State of Wash- ington Department of Licenses Rules and Regulations, the principal use of which is the transportation of commodities,merchandise,produce,freight or animals. Travel or Moving Lane:Means that portion of the street, divided by markings and/or devices into two or more lanes, or in the absence of such markings and/or devices that portion of the street located five (5)feet both to the left and to the right of the center of the street,and intended for the movement of vehicular traffic. Cross-Hashed Barrier Area:Means that portion of the street or public property designated by white painted diagonal lines and bordered by a solid white line. Central Business District:Means that area within the district bounded as follows:Beginning at the northeast corner of South Second Street and Mill Avenue South, thence westerly along the north margin of South Second Street to the west margin of Rainier Avenue,thence southerly along the west margin of Rainier Avenue to the south margin of South Fourth Place,thence easterly along the south margin of South FourthPlace to the east margin of Shattuck Avenue South,thence northerly along the east margin of Shattuck Avenue South to the south margin of South Fourth Street,thence easterly along the south margin of South Fourth Street to the east margin of Main Avenue South,thence northerly along the east-margin of Main Avenue South to the south margin of Houser Way South,thence easterly along the south margin of Houser Wa~South to the south margin of South Third Street,thence easterly along the south margin of South Third to the east margin of Mill Avenue South to the northeast margin of South Second Street,the place of beginning. METHOD OF PARKING: (A)Standing or Parking Close to Curb:No person shall stand or park a vehicle in a roadway other than parallel with the edge of the roadway headed in the direction of lawful traffic movement and with the wheels of the vehicle on that side which is nearest to the edge of the roadway within twelve (12)inches of the curb or edge of the roadway,except as other- wise provided in this chapter. (B)Angle Parking:Upon those streets or public prop- erties which have been signed or marked for angle parking,no person shall park or stand a vehicle other than at the angle to the curb or edge of road- way indicated by such signs or markings. -5"': (C)Parking Stalls Or Spaces:Where parking stalls or spaces are marked or painted upon the curb and/ or pavement of the street or on public property, it shall be unlawful for the operator of any vehicle to park so that any part of such vehicle occupies more than one (1)such space or protrudes beyond the markings designating such space. (D)Permits for Loading or Unloading at an Angle to the Curb:Special permits may be issued to permit the backing of a vehicle to the curb for the purpose of loading or unloading merchandise or materials subject to the terms and conditions of such permits.Such permits may be issued either to the owner or lessee of real property or to the owner of the vehicle and shall grant to such person the privilege as herein stated and authorized and it shall be unlawful for any permittee or other person to violate any of the special terms or conditions of any such permit, provided,however,that no permit issued hereunder shall be exclusive. (E)Permits for Loading Zones:No loading zone shall be designated upon special request of any person unless such person make application for a permit for such zone and for two (2)signs to indicate the ends of each such zone,provided,however,that no permit issued hereunder shall be exclusive.The Director of Public Works,upon granting a permit and is suing such signs,.shall collect from the applicant and deposit in the City Treasury a service fee of twenty-five dollars ($25.00)per year or fraction thereof ~nd may by general regulations impose condi- tions upon the use of such signs and for reimburse- ment to the City for the value thereof in the event of their loss or damage and their return in the event of misuse or upon expiration of permit which shall expire at the end of one year. (F)Unattended Vehicles:No person driving or in charge of a vehicle shall permit it to stand unattended on any street,highway,alley,or public or private property without first stopping the engine,locking the ignition,removing the key,and effectively setting the brake thereon and,when standing upon any perceptible grade,turning the front wheels to the curb or side of the street or property. (G)Parking of Commercial Vehicles Within the Central Business District:Commercial vehicles,as defined herein,may park within a single travel or moving lane within the boundaries of the Central Business District,for the expressed purpose of expeditiously 10-303: loading or unloading materials or freight,for a period of time not to exceed thirty (30)minutes; provided,that at least nine (9)feet of the width of the street,excluding that portion of the street designated for parking if indicated by painted stalls,is left available for the free movement of vehicular traffic;further,provided,that such parking shall not be permitted between the daily hours of 6:30 a.m.to 8:30 a.m.and 3:30 p.m.to 5:30 p.m;further,provided,that such parking shall not be permitted on Sunday or on any "Public Holiday". No person shall park such a vehicle in a travel or moving lane in violation of this sub-section,or fail to immediately remove such vehicle upon the order of a police officer. STOPPING,STANDING,OR PARKING RESTRICTED OR PROHIBITED AT ALL TIMES: (A)Application of Chapter:The provisions of this Chapter prohibitIng or restricting the standing or parking of a vehicle shall apply at all times or as indicated on official signs except when it is neces- sary to stop a vehicle to avoid conflict with other traffic or in compliance with the directions of a police officer or official traffic-control device. (B)Non~Conformance with Posted Signs or Markings:Non- conformance with official posted signs or markings shall be prima-facie presumption that a violation of this Chapter has been committed. (C)Parking Not to Obstruct Traffic:No person shall park a vehicle upon a street or public property in such a manner or under such conditions as to obstruct the free movement of vehicular traffic in any travel or moving lane,except as otherwise provided in this Chapter. (D)Parking in Alleys:No person shall park a vehicle within an alley in such a manner or under such condi- tions as to leave available less than eight (8)feet of the width of the roadway for the free movement of vehicular traffic,and no person shall stop,stand, or park a vehicle within an alley in such a position as to block the driveway entrance to any abutting property. -7:" (E)Parkin~r Certain Purposes Prohibited:No person shall park a vehicle upon any roadway or public property for the purpose of: 1.Displaying such vehicle for sale or for advertising services for vehicles~ 2.Washing,greasing,or repairing such vehicle except repairs necessitated by an emergency. (F)Parking an Unlicensed Vehicle Prohibited:No person driving or in charge of a vehicle shall park or permit it to stand on a street,highway, alley,or public property unless said vehicle possesses a proper and current vehicle license plate or plates,and such plate or plates are properly mounted thereon in accordance with the State of Washington Department of Licenses Rules and Regulations,except as provided in this Chapter. (G)Parking Near C~swalkR~ulated:No person shall stop,stand or park a vehicle within twenty (20) feet of a crosswalk except as provided in this Chapter. (H)Parking Near Trafficc..Control Signs or Signals Regulated:No person shall stop,stand or park a vehicle within thirty (30)feet upon the approach to any flashing signal,stop sign,yield sign,or traffic-control signal located on the side of a roadway except as provided in this Chapter. (1)Parking \Nearor Within an Intersection Regulated: No person shall stop,stand or park a vehicle on or within twenty (20)feet of the boundaries of an intersection except as provided in this Chapter. (J)Parking Near Railroad Crossing Regulated:No person shall stop,stand or park a vehicle within fifty (50)feet of the nearest rail of a railroad crossing except as provided in this Chapter.Provided,how- ever~that this provision shall not apply to the stopping of a vehicle for the purpose of compliance with Section 46.61.350 R.C.W. (K)Parking Near Railroad Tracks Regulated:No person shall stop~stand~park a vehicle in such a manner as to block a railroad track or the movement of a train. (L)Parking Near Driveway Regulated:No person shall stop,stand or park a vehicle in such a manner as to block a driveway except as provided in this ,Chapter. 10-304: -8:'" (M)Parking on Sidewalk or Planting Strip Prohibited: No person shall stop,stand or~park a vehicle or any part thereof on a sidewalk or planting strip except as provided in this Chapter. (N)Parking in Violation of an Official Posted Sign: No person shall stop,stand or park a vehicle in violation of an official posted sign except as provided in this Chapter. (0)Parking Near Fire Hydrant Regulated:No person shall stand or park a vehicle within fifteen (15) feet of a fire hydrant except as provided in'this Chapter. (P)Parking in Specified Places Prohibited:No person shall park ~hicle in a Public Carrier Zone or Stop,or in a Taxicab Zone,or in a School Zone or School Bus Zone,except as provided in this Chapter. (Q)Parking on Bridge or in Tunnel Prohibited:No person shall stop,stand or park a vehicle on a bridge or within a tunnel,except as provided in this Chapter. (R)Parking in Fire Zone Prohibited:No person shall stop,stand or parr-a vehicle in a fire zone,except as provided in this Chapter. PARKING PROHIBITED OR RESTRICTED BY TIME LIMIT OR DURING CERTAIN HOURS: (A) (B) (C) (D) Overtim~:No person shall park a vehicle upon a street or public property for a longer period of time that the limit that is sign posted except as provided in this Chapter. Overtime-Repeated:Each subsequent period of time, as sign posted,lapsing following affixation to a vehicle of a notice of overtime parking shall consti- tute a separate offense except as provided in this Chapter. Moving Vehicle in Same Block:No person shall move and r~park a vehICle withIilthe same block or public property~o avoid a time limit regulation specified in that particular area except as provided in this Chapter. Parking Prohibited During Certain Hours:When offi- cial signs are erected in each block giving notice thereof,no person shall park a vehicle between the hours specified. 10-305: (E)Standing in Loading Zone:No person shall stop, stand,or park a vehicle in a designated Loading Zone for any purpose,or period of time,other than for the expeditious loading or unloading of passen- gers,not to exceed three (3)minutes;or the loading or unloading of materials,not to exceed thirty (30) minutes. (F)Parking Exceptions:Unless otherwise posted by appropriate signs,such parking shall not be pro- hibited on Sundays and Public Holidays."Public Holidays"'within the meaning of this Chapter embrace only those days for the observance of New Year's Day;Abraham Lincoln's birthday;George Washington's birthday;Memorial Day;Independence Day;Labor Day' Veteran's DaYi Thanksgiving DaYi and Christmas Day, on the dates so fixed by the City of Renton for the observance thereof. STOPPING,STANDING,AND PARKING OF TRANSIT COACHES AND TAXICABS REGULATED: (A)The operator of a transit coach shall not stand or park same upon any street or public property at any place other than a Public Carrier Zone or Stop so designated as pr0vided herein. (B)The operator of a transit coach shall not stop same upon any street or public property at any place for the purpose of loading or unloading passengers or baggage other than that at a Public Carrier Zone or Stop so designated as provided herein,except in case of emergency. \ (C)The operator of a transit coach shall enter a Public Carrier Zone or Stop on a street,in such a manner that the transit coach when stopped to load or unload passengers or'baggage,shall be in a position with the right front wheel of such vehicle not further than eighteen (18)inches from the curb and the transit coach approximately parallel to the curb so as not to impede unduly the movement of other vehicular traffic. (D)The operator of a taxicab shall not stand or park such vehicle upon any street or public property at any place other than in a taxicab zone so designated as provided herein.This provision shall not prevent the operator of.a taxicab from temporarily stopping in accordance with other stopping or parking regula- tions at any place for the purpose of and while actually engaged in the expeditious loading or un- loading of passengers or their baggage. 10-306: 10-307: 10-308 : -10,- SIGNS AND/OR MARKINGS REQUIRED:Whenever by this Chapter or any Amendments thereto,or by order of the Director of Public Works,any parking time limit,or parking restriction or prohibitation on any designated street or public property is imposed,it shall be the duty of the Director of Public Works to erect appropri- ate signs and/or markings giving notice thereof,and nQ regulation shall be effective unless said signs are erected and in place at the time of any alleged offense. Provided,however,that this provision shall not require the sign posting of a fire hydrantjrailroad crossing, crosswalk,intersection,travel lane,driveway,bridge, tunnel,cross-hashed barrier,or multiple laned street on which curb parking is not specifically designated by appropriate markings. (A)Nu!nbe'rof Signs Required:The number of signs shall be determined on the basis of sight distance impair- ment. (B)Painted CurhsRequired:With exception of fire hydrants,painte~curb markings shall not be utilized except in conjunction with appropriate signs. (1)The curbs of all areas designated as Fire Zones shall be painted red. (2)The curbs of all areas designated as Prohibited Parking Zones or areas,and the location of fire hydrants,may be painted red. (3)The curbs of all areas designated as Loading Zones,Taxi Zones,and School Bus Zones,shall be painted yellow. (4)The curbs of all areas designated as Public Carrier Zones or Stops shall be painted in alternating strips of red and yellow. PENALTIES:Any person violating any of the provisions of this Chapter shall be guilty of a misdemeanor,and upon conviction thereof shall be punished by a fine not to exceed one hundred dollars ($100.00). AUTHORITY TO DESIGNATE PARKING RESTRICTIONS AND PROHIB- ITIONS,TIME LIMITS,PARKING ZONES,AND APPROPRIATE SIGNS AND/OR MARKINGS:The Director of Public Works shall hereafter possess the authority and is required to: (A)Designate Public Carrier Zones or Stops and Taxicab Zones on such public streets or properties and in such places and in such number as he shall determine to be of the greatest benefit and convenience to the ,public. 10-310: 10-311: 10-312: -11- (B)Designate Fire Zones,Loading Zones,School Zones,Crosswalks,School Bus Stops or Zones, Restricted and Prohibited Parking Zones or Areas on such public streets or properties and in such places and in such number as he shall determine appropriate; (C)Approve and issue special permits for the loading or unloading at an angle to th~curb; (D)Designate upon what streets and public properties angle and/or parallel parking shall be permitted; (E)Designate all tra~fic-control signs or signals, in such places and in such number as he shall determine appropriate. (F)Designate all parking time limits. SEVERABILITY:If any provision of this Chapter or the application thereof to any person or circumstances is held invalid,the remainder of this Chapter and the application of such provisions to other persons or circumstances shall not be affected thereby. EMERGENCY POWERS:The Police Department is hereby authorized to direct all stopping,standing,or parking of vehicles,either in person or by means of visible or audible signals,in conformance with the provisions of this Chapter;provided,that when necessary to prevent or eliminate congestion or to safeguard persons or property,such officers may direct traffic as conditions may require,notwithstanding the pro- visions of t~is Chapter.
