HomeMy WebLinkAboutRES 2394 CITY OF RENTON, WASHINTON RESOLUTION NO . 2394 A RESOLUTION OF THE CITY OF RENTON PROVIDING LEGAL DEFENSE FOR CITY EMPLOYEES AGAINST LIABILITY CLAIMS ARISING OUT OF PERFORMANCE OF EMPLOYMENT DUTIES BY CITY EMPLOYEES WHEREAS a number of City employees perform discretionary services on behalf of the City of Renton on a day to day basis , and WHEREAS performance of such discretionary services may lead to lawsuits being brought against the City which may include naming the Citv employee as a co-defendant , and WHEREAS requiring the City employee to provide his or her own leal counsel to defend such a lawsuit would chill the employee ' s normal exercise of discretion, and ..tend to make that employee unnaturally conservative in making decisions , and WHEREAS the City Council believes it to be in the public interest to encourage City employees to make discretionary decisions without the fear of undue legal expense , now therefore THE CITY COUNCIL OF THE CITY OF PENTON , WASHINGTON, DO RESOLVE AS FOLLOWS : SECTION I : The above recitals are found to be true and correct in all respects . SECTION II : Whenever any City employee or administrative authority of the City is sued in connection with the performance of his , her or its function , and it appears that person or administrative authority has acted in good faith and without malice in verformance of such duties , then the City of Renton shall provide legal counsel to defend that employee or administrative authority either through an attorney appointed by the insurance company if such insurance is in existence , or alternatively , through the City Attorney' s office . Should the litigation result in a judgment against I I the employee or administrative authority, and it should appear that the employee or administrative authority was acting in good faith and within the scope of his , her or its duties , then any judgment rendered against that employee or administrative authority shall be paid by the City. Likewise , the City shall pay any claim made against the employee or administrative authority for performance of duties when it has been determined that claim should be paid in the manner the City would pay any judgment as detailed above .
