HomeMy WebLinkAboutRES 2965 CITY OF RENTON, WASHINGTON RESOLUTION NO. 2965 A RESOLUTION OF THE CITY OF RENTON, WASHINGTON AUTHORIZING AMENDMENTS TO THE CEDAR RIVER TRAIL OPEN SPACE PROJECT INVOLVING THE SCOPE, THE ACQUISITION PHASE AND THE EXPENDITURE SCHEDULE. WHEREAS, the City of Renton has entered into an Interlocal Cooperation Agreement with King County for Open Space Bond Issue funding to assist in the development phase of the Cedar River Trail Project; and WHEREAS, by Resolution No. 2785 adopted on February 16, 1990, the City Council of the City of Renton heretofore approved an Expenditure .. Schedule for the. total project . open space - funding allocation on a restricted,-basis.-.for..admInkstrati,ve and construction. .costs-,only; and WHEREAS., the..Wash�ingt:on..State Department: of::.Transportat'ion:. (WSDOT) is -now committed_ to ac°comp:lishing: a significant. .port:io.n-..-of` the. Cedar- River Trail design and construction as part of the WSDOT widening of SR-169, Maple Valley Highway; and WHEREAS, the City has been recommended for award of grant monies from the Washington State Department of Transportation and the Interagency Committee for Outdoor Recreation, thereby assisting and reducing the development costs of the Cedar River Trail; and WHEREAS, the City of Renton is committed to preserving the Conservancy Area of the Natural Zone and can best accomplish this by reducing the amount of footpath development, and therefore limiting intrusion into the Conservancy Area and; RESOLUTION N0. 2965 WHEREAS, the City Council of the City of Renton, Washington, considers it in the best public interest to revise the scope of the Cedar River Trail Project by adding a land acquisition phase (utilizing funds saved due to the WSDOT in-kind contribution, and potential award of I .A.C. grant monies and WSDOT grant monies) and limiting intrusion into the Conservancy Area and amending the Expenditure Schedule accordingly; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO RESOLVE AS FOLLOWS: SECTION I. The above recitals are found to be true and correct in all respects . SECTION II . The Mayor and City Clerk are hereby authorized to. ::enter iinto a Purchase and Sales Agreement upon completion of. --ascquIsItIon _,:nego.tiations . f:or purchase. of land: .(approximately 51 acres; 1n_,s:,i.ze) ...a.l,ong .-the Cedar. .River Trail subject to approval by the City Attorney.w: SEC-T:'ION"_-.III'. ._ Clo.sure,. of . the property"- same : is. to be_ contingent. upon s: a. Approval of the final sales price by the City Council of the City of Renton. b. A satisfactory Hazardous Waste Site Assessment Report being received for these parcels . C. Clean up of hazardous materials identified in assessment to be completed by owner. d. Certification by owner for the successful clean up of hazardous materials . -2- RESOLUTION N0. 2965 e. Demolition and removal by owner of existing structures that are not historic in nature. f. Approval of Change in Project Scope by the King County Open Space Citizens Oversight Committee. g. Approval of Change in Project Scope by the King County Council . h. Final award of grant monies by Interagency Committee for Outdoor Recreation. i. Approval of the status of title and transfer documents by the City Attorney. SECTION IV.
