RESOLUTION. NO. 3312
A RESOLUTION OF THE CITY OF RENTON, WASHINGTON,
.AUTHORIZING THE MAYOR AND CITY CLERK TO ENTER INTO A
PROJECT COOPERATION AGREEMENT WITH THE UNITED STATES
DEPARTMENT OF THE ARMY CORPS OF ENGINEERS FOR THE RENTON
: CEDAR RIVER SECTION 205 .FLOOD DAMAGE REDUCTION PROJECT.
WHEREAS, the Cedar River Flood Damage Reduction '.Project at
Renton, Washington, (hereinafter the "Project") was approved for
' construction by the Federal Government pursuant to the authority
contained in Section 205 of the Flood Control Act of 1948, as
amended, 33 U.S .C. 701s; and
WHEREAS, the Government and the City of Renton (hereinafter the
"Non-Federal .Sponsor" ) desire to enter into a Project Cooperation
Agreement for construction of the Project, as defined in Article
I .A. of this Agreement; and
WHEREAS, Section 103 (a) of the Water Resources Development Act
of 1986, Public Law 99-662, as amended, specifies the cost-sharing
requirements applicable to the Project; and
WHEREAS, under Section 205 of the Flood Control Act of 1948, as
amended, the Government may expend up to $5, 000, 000 on a single
flood control project; and
WHEREAS, Section 221 of the Flood Control Act of 1970, Public
Law 91-611, as amended, and Section 103 of the Water Resources
Development Act of 1986, Public Law 99-662, as amended, provide
that the Secretary of the Army shall not commence construction of
any water resources project, or separable element thereof, until

each non-Federal sponsor has entered into a written agreement to
furnish its required cooperation for the project or separable
element; and
WHEREAS, the Non-Federal Sponsor does not qualify for a
reduction of the maximum Non-Federal cost share pursuant to the
guidelines that implement Section 103 (m) of the Water Resources
Development Act of 1986, Public Law 99-662, as amended; and
WHEREAS, the Government and Non-Federal Sponsor have the full
authority and capability to perform as hereinafter set forth and
intend to cooperate in cost-sharing and financing of the
construction of the Project in accordance with the terms of this
Agreement;
NOW, .THEREFORE, THE CITY COUNCIL OF THE . CITY OF RENTON,
WASHINGTON, DO RESOLVE AS FOLLOWS :
SECTION I. The above recitals are found to be true and
correct in all respects .
SECTION II. The Mayor and City Clerk are hereby authorized
to enter into a Project Cooperation Agreement with the Federal
Government to construct the Renton Cedar River Section 205 Flood
Damage Reduction Project design and construction to provide
regional flood protection and protect environmental resources. The
Mayor is also authorized to sign the Statement of Financial
Capability and Financing Plan required by the Federal Government .
