HomeMy WebLinkAboutORD 3598 CITY OF RENTON, WASHINGTON ORDINANCE NO. 3598 AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, CLARIFYING CERTAIN ZONING CLASSIFICATIONS, RATIFYING PAST ZONING ACTIONS AND REZONING CERTAIN PARCELS OF PROPERTY WITHIN THE CITY OF RENTON WHEREAS the City of Renton has previously adopted a zoning ordinance for the entire City of Renton, and WHEREAS that zoning ordinance has included a method for rezoning certain parcels of property, and WHEREAS that rezone procedure has included a section for automatic reversion of zoning if the property is not used at the higher zoning classification within a specific period of time, such as six months under Ordinance No. 1472 , and one year, subject to an extension of one year under Ordinance No. 1703, and WHEREAS these automatic reversion ordinances did not contain specific procedures, rules or regulations for the implementation of such automatic reversion, and WHEREAS the current status of the law requires a public hearing and a formal ordinance prior to the rezoning or reversion in zoning of any parcel of land, and WHEREAS the City has previously reverted certain parcels of property because of failure to implement the higher zoning classification, but in other circumstances did not take the necessary administrative action to revert the zoning, and WHEREAS this inconsistent procedure has lead to a potential uncertainty in the minds of the public as to the current status of zoning within the City of Renton, and WHEREAS this uncertainty has lead to the administration of the City being uncertain as to whether or not it should issue building permits when parcels were subject to reversionary zoning, but that reversionary zoning was not administratively implemented, and it being advisable to clarify the situation for the benefit Al, of the general public, and `? WHEREAS a public hearing was held on this matter, following notice to the public as required by statute, and this matter having been treated as an area wide or City wide rezone, and a public hearing having been held on December 28, 19831. THE CITY COUNCIL OF THE CITY OF RENTOR+, WASHINGTON, DO ORDAIN AS FOLLOWS : SECTION I: The above recitals are found to be true and correct. SECTION II: In those instances in which property was upzoned subject to a reversionary clause, and the a6ministration of the City has not formally taken the ministerial action cf down-.zoning that property on the City' s zoning maps , then the last formai Council action taken by Ordinance is hereby ratified and adopted as the official zoning status of the pror.erty in question. SECTION III: In those instances in which the property was subject to automatic reversion, and the administraion has taken the ministerial action of changing the zoning maps , then the zoning map classification is hereby adopted and ratified as the current and correct zoning. SECTION IV: The zoning map of the City of Renton shall be updated, and presented to the Council thereafter and shall be updated and presented to the Council on a yearly basis , for adoption by the Council as the formal and legal zoning classification for the properties within the corporate limits of the City of Renton.
