ORDINANCE NO. 3479
AN ORDINANCE 'OF THE CITY OF RENTON , WASHINGTON
REQUIRING BUSINESS PROPRIETORS TO EXCLUDE MINORS
FROM ANY ROOM OR PLACE WHERE DEVICES , CONTRIVANCES ,
INSTRUMENTS 'OR PARAPHMALIA FOR THE SMOKING,
INHALATION OR INGESTION OF MARIJUANA, HASHISH,
OR OTHER CONTROLLED SUBSTANCES ARE DISPLAYED OR
OFFERED FOR SALE, REQUIRING SALE AND DISPLAY ROOMS ,
DEFINING NUISANCE , AND PROVIDING PENALTIES FOR
VIOLATION OF THIS ORDINANCE.
THE CITY COUNCIL ..OF THE CITY OF RENTON, WASHINGTON, DO ORDAIN
AS FOLLOWS : '
SECTION I : The ,City' Council of. the City of Renton does puke
a finding that unrestricted display and sale by businesses of
drug paraphernalia may impress upon minors the conception that the
use of such paraphernalia with illegal drugs is endorsed by business
and condoned by the . community, and. .may encourage the acquisition and
experiementation with and use of narcotics paraphernalia by such
minors . It is further found that' 'it is in the public interest
that such display and sale of narcotic paraphernalia be regulated.
SECTION II Definitions (lyrontrolled substances"as used in
this ordinance is that term. defined in RCW '69 50. ; .the
Uniform Controlled Sib stanc.

(2) The termttparaphernalia"foY the purposes of this ordinance
includes , but is not limited to devices primarily designed for _and
is
intended for use by` individuals -for the smoking, inhalation or
ingestion of marijuana, hashish; hashish oil, cocaine, or any other
controlled substance, other than :prescription .,,drugs ,or devices to
ingest or inject prescription .drugs . The examples of paraphernalia
include those devices.,.commonly' known as hash pipes , .bongs , electric
pipe , buzz bomb., power hitter',., roach clip.. and .coke spoon.
(3) A device "designe.d primarily for" such smoking or ingestion
is a device which has been fabricated constructed, altered, adjusted
or marled , and peculiarly adapted to such purpose by virtue of a
distinctive feature or combination of features associated with drug

paraphernalia, notwithstanding the fact t_zat it may also be
possible to use such device for some other purpose .
(4) Minors to .be excluded. No owner , proprietor or
other personal in 'charge of any .room in any place of business where
any device , contrivance, instrune.nt. or paraphernalia which is
primarily designed for or intended to be used for the smoking,
ingestion or consumption of. marijuana,- hashish, PCP, or any
controlled substance, other than prescription drugs and devices
. to ingest or inject prescription drugs , is sold or displayed for the,
Purpose of sale may allow . or permit any person under the age of
eighteen (18) years to be. in, remain- in, enter or visit such room
unless such minor person is accompanied by. one of his or her parents ,
or by his or her legal guardian. Likewise , no person under the age
of eighteen (18). -years maybe, in remain in, enter or visit any
such room unless accompanied by one of his or her parents , or by
his or her legal guardian.
(5) Sale and Display Rooms . No . person may maintain, in any
place of business to which the public is invited, the display for
sale , or the offering to sell , of devices, contrivances , instruments
or paraphernalia which are primarily designed for or intended to. be
used for the smoking,- ingestion, ;or consumption of marijuana; `
hashish, PCP, or any controlled substance, other than prescription
drugs and devices to ':ingest or, inject prescription drugs , unless
within a separate room or enclosure to ,which minors not accompanied
by parent or legal guardian are excluded. Each entrance to such .a
room or enclosure shall be .posted. with a sign in reasonably visible
and legible words to the effect that items which are defined as
drug paraphernalia under this ordinance are being offered for sale
in such a room,. and that minors , unless .accompanies by a parent
or legal guardian, are excluded.
(6) Nuisance, The distribution or possession for the
purpose of sale ; exhibition or display, in- any place of business
from which minors are not excluded as set forth in this ordinance ,
of narcotics paraphernalia, is hereby declared to be a public
nuisance and may abated by the City of Renton. This remedy
shall be in addition to any other remedy provided by law, including
penalty provisions applicable for the violation of the terms and
provisions of this ordinance.
(7) Penalty. Any person convicted of having violated this
ordinance shall be . guilty of a misdemeanor and shall be punished
by a fine of not more .than $5.00. 00 or a jail sentence of not more
than ninety (90) days , or both.
SECTION III : Severability, The invalidity or unconstitutionality
of any provision, section; sentence or word of this ordinance shall
not render any..other provision, section, sentence or word of this
ordinance invalid or unconstitutional.:
