HomeMy WebLinkAboutRES 3275 CITY OF RENTON, WASHINGTON' RESOLUTION NO. 3275 A RESOLUTION OF THE CITY OF RENTON, WASHINGTON, SETTING A HEARING DATE FOR VACATING A PORTION OF S.W. 12TH STREET BETWEEN MAPLE AVENUE S.W. AND RAINIER AVENUE S. AND THE ._._REMAINING UNVACATED ALLEY AREA BETWEEN GRADY WAY AND S.W. 12TH STREET IN THE AUTOMALL AREA (SNYDER AND SCARFF VAC 97-005) . WHEREAS, a Petition has been filed with the City Clerk of the City of Renton on or about June 23 , 1997, pursuant to the requirements of RCW 35 . 79, petitioning for the vacation of a portion of a certain street, as hereinafter more particularly described, and said petition having been signed by the owners of more than two- thirds (2/3) of the property abutting upon a portion of said street sought to be vacated, and same being described as follows : See Exhibit "A" attached hereto and made a part hereof as if fully set forth herein. (Portion of S .W. 12th Street between Maple Avenue S .W. and Rainier Avenue S . and the remaining unvacated alley area between Grady ' Way and S .W. 12th Street in the Automall area) NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO RESOLVE AS FOLLOWS : SECTION I. That the 15th day of September, 1997, at the hour of 7 : 30 P.M. at the City Council Chambers in the Municipal Building, Renton, King County, Washington, be and is hereby fixed as the time and place when the aforesaid Petition for vacating the aforesaid portion of S .W. 12th Street between Maple Avenue S .W. and Rainier Avenue S . and the remaining unvacated alley area between Grady Way and S .W. 12th Street in the Automall area shall be heard RESOLUTION NO. 3275 and determined, which said hearing date is not more than sixty nor less than twenty days from the date of passage of this Resolution. SECTION II. The City Clerk is hereby authorized and directed to give notice of said time and hearing as provided in RCW 35 . 79 . 020 and any and/or all persons interested therein or objecting to said vacation may then appear and be heard thereon, or they may file their written objections thereto with the City Clerk at or prior to the time of hearing on said vacation. SECTION III. The City Council shall determine, as provided in RCW 35 . 79 . 030, as to whether an appraisal shall be secured to determine the fair market value of the property sought to be vacated as provided for in Ordinance No. 4266, and the amount of compensation to be paid by the Petitioner-Owners to the City for such vacation but which said amount shall not exceed one-half (1/2) of the appraised value of the area to be vacated. The City likewise reserves the right to retain an easement for public utility and related purposes . D. Hillman's Earlington Gardens Addition to the City of Seattle Division No. 1 according to the plat thereof recorded in Volume 17 of Plats, page 74, records of King County, Washington, in the Northwest Quarter of Section 19, Township 23 North, Range 5 East, W.M., being more particularly described as follows: That portion of SW 12th Street beginning at the southwest corner of Lot 40 of said Block 16; Thence easterly along the southerly line of said Block 16 to an intersection with the SR-167 interchange right-of-way westerly line; Thence southerly along said westerly line to an intersection with a line seventeen (17) feet southerly of and parallel with the southerly line of said Block 16; Thence southwesterly along said parallel line to an intersection with the southerly extension of the west line of said Lot 40; Thence northerly along said extension to the point of beginning; ALSO, that portion of the alley through Block 16 of said plat, beginning at the southwest corner of Lot 28 of said Block 16; Thence northeasterly along the north line of said alley to an intersection with the east line of Lot 8 of said Block 16; Thence southerly along the southerly extension of said east line of Lot 8 to an intersection with the south line of said alley; Thence southwesterly along said south line to an intersection with the west line of said Block 16; Thence northerly to the point of beginning; C:\wordllegal\97_5_lgl.tgb6/97 / \ \1 ,CD.* .
